Both \u00a0 the \u00a0 parties \u00a0 were \u00a0 present \u00a0 during \u00a0 the \u00a0 hearing \u00a0 and \u00a0 made \u00a0 their\u00a0<\/p>\n<p>submissions.\n<\/p>\n<\/p>\n<p>3.      The\u00a0Appellant\/Complainant\u00a0had\u00a0sought\u00a0the\u00a0permission\u00a0of\u00a0the\u00a0CPIO\u00a0to\u00a0<\/p>\n<p>inspect\u00a0the\u00a0personal\u00a0service\u00a0records\u00a0of\u00a0one\u00a0Shankar\u00a0Lal,\u00a0his\u00a0client.\u00a0The\u00a0CPIO\u00a0<\/p>\n<p>had\u00a0denied\u00a0the\u00a0permission\u00a0on\u00a0the\u00a0ground\u00a0that\u00a0it\u00a0was\u00a0information\u00a0relating\u00a0to\u00a0a\u00a0<\/p>\n<p>third\u00a0person\u00a0and\u00a0was,\u00a0therefore,\u00a0exempt\u00a0under\u00a0Section\u00a08(1)\u00a0(d)\u00a0of\u00a0the\u00a0Right\u00a0to\u00a0<\/p>\n<p>Information \u00a0 (RTI) \u00a0 Act. \u00a0 The \u00a0 Appellate \u00a0 Authority \u00a0 had \u00a0 endorsed \u00a0 this \u00a0 decision.\u00a0<\/p>\n<p>During\u00a0the\u00a0hearing,\u00a0Shankar\u00a0Lal\u00a0was\u00a0himself\u00a0present\u00a0and\u00a0submitted\u00a0that\u00a0his\u00a0<\/p>\n<p>records\u00a0should\u00a0be\u00a0shown\u00a0to\u00a0the\u00a0Appellant\/Complainant.<\/p>\n<p>CIC\/SM\/A\/2010\/000990\n<\/p>\n<p> 4.      After \u00a0 hearing \u00a0 the \u00a0 submissions \u00a0 of \u00a0 both \u00a0 the \u00a0 parties \u00a0 and \u00a0 carefully\u00a0<\/p>\n<p>considering\u00a0the\u00a0facts\u00a0of\u00a0the\u00a0case,\u00a0we\u00a0think\u00a0that\u00a0the\u00a0relevant\u00a0service\u00a0records\u00a0of\u00a0<\/p>\n<p>Shankar\u00a0Lal\u00a0should\u00a0be\u00a0shown\u00a0to\u00a0the\u00a0Appellant\/Complainant\u00a0on\u00a0the\u00a0basis\u00a0of\u00a0the\u00a0<\/p>\n<p>authorisation\u00a0indicated\u00a0by\u00a0the\u00a0employee\u00a0concerned\u00a0during\u00a0the\u00a0present\u00a0hearing.\u00a0<\/p>\n<p>Therefore,\u00a0we\u00a0direct\u00a0the\u00a0CPIO\u00a0to\u00a0invite\u00a0the\u00a0Appellant\/Complainant\u00a0and\u00a0Shankar\u00a0<\/p>\n<p>Lal\u00a0on\u00a0any\u00a0mutually\u00a0convenient\u00a0date\u00a0within\u00a015\u00a0working\u00a0days\u00a0from\u00a0the\u00a0receipt\u00a0of\u00a0<\/p>\n<p>this\u00a0order\u00a0and\u00a0to\u00a0show\u00a0him\u00a0the\u00a0service\u00a0records\u00a0of\u00a0the\u00a0said\u00a0employee\u00a0as\u00a0against\u00a0<\/p>\n<p>the\u00a0items\u00a0a,\u00a0b,\u00a0d\u00a0and\u00a0e\u00a0of\u00a0the\u00a0RTI\u00a0application\u00a0as\u00a0available\u00a0with\u00a0the\u00a0Bank.\u00a0After\u00a0<\/p>\n<p>inspection,\u00a0if\u00a0 the\u00a0 Appellant\u00a0 chooses\u00a0 to \u00a0get\u00a0 the\u00a0 photocopies\u00a0 of\u00a0any\u00a0 of\u00a0 those\u00a0<\/p>\n<p>records,\u00a0the\u00a0CPIO\u00a0shall\u00a0provide\u00a0the\u00a0same\u00a0free\u00a0of\u00a0charge.<\/p>\n<p>5.      The\u00a0Appellant\/Complainant\u00a0submitted\u00a0that\u00a0he\u00a0should\u00a0be\u00a0compensated\u00a0<\/p>\n<p>for\u00a0the\u00a0harassment\u00a0and\u00a0the\u00a0financial\u00a0loss\u00a0he\u00a0had\u00a0to\u00a0undergo\u00a0on\u00a0account\u00a0of\u00a0the\u00a0<\/p>\n<p>wrongful\u00a0denial\u00a0of\u00a0the\u00a0information\u00a0by\u00a0the\u00a0CPIO\u00a0in\u00a0the\u00a0first\u00a0place.\u00a0To\u00a0this,\u00a0the\u00a0<\/p>\n<p>Respondent\u00a0submitted\u00a0that\u00a0there\u00a0was\u00a0nothing\u00a0wrong\u00a0in\u00a0the\u00a0 response\u00a0of\u00a0the\u00a0<\/p>\n<p>CPIO\u00a0since\u00a0the\u00a0desired\u00a0information\u00a0was\u00a0about\u00a0the\u00a0personal\u00a0service\u00a0records\u00a0of\u00a0<\/p>\n<p>one\u00a0of\u00a0their\u00a0employees\u00a0and\u00a0they\u00a0had\u00a0nothing\u00a0in\u00a0their\u00a0possession\u00a0to\u00a0show\u00a0that\u00a0<\/p>\n<p>the \u00a0 said \u00a0 employee \u00a0 had \u00a0 authorised \u00a0 the \u00a0 Appellant\/Complainant \u00a0 to \u00a0 seek \u00a0 such\u00a0<\/p>\n<p>information\u00a0from\u00a0the\u00a0Bank.\u00a0He\u00a0further\u00a0submitted\u00a0that\u00a0mere\u00a0endorsement\u00a0by\u00a0the\u00a0<\/p>\n<p>employee \u00a0 concerned \u00a0 on \u00a0 the \u00a0 RTI \u00a0 application \u00a0 could \u00a0 not \u00a0 be \u00a0 taken \u00a0 as \u00a0 his\u00a0<\/p>\n<p>authorisation.\u00a0After\u00a0carefully\u00a0considering\u00a0these\u00a0submissions,\u00a0we\u00a0think\u00a0that\u00a0the\u00a0<\/p>\n<p>CPIO\u00a0was\u00a0not\u00a0entirely\u00a0wrong\u00a0in\u00a0denying\u00a0the\u00a0information\u00a0although\u00a0the\u00a0provision\u00a0<\/p>\n<p>under\u00a0which\u00a0he\u00a0denied\u00a0it\u00a0was\u00a0not\u00a0exactly\u00a0relevant.\u00a0Section\u00a08(1)\u00a0(d)\u00a0refers\u00a0to\u00a0<\/p>\n<p>information\u00a0in\u00a0the\u00a0nature\u00a0of\u00a0commercial\u00a0confidence\u00a0or\u00a0intellectual\u00a0property\u00a0or\u00a0<\/p>\n<p>trade\u00a0secrets\u00a0and\u00a0the\u00a0desired\u00a0information\u00a0would\u00a0not\u00a0fall\u00a0in\u00a0any\u00a0of\u00a0these\u00a0three\u00a0<\/p>\n<p>categories.\u00a0At\u00a0the\u00a0most,\u00a0the\u00a0CPIO\u00a0can\u00a0be\u00a0held\u00a0guilty\u00a0of\u00a0misapplication\u00a0of\u00a0the\u00a0<\/p>\n<p>provision\u00a0of\u00a0law\u00a0in\u00a0support\u00a0of\u00a0his\u00a0decision;\u00a0there\u00a0is\u00a0nothing\u00a0on\u00a0record\u00a0to\u00a0show\u00a0<\/p>\n<p>CIC\/SM\/A\/2010\/000990<br \/>\n that\u00a0he\u00a0denied\u00a0the\u00a0information\u00a0out\u00a0of\u00a0any\u00a0bad\u00a0intent.\u00a0Therefore,\u00a0we\u00a0do\u00a0not\u00a0think\u00a0<\/p>\n<p>that\u00a0there\u00a0is\u00a0any\u00a0case\u00a0for\u00a0the\u00a0award\u00a0of\u00a0any\u00a0compensation.<\/p>\n<p>6.      The\u00a0appeal\/complaint\u00a0is\u00a0disposed\u00a0off\u00a0accordingly.<\/p>\n<p>7.
