Respondents\n\n        Petition under Article 226  of  the  Constitution  of  India  for  the\nissuance  of  a  Writ of Habeas Corpus to call for the records relating to the\ndetention  order  No.P.D.03\/2006,  dated  04.03.2006,  passed  by  the  second\nrespondent,  set aside the same and direct the respondents to produce the body\nof detenu by name Sekar @ Ulakkadi Sekar, S\/o Duraisami, aged about 41  years,  \nwho  is  confined in Central Prison, Thiruchirapalli before this Court and set\nhim at liberty forthwith.\n\n!For Petitioner :  Mr.A.S.Bilal\n\n^For Respondents:  Mr.M.Babu Muthu Meeran    \n                   Addl.  Public Prosecutor\n\n:ORDER  \n<\/pre>\n<p>                (Order of the Court was made by P.SATHASIVAM,J.)<\/p>\n<p>        The petitioner, who is the wife of the detenu by name Sekar @ Ulakkadi<br \/>\nSekar, who is detained as a &#8221;Bootlegger&#8221; as contemplated under the Tamil Nadu<br \/>\nPrevention of Dangerous Activities  of  Bootleggers,  Drug  Offenders,  Forest<br \/>\nOffenders, Goondas, Immoral Traffic Offenders, Slum Grabbers and Video Pirates<br \/>\nAct,  1982  (Tamil Nadu Act 14 of 1982), by the impugned detention order dated<br \/>\n04.03.2006, challenges the same in this Petition.\n<\/p>\n<p>        2.  Heard learned counsel  for  the  petitioner  as  well  as  learned<br \/>\nAdditional Public Prosecutor for the respondents.\n<\/p>\n<p>        3.  At the foremost, learned counsel for the petitioner submitted that<br \/>\nthere is enormous delay in disposal of the representation of the detenu, which<br \/>\nvitiates the  ultimate order of detention.  With reference to the above claim,<br \/>\nlearned Additional Public Prosecutor has placed the details, which  show  that<br \/>\nthe  representation  of  the  detenu  dated  0  1.04.2006  was received by the<br \/>\nGovernment on 04.04.2006 and remarks were called for  on  05.04.2006  and  the<br \/>\nremarks  were  received  by  the  Government  on  27.04.2006  and the File was<br \/>\nsubmitted on 27.04.2006 and the same was dealt with by the Under Secretary and<br \/>\nDeputy Secretary on 28.04.2006 and finally, the Minister for  Prohibition  and<br \/>\nExcise passed  orders  on  02.05.2006.    The rejection letter was prepared on<br \/>\n10.05 .2006 and the same was sent to the detenu on the same day i.e.    on  10<br \/>\n.05.2006 and  served  to  him  on  16.05.2006.   As rightly pointed out by the<br \/>\nlearned counsel for the petitioner, though the Minister  for  Prohibition  and<br \/>\nExcise  passed  an  order  on  02.05.2006,  there is no explanation at all for<br \/>\ntaking time for preparation of rejection  letter  till  10.05.2006.    In  the<br \/>\nabsence  of  any  explanation by the person concerned even after excluding the<br \/>\nintervening holidays, we are of the view that the time taken  for  preparation<br \/>\nof  rejection letter is on the higher side and we hold that the said delay has<br \/>\nprejudiced the detenu in disposal of his representation.  On this  ground,  we<br \/>\nquash the impugned order of detention.\n<\/p>\n<p>        4.   Accordingly,  the  Habeas  Corpus  Petition  is  allowed  and the<br \/>\nimpugned order of detention is set aside.  The detenu is directed to be set at<br \/>\nliberty forthwith from the custody unless he is required in some other case or<br \/>\ncause.\n<\/p>\n<p>raa<\/p>\n<p>To<\/p>\n<p>1.
