CHAKRABORTY R\/O VILL.-\nHARI NARAYANPUR, P.O.- ASARHI, P.S.- NARDIGANJ, DISTT.- NAWADA\n                                  -----------\n<\/pre>\n<p>2\/   08\/11\/2010             Heard learned counsel for the petitioner and<\/p>\n<p>                  learned counsel for the State.\n<\/p>\n<p>                            The petitioner was an applicant for the post of<\/p>\n<p>                  Angan Bari Sevika at the Angan Bari Centre, Hari<\/p>\n<p>                  Narayanpur,     P.O.    Asarhi,   P.S.    Nardiganj,    district-<\/p>\n<p>                  Nawadah along with respondent No.8. The latter came to<\/p>\n<p>                  be selected which was questioned by the petitioner before<\/p>\n<p>                  the District Programme Officer. The District Programme<\/p>\n<p>                  Officer   by   his     order   dated     30.3.2009     held   the<\/p>\n<p>                  appointment of respondent No.8 to be bad and directed<\/p>\n<p>                  the appointment of the petitioner who is stated to have<\/p>\n<p>                  been at serial No.2 of the merit list. When nothing has<\/p>\n<p>                  transpired with regard to her appointment the writ<\/p>\n<p>                  application has been filed.\n<\/p>\n<p><span class=\"hidden_text\">                        -2-<\/span><\/p>\n<p>               Learned counsel for the State rightly points out<\/p>\n<p>     that issues of eligibility\/ineligibility for appointment are<\/p>\n<p>     matters to be examined by the District Magistrate<\/p>\n<p>     himself. It is not known whether respondent No.8 has<\/p>\n<p>     questioned the order of the District Programme Officer or<\/p>\n<p>     whether it has attained finality. In what manner the<\/p>\n<p>     District Magistrate shall be required to proceed shall<\/p>\n<p>     necessarily   encompass      any    challenge     made   by<\/p>\n<p>     respondent No.8 to the order of the District Programme<\/p>\n<p>     Officer before a competent court and what orders may<\/p>\n<p>     have been passed therein.\n<\/p>\n<p>               The application is disposed with the direction<\/p>\n<p>     that only if the petitioner files a representation within 30<\/p>\n<p>     days from today before the District Magistrate, let him<\/p>\n<p>     decide the issues in accordance with law after hearing all<\/p>\n<p>     concerned, including respondent No.8 by a reasoned and<\/p>\n<p>     speaking order within a maximum period of four months<\/p>\n<p>     from the date of receipt\/production of a copy of this order<\/p>\n<p>     before him.\n<\/p>\n<p>               The writ application stands disposed.<\/p>\n<pre>KC                               ( Navin Sinha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Renu Sinha vs The State Of Bihar &amp;Amp; Ors on 8 November, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.4847 of 2010 1.
