JEEVAN REDDY, J.- Heard the counsel for  the  parties.<br \/>\nThis  review petition has to be allowed following the  ratio<br \/>\nof the decision of this Court in CST v. Agra Belting Work I.\n<\/p>\n<p>2.   The  assessment year concerned herein is 1975-76.\t And<br \/>\nthe  matter  arises  under  the U.P.  Sales  Tax  Act.\t The<br \/>\nquestion pertains to taxability of turnover relating to ice-<br \/>\ncream.\n<\/p>\n<p>3.   The State of U.P. has been issuing, from time to  time,<br \/>\nnotifications under Section 4 of the Act, exempting milk and<br \/>\nmilk products from the levy of sales tax.  It has also\tbeen<br \/>\nissuing\t from time to time notifications under\tSection\t 3-A<br \/>\nnotifying  the\trates of tax on sale\/purchase  of  different<br \/>\ngoods.\tIn this case, we are concerned with one notification<br \/>\nunder  Section\t4  namely the one dated\t 21-5-1974  and\t two<br \/>\nnotifications  under Section 3-A dated 4-11-1974  and  30-5-<br \/>\n1975.\tThe  notification under Section\t 4  dated  21-5-1974<br \/>\nexempted milk and milk products from the levy of tax.\tIce-<br \/>\ncream  was understood to be a milk product  and,  therefore,<br \/>\nexempt.\t However, by notifications issued under Section\t 3-A<br \/>\n(dated 4-11-1974 and 30-5-1975) a rate of tax was prescribed<br \/>\nexpressly for ice-cream among other goods.\n<\/p>\n<p>4.   In\t CST  v. Agra Belting Works1 a Bench of\t this  Court<br \/>\ncomprising R.S. Pathak, C.J., Ranganath Misra and B.C.\tRay,<br \/>\nJJ.  held, by a majority, that Sections 3, 3-A and 4 of\t the<br \/>\nU.P.   Sales  Tax  Act\tare  parts  of\tthe  taxing   scheme<br \/>\nincorporated in the Act, and therefore, where a notification<br \/>\nis  issued under Section 3-A prescribing a rate of  tax\t for<br \/>\ngoods,\twhich may have been exempted from tax by an  earlier<br \/>\nnotification  under  Section  4, it must be  held  that\t the<br \/>\nintention  was to withdraw the exemption and make  the\tsale<br \/>\nleviable to tax at the rate prescribed in the  notification.<br \/>\nIt  was held that it is not necessary in such a case that  a<br \/>\nspecific  or separate notification withdrawing\tor  revoking<br \/>\nthe  exemption\tis issued.  Following the said\tdecision  it<br \/>\nmust  be  held that the exemption granted  to  ice-cream  by<br \/>\nnotification dated 21-5-1974 was undone by the\tnotification<br \/>\ndated  4-11-1974 as well as by the notification dated  30-5-<br \/>\n1975.\n<\/p>\n<p>5.   For  the above reasons the review petition\t is  allowed<br \/>\nand the order of the High Court dated 12-12-1986 (which\t was<br \/>\nthe  subject-matter of SLP No. 14648 of 1988) is set  aside.<br \/>\nFor  the  same\treasons, the order  dated  9-1-1989  in\t the<br \/>\naforesaid  SLP No. 14648 of 1988 is also set aside  and\t the<br \/>\norder  of  the\tassessing  authority  holding  the  turnover<br \/>\nrelating to ice-cream as taxable is restored.<br \/>\n1  (1987) 3 SCC 140: 1987 SCC (Tax) 233<br \/>\n641  Consequently,  the SLP (C) No. 14648 of 1988  shall  be<br \/>\ndeemed to have been granted and the civil appeal  registered<br \/>\non  that basis shall be deemed to have been allowed  in\t the<br \/>\nabove terms.\n<\/p>\n<p>6.   Mr\t  Raju\t Ramachandran,\tlearned\t counsel   for\t the<br \/>\nrespondent-dealer submitted that setting aside the order  of<br \/>\nthe  High  Court at this distance of time would\t expose\t the<br \/>\nrespondent-dealer to penalties and other penal\tconsequences<br \/>\nin addition to tax.  In our opinion the said apprehension is<br \/>\nunfounded.   No such proceeding for levying penalty  or\t for<br \/>\nvisiting other penal consequences has been initiated so far.<br \/>\nIn  any\t event,\t the facts of this  case   particularly\t the<br \/>\nconflict of opinion in the High Court on this point  make it<br \/>\nappear that it may not be a case calling for levy of penalty<br \/>\nor for visiting other penal consequences.\n<\/p>\n<p>7.
