Justice M.SASIDHARAN NAMBIAR\n\n Dated :01\/06\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n           ===========================\n           CRL.M.C.No.2777       OF 2007\n           ===========================\n\n       Dated this the 1st day of June,2009\n\n                        ORDER\n<\/pre>\n<p>    Petitioner is the second accused in C.C.35\/2006 on<\/p>\n<p>the file of Judicial First Class Magistrate Court -II,<\/p>\n<p>Kottayam.    The  case  was  taken  cognizance  by  the<\/p>\n<p>Magistrate on the basis of Annexure I complaint filed<\/p>\n<p>by the first complainant Almaya Vedi represented by its<\/p>\n<p>Secretary who is shown as the second complainant.  When<\/p>\n<p>it was brought to their notice that a joint complaint<\/p>\n<p>by  two  persons   is  not  maintainable,  Annexure   V<\/p>\n<p>application was filed with a prayer to remove numbers 1<\/p>\n<p>and 2 shown in the cause title.      That petition was<\/p>\n<p>filed under section 216 of Code of Criminal Procedure.<\/p>\n<p>Petitioner  opposed  the  application  contending  that<\/p>\n<p>petition is not maintainable.   Under Annexure V order<\/p>\n<p>learned Magistrate found that Section 216 of the Code<\/p>\n<p>of Criminal Procedure was wrongly quoted     and still<\/p>\n<p>the application is to be considered on merit.   It was<\/p>\n<p>found that when a joint complaint is filed by more than<\/p>\n<p>one complainant, for that reason alone   the complaint<\/p>\n<p>cannot be dismissed and an opportunity is to be granted<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.2777\/2007               2<\/span><\/p>\n<p>to cure the defect.     But it was found that the mode adopted<\/p>\n<p>by the complainants is not correct and by removing     numbers<\/p>\n<p>1 and 2 from the cause title, the defect cannot be cured.<\/p>\n<p>Therefore the petition was dismissed.      Thereafter   second<\/p>\n<p>complainant filed Annexure VII petition to delete him from<\/p>\n<p>the array of the complainant and to permit him to be a<\/p>\n<p>witness in the complaint.     It is also pointed out that the<\/p>\n<p>first complainant, who would be the sole complainant if the<\/p>\n<p>petition is allowed,     is represented by its Secretary the<\/p>\n<p>second     complainant.     Petitioner  filed   Annexure   VII<\/p>\n<p>objection contending that the petition would amount to<\/p>\n<p>review     of   the  earlier  order  and   when  the   earlier<\/p>\n<p>application was dismissed petitioner is not entitled to<\/p>\n<p>file    another   application  for  the  same  relief.   Under<\/p>\n<p>Annexure      IX   order  learned   Magistrate   allowed   the<\/p>\n<p>application.     It is challenged in this petition filed under<\/p>\n<p>section 482 of the Code of Criminal Procedure.<\/p>\n<p>      2.    Learned counsel appearing for the petitioner and<\/p>\n<p>learned counsel appearing for the respondents were heard.<\/p>\n<p>      3.   It is not disputed that a joint complaint filed by<\/p>\n<p>two persons is not maintainable.      It is also not disputed<\/p>\n<p>that such a complaint cannot be dismissed for that sole<\/p>\n<p>reason and an opportunity is to be granted to cure the<\/p>\n<p>defect. How such a complaint could be cured is dealt by<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.2777\/2007               3<\/span><\/p>\n<p>this    court    in  <a href=\"\/doc\/1346174\/\">Zain  Sait  v.  Intex-Painter,   Interior<\/p>\n<p>Decorators<\/a> (1993 (1) KLT 532).       Annexure VII application<\/p>\n<p>was filed consequent to Annexure VI order dismissing the<\/p>\n<p>earlier petition for the reason that the mode adopted by<\/p>\n<p>the complainant to cure the defect is not correct.          By<\/p>\n<p>Annexure VII petition the complainant sought to cure the<\/p>\n<p>defect by permitting the first complainant to proceed with<\/p>\n<p>the complaint and the second complainant, who is none other<\/p>\n<p>then    the     Secretary of   the  first   complainant,   who<\/p>\n<p>represented by first complainant    to be a witness.   Learned<\/p>\n<p>Magistrate rightly allowed the petition under Annexure IX<\/p>\n<p>order.     I cannot agree with the submission of the learned<\/p>\n<p>counsel that Annexure IX order would amount to review of<\/p>\n<p>Annexure VI order. If under Annexure VI order, the earlier<\/p>\n<p>petition was dismissed on the ground that     complainants are<\/p>\n<p>not entitled to cure the defect by filing a joint complaint<\/p>\n<p>and under Annexure IX order the defect was not allowed on<\/p>\n<p>the ground that defect cannot be cured it could have been<\/p>\n<p>interpreted that the second order would amount to review of<\/p>\n<p>the first order.     But that is not the case herein.  Learned<\/p>\n<p>Magistrate himself found that the defect could be cured.<\/p>\n<p>Under Annexure VI order,       permission sought for was not<\/p>\n<p>granted to cure the defect for the sole reason that        the<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.2777\/2007            4<\/span><\/p>\n<p>mode adopted is not correct.
