Notification under s.4(1) of the Land Acquisition Act  1<br \/>\nof 1894 for short `the\t Act&#8217;  was published on\t August\t II,<br \/>\n1971  acquiring about 700 acres of land in  Golabandha\tBuxi<br \/>\nPalli,\tVikrampur in Ganjam Dist of Orissa State.  By  award<br \/>\ndated\tOctober\t 18,  1976  the\t land  Acquisition   Officer<br \/>\ndetermined the market value.  On reference under s. 1 8, the<br \/>\nlearned\t subordinate  Judge  confirmed\tthe  award  of\t the<br \/>\nCollector at the rate of Rs.80\/- per fruit bearing tree\t and<br \/>\nRs.  60\/-  per\tnon-fruit  bearing tree\t as  full  value  in<br \/>\naddition  to the compensation to the land by his  award\t and<br \/>\ndecree dated August 21, 1986.  The appellants did not  carry<br \/>\nthe  matter in appeal.\tWhen others filed the  appeal  under<br \/>\ns.54   of  the\tAct,  the  High\t Court\thad   enhanced\t the<br \/>\ncompensation to the fruit bearing tree at Rs. 990\/- and\t Rs.<br \/>\n650\/- for non-fruit bearing tree by its judgment and  decree<br \/>\ndated  December 12, 1989.  Thereafter, the appellants  filed<br \/>\nan  application under s.28-A of the Land Acquisition Act  on<br \/>\nMay  23\t 1990  for redetermination.   The  Land\t Acquisition<br \/>\nOfficer\t dismissed the application and thereafter  the\tHigh<br \/>\nCourt by its order dated February 8, 1993 confirmed the same<br \/>\nin O.J.C. No.965\/92. Thus this appeal by special leave.\n<\/p>\n<p>3.   It is contended that when the High Court awarded higher<br \/>\ncompensation by operation of s.28-A of the Land\t Acquisition<br \/>\nAct  the appellants also are entitled to the  same  benefit.<br \/>\nThe  point is now squarely covered by two judgments of\tthis<br \/>\nCourt  in Scheduled Castes Co-operative Land Own in  Society<br \/>\nLtd., Bhatinda v. Union of India &amp; Ors.reported in AIR\t1991<br \/>\nSC 738 and <a href=\"\/doc\/1806862\/\">Babua Ram &amp; Ors. v. State of U.P. &amp;<\/a><br \/>\n<span class=\"hidden_text\">513<\/span><br \/>\nAnr.  reported\tin  JT\t1994 (7)  SC  377.   Therefore,\t the<br \/>\nappellants  having failed to avail of the remedy  of  appeal<br \/>\nand having already availed the remedy of reference under  s.<br \/>\n18,  they  are not entitled to seek redetermination  of\t the<br \/>\ncompensation  on  the  basis  of award\tof  the\t High  Court<br \/>\ngranting enhanced compensation.\t Section 28-A would apply to<br \/>\nthe claimants who received the compensation without  protest<br \/>\nand  faced  with statutory bar of reference  and  would\t not<br \/>\napply  to  those  who  had already  availed  the  remedy  of<br \/>\nreference  and got no benefit or lesser benefit\t thereunder.<br \/>\nEqually\t the bar of res judicata clearly would apply to\t the<br \/>\nappellants.  The application under s.28A is, therefore,\t not<br \/>\nmaintainable.\tThe  Collector and the\tHigh  Court  rightly<br \/>\nrefused to grant the amount on par with the judgment of\t the<br \/>\nHigh Court.\n<\/p>\n<p>4.
