Pandey, Adv.\n<\/p>\n<pre>               For the State:-            A.C. to G.A.-4.\n                                -------------\n\n4.   29.11.2010                 Heard learned counsel for the petitioner\n\n                  and the Union of India.\n\n<\/pre>\n<p>                                The petitioner is stated to be the widow of<\/p>\n<p>                  late   Shri   Rajendra    Thakur    who   was   drawing<\/p>\n<p>                  Freedom Fighter pension in his life time and has<\/p>\n<p>                  been deceased on 11.2.2009.        It is submitted that<\/p>\n<p>                  the deceased drew family pension till 11.2.2009. The<\/p>\n<p>                  petitioner has represented for grant of family pension<\/p>\n<p>                  on 29.3.2009 which has not been granted.<\/p>\n<p>                                Learned counsel for the Union of India<\/p>\n<p>                  invites the attention of the Court to Annexure-A\/6 to<\/p>\n<p>                  the counter affidavit and submits that on 1.10.2004<\/p>\n<p>                  in the life time of the deceased show cause notice<\/p>\n<p>                  had been issued to him and on receipt of his reply on<\/p>\n<p>                  21.10.2004 the comment of the State Government<\/p>\n<p>                  has been asked for and which is still awaited. The<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>           pension of the deceased was directed to be stopped<\/p>\n<p>           from 1.10.2004. In view of the assertions made in<\/p>\n<p>           the writ petition further details has been sought from<\/p>\n<p>           the State Government on all aspects by letter dated<\/p>\n<p>           10.9.2010.\n<\/p>\n<p>                         Let the State of Bihar answer the queries<\/p>\n<p>           of the Union of India as raised in the latters letter<\/p>\n<p>           dated 10.9.2010 within a maximum period of six<\/p>\n<p>           weeks from the date of receipt and\/or presentation of<\/p>\n<p>           a copy of this order before it. The Union of India is<\/p>\n<p>           then expected to take a final decision in the matter<\/p>\n<p>           within another maximum period of six weeks from<\/p>\n<p>           the date that the reply of the State of Bihar is<\/p>\n<p>           received.\n<\/p>\n<p>                         It is expected that the State of Bihar and<\/p>\n<p>           the Union of India shall adequately furnish materials<\/p>\n<p>           to the petitioner on which aspect they rely and if<\/p>\n<p>           they proposes to arrive at a finding adverse to the<\/p>\n<p>           petitioner.\n<\/p>\n<p>                         The writ application stands disposed.<\/p>\n<pre>P.
