2. The petitioner herein filed an<\/p>\n
Vapplication under Or at 1 Rule 10(2) of CPC<\/p>\n
g<\/p>\n
seeking leave of the trial Court ‘to! be<\/p>\n
impleaded. as one- of the respondents? to {\u00a7he’_<\/p>\n
suit. The plaintiff in the suit\ufb01op\ufb01\u00a2e\u00e9\ufb02=therua<\/p>\n
said application. However, ,the atrial ‘\ufb01oprte<\/p>\n
after considering thev rival ,oontentione :hae j><\/p>\n
come to the conclusion that :iAiVlll filed by
\nthe petitioner herein iegaire\u00e9 to be allowed
\nand the petitioner herein ie \u00a3$Q\ufb01e impleaded
\nas defendant \ufb01\u00a7Eb.to the gait} ilnsofar as the
\napplication heine aiio\u00a7\u00a7\u00a7 \ufb01g the trial Court,
\nthe petitioner has \ufb01g grievance. However, the
\npetitionerie’a\u00a7oiieeee by that portion of the<\/p>\n
order” whereini the trial Court has observed<\/p>\n
nltvthat %\u00e9in\u00a2e, the purchase by the petitioner<\/p>\n
iherein”ie daring the pendency of the suit, the<\/p>\n
saee ia hit by Section 52 of the Transfer of<\/p>\n
‘W”e\u00a7ropertf Act and therefore, in this context a<\/p>\n
ireeeparate written statement cannot be allowed<\/p>\n

3. The learned counsel for the petitioner’<\/p>\n
while assailing the said order would contemdfh.<\/p>\n
that the trial Court after Mhavingryoermittedi<\/p>\n
the petitioner” to come\u00bb on Vrecord lg\u00a2u1dx\u00bb\ufb01o:’<\/p>\n
have made such observations “since Ethe Wsame
\nwould prejudice  if
\nultimately the petitioner .e5\u00a7g$es to file
\nwritten statenent and make an eoplication in
\nthat reg\u00e9rdelnlhe\ufb02oheereation as to whether
\nthe sgm\u00e9 is hit by Seetion h2 of the Transfer
\nof Property–hot eonld have been Hmde by the<\/p>\n
trial Court while ultimately deciding the suit<\/p>\n
l”\u00aband1hot:at this stage and therefore, the order<\/p>\n
l\ufb01istnottsustainable.\n<\/p>\n
h”4:lThe learned counsel for respondents 1<\/p>\n

5. In the light of the contentions, a
\nperusal of the order would indicate that the<\/p>\n
trial Court after L\ufb01oticing the prayer put<\/p>\n

forth in the application–I.A.VIII, has come to<\/p>\n
the conclusion that the petitioner has to be<\/p>\n
permitted to come on record. Aocordingle; the *<\/p>\n
trial Court has directed_\u00bbtheA \ufb01lain\ufb01iffiito_h<\/p>\n
amend the cause title i*and ” inplead ~ thee<\/p>\n
petitioner as defendant ;No.S-_ A baring “the”l<\/p>\n

\nmade that though the petitioner is entitled to<\/p>\n
come on record, he Wbold hot he’entitled to<\/p>\n

observation of_the_trial Court, in my View, is<\/p>\n

notdlsought} for any other relief and if<\/p>\n
