He had filed Regular Civil Suit<br \/>\n\tNo.110 of 2000 before the learned Civil Judge (Junior Division),<br \/>\n\tBorsad with respect to land bearing survey No.371 of Village:<br \/>\n\tBhetasi, Tal. Borsad. Along with the suit, the plaintiffs i.e. the<br \/>\n\tpresent petitioner and respondent No. 2 to 5 had also filed interim<br \/>\n\tinjunction application Exh.5 and prayed inter-alia that the<br \/>\n\tdefendant be prevented from entering the suit land or from<br \/>\n\tobstructing the plaintiffs in cultivating and enjoying possession<br \/>\n\tthereof. The defendant i.e. respondent No.1 herein had also filed a<br \/>\n\tcounter injunction application Exh.21.\n<\/p>\n<p>2.1\tIt<br \/>\n<span class=\"hidden_text\">\tappears that the respondent Nos. 2 to 5<\/span><br \/>\n\therein are owners of the suit land. They have allegedly sold the<br \/>\n\tland in favour of the petitioner herein in the year 2000. The<br \/>\n\tdefendant- present respondent No.1 claims to be in actual and lawful<br \/>\n\tpossession thereof since time of his forefathers and had therefore,<br \/>\n\topposed the suit and interim injunction application.\n<\/p>\n<p>2.2\tThe<br \/>\n\ttrial Court by its order dated 6.12.2000<br \/>\n\trejected Exh.5 application of the plaintiffs and granted counter<br \/>\n\tinjunction application Exh.21 filed by the defendant-respondent No.1<br \/>\n\therein.\n<\/p>\n<p>2.3\tThe<br \/>\n\tpresent petitioner challenged the said order passed by the trial<br \/>\n\tCourt by filing appeal being Misc. Civil Appeal No 736 of 2006 which<br \/>\n\tappeal, however, came to be dismissed by an order dated 12.5.2006<br \/>\n\tpassed by the Presiding Officer, 2nd Fast Track Court,<br \/>\n\tAnand, upon which, the present petition has been filed by the<br \/>\n\toriginal plaintiff No.5.\n<\/p>\n<p>Learned<br \/>\n\tadvocates appearing for the petitioner as well as respondents No. 2<br \/>\n\tto 5 strongly contended that the respondent No.1 herein original<br \/>\n\tdefendant has no right, title and interest over the suit land. He<br \/>\n\twas also not in possession thereof. The Courts below, therefore,<br \/>\n\terred in granting injunction in his favour. They, further, submitted<br \/>\n\tthat the land originally belonged to the predecessors-in-title of<br \/>\n\tplaintiff No.1 to 4 i.e. Respondent Nos.2  to 5 herein. Uncle of the<br \/>\n\trespondent No.1, Maganbhai, had given loan to the predecessors of<br \/>\n\tthe original owners but the entire loan amount was repaid and the<br \/>\n\tland mortgaged was reclaimed. Thereafter, neither Maganbhai nor any<br \/>\n\tof the heirs had any right to occupy the suit land. In any case,<br \/>\n\tpresent respondent No.1 is not even son of Maganbhai and he,<br \/>\n\ttherefore, has no right at all on the suit land. It was further<br \/>\n\tcontended that there was no evidence on record to permit the Courts<br \/>\n\tbelow to hold that respondent No.1 was in actual lawful possession<br \/>\n\tof the suit land.\n<\/p>\n<p>\tOn the other hand<br \/>\n\ton behalf of the respondent No.1 it was contended that there was<br \/>\n\tdocumentary evidence to show that father of the respondent No.1 and<br \/>\n\tthereafter, respondent No.1 himself continued to cultivate the land<br \/>\n\tfor years.\n<\/p>\n<p>Having<br \/>\n\theard the concerned parties, I find that this petition arises out of<br \/>\n\ttwo orders passed by the Courts below at interlocutory stage. As<br \/>\n\talready noted, the trial Court found, as a matter of fact that<br \/>\n\trespondent No.1 was in actual possession of the suit land. In coming<br \/>\n\tto such a conclusion, the Court observed that father of the<br \/>\n\tdefendant had for years together paid land revenue for the suit<br \/>\n\tland. Name of the father of the defendant was shown as occupier of<br \/>\n\tthe land in 7\/12 Forms. The revenue record also showed that he was<br \/>\n\tcultivating the land personally since 1954-55. The learned Judge<br \/>\n\topined that report of the Court Commissioner was contrary to the<br \/>\n\tdocumentary evidence. Even the report suggested that there was<br \/>\n\tfreshly prepared shed and the tin sheds were brand-new. He,<br \/>\n\ttherefore, believed that there was an attempt to show the possession<br \/>\n\tof the plaintiffs. The plaintiffs had in the suit stated that the<br \/>\n\tdefendant had threatened to disturb the possession of the plaintiff<br \/>\n\ttwo or three days before, which<br \/>\n\trequired them to file the suit which was presented on<br \/>\n\t16.6.2000 whereas, in support of<br \/>\n\tthe plaint, affidavits of neighbors were presented which were dated<br \/>\n\t31.5.2000. The learned Judge also observed that in the disputed land<br \/>\n\tfor the first time on 12.11.1999 entry No.3054 was entered in<br \/>\n\tthe revenue records and shortly, thereafter, the entry was certified<br \/>\n\ton 8.3.2000. The land was<br \/>\n\timmediately sold by the owners to plaintiffs No.5 on 5.4.2000 and in<br \/>\n\tthe meantime, entry No.3054 was challenged and stayed by the<br \/>\n\tappellate Authority. On all these grounds, the learned Judge<br \/>\n\twas pleased to reject the Exh.5 application of the plaintiffs and<br \/>\n\tallowed application Exh.21 of the defendant No.1 for counter<br \/>\n\tinjunction.\n<\/p>\n<p>Appellate<br \/>\n\tCourt also in detailed order concurred with the view of the trial<br \/>\n\tCourt and dismissed the appeal.\n<\/p>\n<p>I<br \/>\n\tdo not find that the conclusions of the Courts below are perverse so<br \/>\n\tas to permit interference by this Court in exercise of writ<br \/>\n\tjurisdiction under Article 226 and\/or 227 of the Constitution of<br \/>\n\tIndia. Interestingly, though the plaintiffs relied on an alleged<br \/>\n\tcompromise between the parties, it may be noted that neither present<br \/>\n\trespondent No.1 nor other male members of the family were parties<br \/>\n\ttherein. Even otherwise, I find that the conclusions were well<br \/>\n\tsupported from the material on record. The petitioner has not been<br \/>\n\table to explain the continuous entry in the revenue records in<br \/>\n\tfavour of the father of respondent No.1. When respondent No.1 and<br \/>\n\tearlier his father had year after year for decades together paid<br \/>\n\trevenue for the said land, it was a relevant factor which was<br \/>\n\trightly considered by the Courts below. They produced series of such<br \/>\n\treceipts. They had also produced supporting affidavits of the<br \/>\n\tfarmers having land in the nearby area. If the original plaintiffs<br \/>\n\tNos. 1 to 4 were in actual lawful possession of their own land,<br \/>\n\tthere is no reason why they should not have objected to the name of<br \/>\n\tthe father of respondent No.1 continuously for years together and<br \/>\n\tland revenue being paid by the father of respondent No.1 and<br \/>\n\tthereafter, respondent himself for years together. It is true that<br \/>\n\trevenue entries do not provide conclusive proof. However, coupled<br \/>\n\twith other attending circumstances and materials when two Courts<br \/>\n\tbelow have arrived at factual findings regarding the possession of<br \/>\n\tthe respondent No.1, I do not find that this is a case where such<br \/>\n\tfactual finding can be reversed.\n<\/p>\n<p>In<br \/>\n\tthe result, petition fails and is hereby dismissed. Rule is<br \/>\n\tdischarged. Interim relief stands vacated.
