Brar,                    Deputy    Advocate\n               General, Punjab.\n\n\n                                .     .      .\n\nAJAI LAMBA, J (Oral)\n\n               This        petition         has     been       filed        under\n\n<\/pre>\n<p>Section 438 Cr.P.C. for grant of anticipatory bail in<\/p>\n<p>FIR No.232 dated 8.8.2008 lodged for offences under<\/p>\n<p>Section(s) 406, 420 IPC with Police Station, Sadar,<\/p>\n<p>Jalandhar.\n<\/p>\n<p>               Contention            of    learned      counsel       for     the<\/p>\n<p>petitioner     is      that     the       petitioner      is     a    property<\/p>\n<p>dealer and is not involved in the business of sending<\/p>\n<p>people abroad. The complainant is inimical towards<\/p>\n<p>the petitioner being distant relative and therefore,<\/p>\n<p>has falsely implicated the petitioner.<\/p>\n<pre>               It         has        been        contended           that     no\n\nparticulars       of     the    offence          have     been       given    in\n Crl. Misc. No. M-25098 of 2008                                        [2]\n\n\n\n<\/pre>\n<p>relation to the giving of money to the petitioner<\/p>\n<p>i.e. to say that the place and time of handing over<\/p>\n<p>of the money etc., has not been given. Allegation is<\/p>\n<p>that     the     petitioner          took        Rs.50,000\/-         to     send<\/p>\n<p>Tejinderpal          Singh,        husband       of     the    complainant,<\/p>\n<p>abroad.       Tejinderpal          Singh    is    not    related      to     the<\/p>\n<p>complainant.\n<\/p>\n<p>                   Learned counsel has also raised an issue<\/p>\n<p>that     because       it     is     the     admitted         case    of     the<\/p>\n<p>complainant that her husband was to be sent abroad by<\/p>\n<p>illegal means, it would be an agreement\/ contract<\/p>\n<p>against public policy and therefore, not enforceable<\/p>\n<p>in law.\n<\/p>\n<p>                   Learned counsel for the petitioner has<\/p>\n<p>pointed        out     that        the      petitioner         has        joined<\/p>\n<p>investigation.\n<\/p>\n<p>                  Learned          counsel       for    the     respondent-<\/p>\n<p>State,      on    instructions           from     Surjit       Singh,       Head<\/p>\n<p>Constable, has stated that indeed the petitioner has<\/p>\n<p>joined investigation and is not required for further<\/p>\n<p>investigation at this stage.\n<\/p>\n<p>                  In     view       of     the    above       statement       of<\/p>\n<p>learned        counsel      for      the     respondent-State,               the<\/p>\n<p>petition is allowed.\n<\/p>\n<p>                  Order dated 25.9.2008 is made absolute<\/p>\n<p>and it is directed that in the event of arrest, the<\/p>\n<p>petitioner shall be enlarged on bail on furnishing<\/p>\n<p>of     bail      bonds        to     the     satisfaction            of      the<\/p>\n<p>Arresting\/Investigating                  Officer,       subject      to      the<br \/>\n Crl. Misc.
