Rule 32-Decree for injunction  against  State\nGovernment-'Party'-Wilfully failing to obey decree-Execution\nof decree-Whether can be enforced by attachment of  property\nof State employee who is not part to suit.\n\n\n\nHEADNOTE:\n     Respondent\t no.  3\t obtained  a  decree  for  permanent\ninjunction  restraining\t the State of U.P.  and\t its  Forest\nDepartment from interfering with his rights of cutting trees\non a plot of land.  Later on 'X' filed a suit and obtained a\ntemporary   injunction\trestraining  respondent\t no.3\tfrom\ncutting and removing trees from her plot under the guise  of\nthe injunction obtained by him.\t Thereafter 'X' reported  to\nthe  District  Senior  Superintendent of  Police  about\t the\ndisobedience of the temporary injunction; and ultimately the\nappellant,  who was the Station House Officer of  the  area,\nseized\tcertain\t logs  of wood said to\thave  been  cut\t and\nremoved\t from the plot of 'X'.\tRespondent no.3,  moved\t the\nexecuting  court under Order 21, Rule 32, C.P.C.  impleading\nthe  S.S.P and the S.H.O., the appellant, and  alleged\tthat\ntheir action amounted to obstruction and was in defiance  of\nthe injunction granted in his favour.  The objections  filed\nby  the\t S.S.P. and the appellant were dismissed  and  their\nproperties  were directed to be attached.  On revision,\t the\nDistrict  Judge modified the attachment order absolving\t the\nS.S.P. of the obstruction.\n     The  appellant,  after unsuccessfully  challenging\t the\norders of the civil courts in writ petition before the\tHigh\nCourt, filed the appeal by special leave to this Court,\n     Allowing the appeal and setting aside the orders of the\nHigh Court and of both the civil courts, this court,\n\t\t\t\t\t\t       184\n     HELD: 1. The provision of Order 21 Rule 32(1) C.P.C  is\napplicable  to a party against whom a decree for  injunction\nhad been passed, [p.186A-B]\n     2.\t The word 'party' occurring in Order 21 Rule  32(1),\nC.P.C.\tcannot be construed so liberally as to include\teach\nand every employee of the State to have been a party to\t the\nsuit  in  which the injunction was passed .   The  intention\nmanifested  in the provision seems to confine the rigour  to\nthe  party who had contested the suit and had  suffered\t the\ndecree\tand  it is that pary when obstructing is  liable  of\nbeing detained in the civil prison, or suffer attachment  of\nhis property, or both. [p. 186C-D]\n     3.1 Although the Forest Department of the State of U.P.\nand  the State of U.P were parties,  and, being an  employee\nof  the State of U.P., the appellant was in an indirect\t way\nbound  by the injunction, yet it cannot be said that he\t was\nby himself a party to the suit as such against whom the said\ndecree was passed. [p.186B-C]\n     3.2 The appellant was not a party to the suit in  which\nthe injunction was granted.  He need not suffer action under\nOrder  21  Rule\t 32  C.P.C. or to  remain  under  threat  of\nattachment  of\this property, more so when he is  no  longer\navailable at the scene to obstruct any more or to expose his\nproperty to such supposed attachment. Writ Petition No Nil  of<br \/>\n1990.\n<\/p>\n<p>     Bharat Sangal for the Appellant.\n<\/p>\n<p>     Manoj Prasad for the Respondent.\n<\/p>\n<p>     The following Order of the Court was delivered.<br \/>\n     This  appeal  by special leave concerns  a\t Police\t Sub<br \/>\nInspector  who\tin the discharge of his duty  was  about  to<br \/>\nattract\t an order under order 21 Rule 32 C.P.C. as also\t the<br \/>\nprospect of getting  his property attached.\n<\/p>\n<p>     Respondent\t  no.3\tobtained  a  decree  for   permanent<br \/>\ninjunction  against the Forest Department of the State\tU.P.<br \/>\nand the State of U.P. injuncting<br \/>\n<span class=\"hidden_text\">\t\t\t\t\t\t       185<\/span><br \/>\nthem from interfering in the rights of respondent no.3\tfrom<br \/>\ncutting trees on a plot of land said to be belonging to him.<br \/>\nLater  one  Smt.  Lagan\t Devi filed  a\tcivil  suit  against<br \/>\nrespondent   no.3   and\t obtained  an\t interim  injunction<br \/>\nrestraining respondent no.3 from cutting and removing  Trees<br \/>\nstanding  on  her  plot under the  guise  of  the  injuction<br \/>\nobtained  by  him in the earlier suit.\t Having\t obtained  a<br \/>\ntemporary  injunction she reported disobedience\t thereof  to<br \/>\nthe  Senior  Superintendent of Police,\t District  Gorakhpur<br \/>\nsoliciting  help  towards  obedience of\t the  injuction.  It<br \/>\nappears that the appellant herein who was the Station  House<br \/>\nOfficer\t of  Police Station, Paniar,  Distt.  Gorakhpur\t was<br \/>\nasked  to take up the matter in hand. As a remedial step  he<br \/>\nsiezed\tcertain\t logs  of wood said to\thave  been  cut\t and<br \/>\nremoved for the plot of land of Smt. Lagan Devi and  stopped<br \/>\ntheir movement.\t Terming the stoppage of movement of logs of<br \/>\nwood  as  defiance of the injunction granted  in  favour  of<br \/>\nrespondent  no.3,  the said respondent moved  the  Executing<br \/>\nCourt  under Order 21 Rule 32 C.P.C complaining\t obstructing<br \/>\nand necessary orders in that regard.  He arrayed the  S.S.P.<br \/>\nAnd the S.H.O. as respondents.\tThey filed objection  before<br \/>\nthe  Executing Court.  The objections were dismissed by\t the<br \/>\nExecuting   Court  directing  that  the\t property  of\t the<br \/>\nappellant  and\tthe S.S.P. Gorakhpur be attached  as  prayed<br \/>\nfor.  On revision to the District Judge (such revision being<br \/>\ncompetent under a State Amendment) the order was modified to<br \/>\nthe extent that the S.S.P. was absolved of the\tobstruction.<br \/>\nThe  appellant on whom came the brunt moved  the High  Court<br \/>\nby  means  of a writ petition unsuccessfully  and  this\t has<br \/>\nbrought him to this Court.\n<\/p>\n<p>     We\t are told at the Bar by Mr. Bharat  Sangal,  learned<br \/>\ncounsel\t for  the appellant that since\tlong  the  appellant<br \/>\nstands\ttransferred to another District and now he is  in  a<br \/>\npromotional  post.   It is otherwise the  admitted  position<br \/>\nthat   thus far the property of the appellant  has not\tbeen<br \/>\nattached. In the first place when the appellant is no longer<br \/>\npresent in the District to obstruct or continue\t obstructing<br \/>\nthe  legal process, it is idle to contend that the order  of<br \/>\nthe Executing Court in the changed circumstance shall remain<br \/>\nsustained.   These supervening facts must obviously have  an<br \/>\nimpact\tin moulding the relief.\t In the second place, it  is<br \/>\ndifficult  to uphold the view of the Courts below  that\t the<br \/>\nappellant was a person who could be brought within the\tgrip<br \/>\nof  order  21  rule  32 C.P.C.\tThe  said  provision  in  an<br \/>\nextracted form can be re-written as follows:<br \/>\n\t &#8220;E.32(1) Where the party against whom a decree\t for<br \/>\n\t injuction<br \/>\n<span class=\"hidden_text\">\t\t\t\t\t\t       186<\/span><br \/>\n\t has been passed, has had an opportunity of  obeying<br \/>\n\t the decree and has willfully failed to obey it, the<br \/>\n\t decree may be enforced in the case of a decree\t for<br \/>\n\t an injuction by his detention in the civil  prison,<br \/>\n\t or by the attachment of his property, or by both&#8221;.<br \/>\n     It\t is  significant and patent that this  provision  is<br \/>\napplicable  to a party against whom a decree  for  injuction<br \/>\nhad been passed.  Admittedly, the  appellant was not a party<br \/>\nto  the\t suit in which the injuction was granted. It  may be<br \/>\ntrue that the Forest Department of the State of U.P. and the<br \/>\nState  of  U.P. were parties and being and employee  of\t the<br \/>\nState  Of U.P. the appellant is in an indirect way bound  by<br \/>\nthe injuction but it cannot be said that he was by himself a<br \/>\nparty to the suit as such against whom the  said decree\t was<br \/>\npassed.\t  The word `party&#8217; cannot be construed so  liberally<br \/>\nso  as\tto include each and every employee of the  State  of<br \/>\nU.P. to have been a party to the suit in which the injuction<br \/>\nwas passed.  The intention manifested in the provision seems<br \/>\nto  confine  the rigour to the party who had  contested\t the<br \/>\nsuit  and had suffered the decree and it is that party\twhen<br \/>\nobstructing is liable of being detained in the civil prison,<br \/>\nor suffer attachment of his property, or both.\tThus we\t are<br \/>\nof  the considered view that on either count  the  appellant<br \/>\nneed  not suffer action under Order 21 Rule 32 C.P.C. or  to<br \/>\nremain\tunder threat of attachment of his property, more  so<br \/>\nwhen he is no longer available at the scene to obstruct\t any<br \/>\nmore, or to expose his property to such supposed attachment.\n<\/p>\n<p>     For  the reasons recorded above the appeal is  allowed.<br \/>\nThe  impugned  orders of the High Court as well as  that  of<br \/>\nboth  the Civil courts against the appellant are set  aside.<br \/>\nNo order as to costs.\n<\/p>\n<pre>R.P.\t\t\t\t\t     Appeal allowed.\n<span class=\"hidden_text\">\t\t\t\t\t\t      187<\/span>\n\n\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Yashpal Singh vs Viii Addl.
