No.33878 of 2008\n    Mukesh Kumar Gupta, son of Late Nishikant Gupta, village Line Para, PS Kishanganj, Dist.\n                                  Kishanganj - Petitioner.\n                                           Versus\n                                       State Of Bihar\n\n\n2        12.7.2011<\/pre>\n<p>                      Heard learned counsel for the petitioner and the<\/p>\n<p>                            counsel appearing on behalf of the State.<\/p>\n<p>                                        The petitioner has challenged the order taking<\/p>\n<p>                            cognizance, dated 5.11.2007 passed by the C.J.M., Kishanganj in<\/p>\n<p>                            Kochadhaman PS Case No. 43\/2006 as well as the entire<\/p>\n<p>                            proceeding on the ground that the present case has been filed due<\/p>\n<p>                            to an election dispute in which the petitioner was injured.<\/p>\n<p>                                        The petitioner has filed a case against the informant of<\/p>\n<p>                            the present case and as such it is submitted that the entire<\/p>\n<p>                            proceeding is motivated and malicious.\n<\/p>\n<p>                                        These aspects of the matter may be raised at the<\/p>\n<p>                            appropriate stage of the case.
