The Tribunal has awarded compensation of Rs.<br \/>\n\t3,17,200\/- with 7.5% interest.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Mr. Patel raised contention that Tribunal has committed<br \/>\n\tgross error in not considering future prospect of income received by<br \/>\n\tclaimant, at the time when accident occurred.\n<\/p>\n<p>He<br \/>\n\tsubmitted that on the date of accident, income for the year<br \/>\n\t1990-1991 comes to Rs. 1,32,933\/- and monthly salary was Rs. 3860\/-.<br \/>\n\tLearned advocate Mr. Patel submitted that Tribunal has not assessed<br \/>\n\tfuture prospect of income and only considering Rs. 4000\/- per month.<br \/>\n\t Therefore, it is clear case of reducing in calculating income of<br \/>\n\tclaimants.  Except that no other submission is made before this<br \/>\n\tCourt by him.\n<\/p>\n<p>I<br \/>\n\thave considered submissions made by learned advocate Mr. Patel.  The<br \/>\n\tclaim was made by claimant in MACP no. 1508\/1991 for Rs. 4,50,000\/-<br \/>\n\this age was 36 years and Dr. Nirav Harsadray Joshi was examined vide<br \/>\n\texh 30 he had explained injury caused to claimant.  The claimant was<br \/>\n\tadmitted in Hospital from 21\/4\/1991 to 30\/5\/1991 and 57% permanent<br \/>\n\tpartial disability was certified by the Dr. Joshi vide exh 31.\n<\/p>\n<p>The<br \/>\n\tTribunal has considered existing salary of Rs. 3860\/- of claimant on<br \/>\n\tthe date on which accident occurred and round figure of Rs. 4000\/-<br \/>\n\thas been taken into account. From the disability certificate body as<br \/>\n\ta whole, it has been reduced to 30%.   Therefore, from salary of Rs.<br \/>\n\t4000\/-, 30% comes to Rs. 1200\/- which yearly comes to Rs. 14,400\/-<br \/>\n\thas been awarded by Tribunal.  Looking to the age of claimant, 13<br \/>\n\tmultiplier has been applied, which comes to Rs. 1,87,200\/- which is<br \/>\n\tconsidered to be loss of future income.  The Tribunal has awarded<br \/>\n\tRs. 25,000\/- for medical expenses, Rs. 15,000\/- Transportation<br \/>\n\tattendance, for neutral diet Rs. 5000\/-, Rs. 25,0000\/- for pain,<br \/>\n\tshock and suffering, Rs. 60,000\/- for loss of income of six months<br \/>\n\thas been calculated by Tribunal, which comes to Rs. 3,17,200\/-.\n<\/p>\n<p>The<br \/>\n\tlaw on this subject is very clear that in injury case, when<br \/>\n\tcompensation is awarded under the head of permanent disability, then<br \/>\n\tagain, awarding compensation for loss of earning capacity would not<br \/>\n\tarise.  In this case, it is not the case of claimant that because of<br \/>\n\tinjury his salary has been reduced.  The concept of future income<br \/>\n\tthat it is not mean to work out by applying principles which has<br \/>\n\tbeen followed by High Court of Gujarat, but future income means<br \/>\n\twhatever disability has been received body as a whole by claimant,<br \/>\n\tit may extent adversely affect for performing  duty and work, that<br \/>\n\thas been compensated by Tribunal.  The 30% disability body as a<br \/>\n\twhole has been accepted and accordingly, Tribunal has made proper<br \/>\n\tcalculation.\n<\/p>\n<p>It<br \/>\n\tis necessary to note that claimant was working in Life Insurance<br \/>\n\tCorporation being corporate body\/semi Government institution.  In<br \/>\n\tcase, when salary is not reduced because of injury then according to<br \/>\n\tlaw, which has been decided by the Division Bench of this Court,<br \/>\n\tTribunal shall have to consider \u00bcth disability of<br \/>\n\ttotal as certified by Doctor.  Earlier the decision of this Court<br \/>\n\treported in 1993(2) GLR 1043, in such case of injury when there is<br \/>\n\tno loss to earning, 5 multiplier has been applied.  That has been<br \/>\n\tsubsequently altered to consider 1\/4th disability when<br \/>\n\temployee of state government or any Corporation.  For that<br \/>\n\tprinciples, naturally, this compensation bound to be reduced because<br \/>\n\tfrom 57% if it is reduce to 1\/4th that it comes to 15%.\n<\/p>\n<p>The<br \/>\n\tview taken by the Division Bench of this Court in case of the<br \/>\n\tNew India Insurance Co. Vs. Ratilal Jivabhai Patel reported in 1996<br \/>\n\t(2) GLH 712.  The relevant discussion in para 9 is quoted as<br \/>\n\tunder:\n<\/p>\n<p>?S9.\tThe<br \/>\n\tLearned Tribunal had before it the evidence of disability of right<br \/>\n\tlower limb on account of said injury, i.e. permanent partial<br \/>\n\tdisablement capacity determined at 72%.  In relation to the entire<br \/>\n\tbody, it is worked out to 1\/4th, namely 18%.  The learned<br \/>\n\tJudge unfortunately has taken 50% of disablement and has worked out<br \/>\n\tcompensation on that basis.??\n<\/p>\n<p>Therefore,<br \/>\n\taccording to my opinion, considering overall compensation as awarded<br \/>\n\tby claims Tribunal, reasonable compensation has been awarded while<br \/>\n\tconsidering entire facts and circumstances of the case and this<br \/>\n\tCourt has to only consider whether total compensation as awarded by<br \/>\n\tTribunal is just, reasonable and proper or not.\n<\/p>\n<p>In<br \/>\n\tlight of the aforesaid back ground, according to my opinion,<br \/>\n\tTribunal has rightly assessed income of future prospect and also<br \/>\n\trightly calculated amount of compensation.
