PUBLIC PROSECUTOR\nfor Applicant(s) : 1, \nMR\nHEMANT B RAVAL for Respondent(s) :\n1, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 24\/02\/2011\n \n\nORAL\nORDER<\/pre>\n<p>By<br \/>\n\tway of present application the applicant-State has inter alia prayed<br \/>\n\tto cancel the bail granted to the respondent-accused vide order<br \/>\n\tdated 09th June 2010 passed by the learned Additional<br \/>\n\tSessions Judge, Court No.17, Ahmedabad City in Criminal<br \/>\n\tMiscellaneous Application No.1864 of 2010.\n<\/p>\n<p>Heard<br \/>\n\tMr.H.L. Jani, learned Additional Public Prosecutor and Mr.Hemant<br \/>\n\tRaval, learned counsel for the respondent.\n<\/p>\n<p>Mr.Jani<br \/>\n\thas contended that certain conditions were imposed upon the<br \/>\n\trespondent-accused while he was enlarged on bail, one of which is to<br \/>\n\tmark his presence at the concerned police station on every 5th<br \/>\n\tof English calendar month between 10.00 a.m. and 2.00 p.m. till the<br \/>\n\tcharge-sheet is filed. Mr.Jani has further contended that the<br \/>\n\trespondent-accused was never bothered to mark his presence before<br \/>\n\tthe concerned Police Station as directed by the learned trial Judge<br \/>\n\tin his order dated 09th June 2010 and therefore, order<br \/>\n\tgranting bail to the respondent-accused is required to be cancelled.\n<\/p>\n<p>As<br \/>\n\tagainst this, Mr.Raval has contended that it is true that<br \/>\n\trespondent-accused has never marked his presence before the<br \/>\n\tconcerned Police Station. Mr.Raval has made a statement at the Bar<br \/>\n\tthat the respondent-accused had never marked his presence before the<br \/>\n\tconcerned Police Station because he is externee. He has also<br \/>\n\tcontended that externment order was passed against the<br \/>\n\trespondent-accused and therefore, he has not marked his presence<br \/>\n\tbefore the concerned Police Station. He, therefore, requested this<br \/>\n\tCourt that applicant may be permitted to mark his presence before<br \/>\n\tTahera Police Station, Godhra.\n<\/p>\n<p>I<br \/>\n\thave perused the papers produced before me as well as submissions<br \/>\n\tadvanced by the learned counsel for the parties. In view of the<br \/>\n\tfacts, more particularly statement made by Mr.Hemant Raval, learned<br \/>\n\tcounsel for the respondent-accused, I am of the opinion that this is<br \/>\n\tnot a fit case to cancel the bail. In view of statement made by<br \/>\n\tMr.Hemant Raval, present respondent-accused is hereby directed to<br \/>\n\tmark his presence before Tahera Police Station, Godhra on every 5th<br \/>\n\tday of English calendar month between 10.00 a.m and 2.00 p.m. till<br \/>\n\tthe charge-sheet is filed.  Other conditions mentioned in the order<br \/>\n\tdated 09th June 2010 passed by the earned Additional<br \/>\n\tSessions Judge, Court No.17, Ahmedabad City in Criminal<br \/>\n\tMiscellaneous Application No.1864 of 2010 remain unaltered.
