DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 06\/09\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1\tThis<br \/>\npetition under Article 226 of the Constitution of India is filed by<br \/>\nthe petitioner challenging the order dated 18th February<br \/>\n2011 and the consequential order date 19th April 2011.\n<\/p>\n<p>2\tThe<br \/>\nfacts of the case are that, initially, by order dated 28th<br \/>\nAugust 2002, punishment of compulsory retirement from service was<br \/>\nimposed upon the petitioner. In departmental appeal, by order dated<br \/>\n25th March 2003, the punishment of compulsory retirement<br \/>\nfrom service was substituted by imposing punishment of reduction to a<br \/>\nlower post and stage i.e. from the pay-scale of 4500-7000 on the post<br \/>\nof Master to the pay-scale of Rs.4000-6000 on the post of  Sarang. In<br \/>\nspite of the above order dated 25th March 2003 passed by<br \/>\nthe Appellate Authority, the Subordinate Officer inadvertently fixed<br \/>\nthe pay of the petitioner at Rs.4800\/- in the pay-scale of<br \/>\nRs.4000-6000, which is sought to be corrected by order dated 18th<br \/>\nFebruary 2011 and that is the subject matter of challenge in the<br \/>\npresent petition.\n<\/p>\n<p>3\tLearned<br \/>\ncounsel for the petitioner has placed reliance on Rule 15 of the<br \/>\nGujarat Civil Services (Pay) Rules, 2002 [for short, &#8216;the Rules&#8217;] and<br \/>\nsubmitted that, in the matter where fixation of pay on reversion from<br \/>\nhigher to lower post, pay in the lower post shall be fixed at the<br \/>\nstage of the time scale of the lower post on which he would have<br \/>\ndrawn pay but for his appointment to the higher post as admissible.<br \/>\nIt is also submitted that no opportunity is given to the petitioner<br \/>\nwhile passing the order dated 18th February 201 and,<br \/>\ntherefore, the impugned orders deserve to be quashed and set aside.\n<\/p>\n<p>4\tLearned<br \/>\ncounsel for the respondents would submit that the order impugned is<br \/>\nsimply a correction of earlier administrative error which has crept<br \/>\nin while fixing the pay-scale of the petitioner on the lower post of<br \/>\nSarang. Pursuant to substitution of penalty of compulsory retirement<br \/>\nwith reduction to lower stage and in spite of the order passed by the<br \/>\nAppellate Authority to fix the pay-scale of the petitioner in the<br \/>\npay-scale of Rs.4000-6000 for the post of Sarang in the lower<br \/>\npay-scale, the Subordinate Officer has wrongly fixed the pay-scale of<br \/>\nthe petitioner at Rs.4800\/- which is sought to be corrected by the<br \/>\nimpugned order and, hence, no interference is called for.\n<\/p>\n<p>5.\tRule<br \/>\n15 of the Rules reads as under:\n<\/p>\n<p>&#8220;Fixation<br \/>\nof pay on reversion from higher to lower post: The provisions of rule\n<\/p>\n<p>-13 do not apply in the case of a Government employee appointed from<br \/>\na higher post to a lower post due to reduction of establishment or<br \/>\nreverting to a lower post on termination of his officiating promotion<br \/>\nto a higher post. Where a Government employee is reverted to a lower<br \/>\npost after a spell of promotion in a higher post, his pay in the<br \/>\nlower post shall be fixed at the stage in the time scale of the lower<br \/>\npost at which he would have drawn pay but for his appointment to the<br \/>\nhigher post as admissible under rule-39.&#8221;\n<\/p>\n<p>5\tHaving<br \/>\nheard the learned counsels for the parties and on perusal of the<br \/>\nrecord, what transpires from the record is that, after considering<br \/>\nthe overall facts, initially, the petitioner was compulsorily retired<br \/>\nfrom service by the Disciplinary Authority, but, on appeal, the<br \/>\nChairman of the Gujarat Maritime Board, in exercise of powers<br \/>\nconferred upon the Appellate Authority, substituted the penalty of<br \/>\ncompulsory retirement with reducing the petitioner to the lower rank<br \/>\nof the cadre and the pay-scale was to be fixed accordingly, namely,<br \/>\nfrom the pay-scale of 4500-7000 on the post of Master to the<br \/>\npay-scale of Rs.4000-6000 on the post of  Sarang. In spite of the<br \/>\nabove fact, the Subordinate Officer, wrongly relying upon the Rule 15<br \/>\nof the Rules, fixed the pay-scale of the petitioner at Rs.4800\/-<br \/>\nwhich is contrary to the order passed by the Appellate Authority. On<br \/>\nperusal of Rule 15 of the Rules, it applies in a situation where the<br \/>\npay is to be fixed on reversion from higher to lower post and,<br \/>\nadmittedly, in the instant case the petitioner was not reverted but<br \/>\nhis major penalty of compulsory retirement is substituted by the<br \/>\nAppellate Authority by imposing punishment of  reduction to lower<br \/>\nstage i.e. from the pay-scale of 4500-7000 on the post of Master to<br \/>\nthe pay-scale of Rs.4000-6000 on the post of  Sarang and, in view of<br \/>\nthe above, the said Rule 15 is not applicable. Correction of an<br \/>\nadministrative mistake by the Authority does not confer any right on<br \/>\nthe employee for seeking remedy by challenging the order on the<br \/>\nground of non-compliance of principles of natural justice. No case is<br \/>\nmade out to interfere with the orders impugned in the present<br \/>\npetition.\n<\/p>\n<p>6\tIn<br \/>\nthe result, the petition is rejected. The interim relief stands<br \/>\nvacated. Notice is discharged with no order as to costs.\n<\/p>\n<p>(ANANT<br \/>\nS.
