Sharma, Advocate\n             for the petitioner.\n             ***\n\nARVIND KUMAR, J.\n<\/pre>\n<p>             The petitioner is aggrieved with the order dated 24.2.2009<br \/>\npassed by the learned trial court by virtue of which his application under<br \/>\nSection 319 Cr.P.C. for summoning and trial of Smt. Urmila along with<br \/>\nother accused has been dismissed.\n<\/p>\n<p>             The marriage of sister of petitioner namely Smt. Sunita was<br \/>\nsolemnized with Bhoop Singh, the brother of Smt. Urmila on 22.2.2008.<br \/>\nSmt. Sunita was found dead in her matrimonial house on 16.8.2008. On the<br \/>\nbasis of complaint made by the petitioner, case FIR No.129 dated 16.8.2008<br \/>\nwas registered under Section 304-B read with Section 34 IPC. Although the<br \/>\ncomplainant in the said complaint named as many as eleven persons<br \/>\nincluding father-in-law, mother-in-law, husband, husband&#8217;s brother and<br \/>\nsister and some other relatives, but after investigation the challan was<br \/>\npresented in the Court against father-in-law, mother-in-law, husband and<br \/>\nbrother-in-law while the remaining were found innocent.\n<\/p>\n<p>             During the trial, after the recording of examination-in-chief of<br \/>\ncomplainant as PW.1, an application under Section 319 Cr.P.C. was filed<br \/>\nfor summoning of Smt. Urmila, which, as noticed above, has been dismissed<br \/>\nby the trial court. Hence this revision petition.\n<\/p>\n<p>             I have heard learned counsel for the petitioner and have also<br \/>\ngone through the paper-book file carefully.\n<\/p>\n<p><span class=\"hidden_text\">                                       2<\/span><\/p>\n<p>               The provisions of Section 319 of the Code confers an extra<br \/>\nordinary power and should not be easily resorted to. It is well settled that<br \/>\nsweep of Section 319 Cr.P.C. is limited as it is an enabling provision which<br \/>\ncan be invoked only if there is convincing evidence disclosing the<br \/>\ncomplicity of the person other than the person (s) already arraigned as<br \/>\naccused. Admittedly, Smt. Urmila is married sister of husband of deceased<br \/>\nSmt. Sunita and is residing at a far off place in her matrimonial home. The<br \/>\nperusal of FIR as well as examination-in-chief of complainant though<br \/>\nreveals that the complainant has stated therein that sister-in-law was also<br \/>\ninstrumental in demand of dowry and harassment to his sister Sunita, but by<br \/>\nmerely mentioning the name of a person as an accused, criminal liability<br \/>\ncannot be fastened upon the same. There has to be some other material on<br \/>\nrecord which may prompt the Court to believe that the person so accused<br \/>\nhas complicity in the offence and her\/his conviction is likely to result in the<br \/>\neventuality of facing the trial, which is missing in this case. The Hon&#8217;ble<br \/>\nSupreme Court in the case of <a href=\"\/doc\/1335414\/\">Michael Machado v. Central Bureau of<br \/>\nInvestigation,<\/a> 2000(2) RCR (Criminal) 75 (SC) has observed as under:-\n<\/p>\n<blockquote><p>                   &#8220;11. The basic requirements for invoking the above<br \/>\n                   section is that it should appear to the Court from the<br \/>\n                   evidence collected during trial or in the inquiry that some<br \/>\n                   other person, who is not arraigned as an accused in that<br \/>\n                   case, had committed an offence for which that person<br \/>\n                   could be tried together with the accused already<br \/>\n                   arraigned. It is not enough that the Court entertained<br \/>\n                   some doubt, from the evidence, about the involvement of<br \/>\n                   another person in the offence. In other words, the Court<br \/>\n                   must have reasonable satisfaction from the evidence<br \/>\n                   already collected regarding two aspects. First is that the<br \/>\n                   other person has committed an offence. Second is that for<br \/>\n                   such offence that other person could as well be tried<br \/>\n                   along with the already arraigned accused.\n<\/p><\/blockquote>\n<blockquote><p>                   12. But even then, what is conferred on the Court is only<br \/>\n                   a discretion as could be discerned from the words &#8220;the<br \/>\n<span class=\"hidden_text\">                                        3<\/span><\/p>\n<p>                    Court   may    proceed    against    such   person&#8221;.   The<br \/>\n                    discretionary power so conferred should be exercised<br \/>\n                    only to achieve criminal justice. It is not that the Court<br \/>\n                    should turn against another person whenever it comes<br \/>\n                    across evidence connecting that another person also with<br \/>\n                    the offence. A judicial exercise is called for keeping a<br \/>\n                    conspectus of the case, including the stage at which the<br \/>\n                    trial has proceeded already and the quantum of evidence<br \/>\n                    collected till then, and also the amount of time which the<br \/>\n                    Court had spent for collecting such evidence. It must be<br \/>\n                    remembered that there is no compelling duty on the<br \/>\n                    Court to proceed against other persons.&#8221;<\/p><\/blockquote>\n<p>              In the above facts, no fault could be found with the approach of<br \/>\nthe learned trial court while dismissing the application of the complainant<br \/>\nunder Section 319 Cr.P.C.
