According   to   the      writ    petitioner,   originally   his\n\n           grievance was that he was not given first time bound\n\n           promotion with effect from 23.11.1977 and Second time\n\n           bound promotion with effect from from 23.11.1989 and\n\n           consequential monetary benefits due to such promotion.\n\n           Petitioner\/appellant has also prayed that Rs. 8825\/- has\n\n           been    wrongly    recovered           from   him    and,   therefore,\n\n           respondents may be directed to refund the said amount.\n\n           3.     It appears from the impugned order dated 07.05.2009\n\n           passed in W.P.(S) No. 3224\/08 that so far as first time\n\n           bound promotion with effect from 23.11.1977 and Second\n\n           time bound promotion with effect from 23.11.1989 are\n\n           concerned, they were redressed. So far as petitioner's\n\n           claim    for   refund     of     Rs.    8925\/-   and   consequential\n\n           pensionary benefits are concerned, the same have been\n\n           rejected by the impugned order dated 07.05.2009 on the\n\n           ground that a mistake was detected by the Office of the\n\n           Accountant General and it was found that                mistake was\n                        -2-\n\ncommitted     in   fixation   of   salary    of   the   writ\n\npetitioner\/appellant and, therefore, he was called upon to\n\nrefund the amount of Rs. 8925\/-.\n\n4.   According to the respondents, petitioner voluntarily\n\nrefunded that excess amount and therefore, the writ\n\npetitioner \/appellant could not have raised any grievance\n\non this count. Argument of the respondent prevailed and\n\nthe writ petition of the petitioner was dismissed. Hence,\n\nthis L.P.A. has been preferred.\n\n5.   Learned counsel for the writ petitioner      submitted\n\nthat respondents themselves have passed appropriated\n\norder of fixation of salary of the writ petitioner and\n\nthereafter, petitioner retired in the month of January, 2002.\n\nPetitioner's pension was due and therefore, he was under\n\ncompulsion to refund the amount of Rs. 8925\/- and he paid\n\nthe said amount so as to get the renaming amount of his\n\nother benefits running in lacs of rupees.\n\n6.   Learned counsel for the petitioner submitted that\n\nneither petitioner committed any wrong or fraud upon the\n\nrespondents to get the fixation of his salary nor petitioner\n\nwas ever given any show cause notice and opportunity of\n\nhearing   before alleging that the petitioner's salary was\n\nwrongly fixed and no order to      withdraw the fixation of\n\nsalary of the petitioner was ever passed by the respondents\n\nand straightway, on the basis of the objection raised by the\n\noffice of the Accountant General, not only that amount of\n\nRs. 8,925\/- has been recovered, but consequently          his\n                               -3-\n\npension has also been reduced.\n\n7.   Learned counsel for the State submitted that the\n\npetitioner was given wrong pay fixation and this fact was\n\ndetected by the office of the Accountant General and this\n\nmistake     cannot      be    disputed        by     the    writ   petitioner-\n\nappellant.\n\n8.   Learned          counsel        for    the      Accountant       General\n\nsubmitted that it is the obligation of the State to give the\n\ncomplete Service Book of the employee to the office of the\n\nAccountant General 18 months prior to retirement of the\n\nemployee.        However,       the    Accountant           General's        office\n\nreceived the Service Book of the petitioner after his\n\nretirement. Therefore, before the retirement of the writ\n\npetitioner-appellant, the Accountant General's office could\n\nnot examine the case of the writ petitioner for grant of\n\nretiral benefits. Immediately, when mistake was detected\n\nby   the     office    of    the      Accountant           General,     it    was\n\ncommunicated to the State and the employer consequently\n\nraised     the    demand        of    above        said    amount     and       in\n\nconsequence        thereof,      the       pension    amount       has       been\n\nreduced that was a natural consequence.\n\n9.   Learned          counsel        for    the      Accountant       General\n\nsubmitted that Hon'ble Supreme Court, in the case of\n\nUnion of India Vs. S.R.Dhingra and Others, reported in\n\n(2008) 2 SCC 229 clearly held that correction of clerical\n\nmistake can be made and pension initially calculated by\n\ncalculating average emoluments which included running\n                             -4-\n\nallowances        but    subsequently       a   clarification      dated\n\n29.12.1999<\/pre>\n
 was issued by the Railway Board stating that<\/p>\n
running allowances was not to be taken into consideration,<\/p>\n
then in that situation, revision of pension on account of<\/p>\n
mistaken calculation of pension is permissible.<\/p>\n
10. Learned counsel for the Accountant General also<\/p>\n
relied upon another Division Bench judgement of this Court<\/p>\n
delivered in the case of Ram Chandra Singh Vs. State of<\/p>\n
Jharkhand & Others reported in 2005(2) JLJR 705<\/p>\n
wherein also Hon’ble Supreme Court judgement delivered<\/p>\n
in the case of Sahib Ram Vs. State of Haryana and<\/p>\n
others reported in 1995 Suppl (1) SCC 18 was<\/p>\n
distinguished and it was held that the mistakes in such<\/p>\n
matter can be corrected.\n<\/p>\n
11. Learned counsel for the Accountant General further<\/p>\n
relied upon Division Bench judgement of this Court<\/p>\n
delivered    in    the    case     of    Rameshwar        Prasad    Vs.<\/p>\n
Jharkhand State Electricity Board & others reported in<\/p>\n
2009(3) JCR 207 wherein, taking the same view, revision<\/p>\n
of pension was upheld.\n<\/p>\n
12. Learned counsel for the Accountant General then<\/p>\n
further relied upon yet another judgement of the Supreme<\/p>\n
Court delivered in the case of I.C.A.R. & another Vs.<\/p>\n
T.K.Suryanarayan           &      Ors.    reported   in    1997     (7)<\/p>\n
Supreme 635.\n<\/p>\n
13. We have considered the submissions of the learned<\/p>\n
counsel for the parties and also perused the judgements
\n                         -5-<\/span><\/p>\n
cited by learned counsel referred above.<\/p>\n
14. A bare perusal of all the judgements reveals that in<\/p>\n
none of the cases the issue was there that an order was<\/p>\n
passed for pay fixation by the employer during the service<\/p>\n
tenure of the employee and thereafter the employee was<\/p>\n
made to retire on the basis of the pay which he was getting<\/p>\n
when he was in service. In none of the cases issue was<\/p>\n
available that any order to rectify the mistake was not<\/p>\n
passed by any competent authority i.e., the employer and<\/p>\n
yet the revision in pay after retirement of employee is<\/p>\n
sought and pension has been effected. Here in this case,<\/p>\n
admittedly the petitioner retired on 31.01.2002 and got the<\/p>\n
last pay according to a particular amount. The petitioner,<\/p>\n
therefore,   was   entitled   to   pension   to   be   calculated<\/p>\n
according to his last paid salary. If the petitioner’s pay was<\/p>\n
wrongly fixed, then that could have been corrected by<\/p>\n
passing appropriate order after giving opportunity of<\/p>\n
hearing to the writ petitioner and that also could have been<\/p>\n
done during the service period. The petitioner’s pay, fixed<\/p>\n
long back when he was in service, could not have been<\/p>\n
altered after his retirement merely on account of the<\/p>\n
objection raised by the office of the Accountant General<\/p>\n
and that too, without giving any show cause notice and<\/p>\n
opportunity of hearing to the petitioner and in this case it<\/p>\n
is admitted case that even after communication from the<\/p>\n
office of the Accountant General, no order has been passed<\/p>\n
to withdraw the revision of pay or pay fixation of the writ
\n                                           -6-<\/span><\/p>\n
                 petitioner and, therefore, in view of the objection of the<\/p>\n
                 office of the Accountant General only, the order of pay<\/p>\n
                 fixation\/salary fixation of the writ petitioner cannot be<\/p>\n
                 nullified.\n<\/p>\n
                 15. In view of the above, the respondents could not have<\/p>\n
                 ordered for recovery of the amount of Rs. 8,925\/- which has<\/p>\n
                 been recovered from the petitioner after his retirement and<\/p>\n
                 that too without passing any order of withdrawal, the order<\/p>\n
                 of salary fixation\/pay fixation.\n<\/p>\n
                 16. Therefore, the L.P.A. is allowed. The order of recovery<\/p>\n
                 of Rs. 8,925\/- from the petitioner is quashed and set aside.<\/p>\n
                 The respondents are directed to refund the said amount to<\/p>\n
                 the writ petitioner-appellant with interest @ 9% per annum<\/p>\n
                 from the date when it was deposited with the respondents.<\/p>\n
                 The respondents are further directed to make appropriate<\/p>\n
                 re-calculation of pension of the writ petitioner-appellant<\/p>\n
                 and pay the arrears to the writ petitioner in accordance<\/p>\n
                 with Rules as well as shall pay the pension according to<\/p>\n
                 such calculation for future. All actions required to be taken<\/p>\n
                 by the respondents, be completed within a period of two<\/p>\n
                 months from today.\n<\/p>\n<\/p>\n
