Public Prosecutor for the State waives the service.\n<\/p>\n<p>\tHeard learned Advocate Mr.Ashish Dagli, for the applicant and<br \/>\n\tMr.R.C. Kodekar,  learned Addl. Public Prosecutor for the respondent<br \/>\n\t?  State.\n<\/p>\n<p>\tPresent application is filed by the applicant ?  original accused ?<br \/>\n\tPritiben wife of Ketanbhai Shah for releasing her on bail in<br \/>\n\tconnection with the complaint being CR No.I-155 of 2007<br \/>\n\tregistered with Wadhwan  Police Station  for the offences<br \/>\n\tpunishable under secs.406, 409, 420 of Indian Penal Code.\n<\/p>\n<p>\tMr.Dagli, learned advocate appearing on behalf of the applicant has<br \/>\n\tvehemently submitted that  investigation is already concluded and<br \/>\n\tchargesheet is filed and there is no possibility of tampering with<br \/>\n\tthe evidence and\/or witnesses. It is further submitted that the<br \/>\n\tapplicant is a lady who is in jail since 29\/1\/2008. He has also<br \/>\n\tfurther submitted that the applicant has two minor children and both<br \/>\n\tchildren are school going. He has also further submitted that the<br \/>\n\thusband of the applicant is also in jail and there is nobody to<br \/>\n\tlook-after those two minor children. It is also further submitted<br \/>\n\tthat as such the first complaint was filed being CR No.I-7 of 2007<br \/>\n\tand the statement of the complainant was recorded on 26\/2\/2008 and<br \/>\n\tin the said statement, the name of the applicant was not figured and<br \/>\n\tsubsequently  after a period of about eight months, the applicant<br \/>\n\tsought to be implicated and shown as accused No.2. Submitting<br \/>\n\taccordingly, it is requested to release the applicant on bail.\n<\/p>\n<p>\tMr.Dagli,  learned advocate appearing on behalf of the applicant,<br \/>\n\tunder the instructions of his client and her husband, has submitted<br \/>\n\tthat if the applicant is released on bail, her husband shall not<br \/>\n\tclaim any parity on the ground that as the present applicant is<br \/>\n\treleased, he be also released on bail on the ground of parity. He<br \/>\n\thas also further submitted that even otherwise, the case of the<br \/>\n\tapplicant cannot be compared with her husband, as the applicant is a<br \/>\n\tlady.\n<\/p>\n<p>\tMr.Kodekar, learned Additional Public Prosecutor   while opposing<br \/>\n\tthe present application has submitted that the applicant and her who<br \/>\n\twere agent in the Post Office has misappropriated a huge amount of<br \/>\n\tvarious depositors and even the applicant was also with her husband<br \/>\n\tat the relevant time  and hence the applicant cannot be released on<br \/>\n\tbail. It is also further submitted that even the agency was also in<br \/>\n\tthe name of the applicant and therefore, the applicant may not be<br \/>\n\treleased on bail.\n<\/p>\n<p>\tHaving heard the learned advocate appearing on behalf of the<br \/>\n\trespective parties and  considering the facts and circumstances of<br \/>\n\tthe case, more particularly the fact that the applicant is lady, she<br \/>\n\thas two minor children, her husband is in jail and there is nobody<br \/>\n\tto look after  two minor children, and also considering the<br \/>\n\tstatement made by the learned advocate of the applicant under the<br \/>\n\tinstructions of applicant and her husband, that the husband of the<br \/>\n\tapplicant shall not claim parity, the case of the applicant is<br \/>\n\trequired to be considered positively.\n<\/p>\n<p>\tIn view of the above and considering the submissions made on behalf<br \/>\n\tof the parties and having regard to the circumstances and facts of<br \/>\n\tthe case, the application is allowed and the applicant is ordered to<br \/>\n\tbe released on bail in connection with Crime Register I-155 of<br \/>\n\t2007 registered with Wadhwan  Police Station  on her<br \/>\n\texecuting a bond of Rs.5,000\/- (Rupees Five Thousand only) with one<br \/>\n\tsurety of the like amount to the satisfaction of the lower Court and<br \/>\n\tsubject to the conditions that she shall :\n<\/p>\n<p>(a)\tnot take undue advantage of her liberty or abuse her liberty:\n<\/p>\n<p>(b)\tnot act in a manner injurious to the interest of the prosecution:\n<\/p>\n<p>(c)\tmaintain law and order;\n<\/p>\n<p>(d)\tnot lave the State of Gujarat without the prior permission of the<br \/>\nSessions Court concerned;\n<\/p>\n<p>(e)\tfurnish the address of her residence at the time of execution of<br \/>\nthe bond and shall not change the residence without prior permission<br \/>\nof this Court;\n<\/p>\n<p>(f)\tsurrender her passport, if any, to the lower Court within a week.\n<\/p>\n<p>9.\tIf breach of any of the above conditions is committed, the<br \/>\nSessions Judge concerned will be free to issue warrant or to take<br \/>\nappropriate action in the matter.\n<\/p>\n<p>10.\tBail before the lower Court having jurisdiction to try the case.\n<\/p>\n<p>11.\tRule is made absolute.
