OF BIHAR, PATNA\n                                        -----------\n<\/pre>\n<p>2.   16.9.2010            Heard learned counsel for the petitioners<\/p>\n<p>                 and the State.\n<\/p>\n<p>                          The Court in an order passed today in<\/p>\n<p>                 C.W.J.C. No. 6733 of 2010 and analogous cases, has<\/p>\n<p>                 noticed that the advertisement dated 6.2.2010 was<\/p>\n<p>                 specific for the post of Block Development Officer<\/p>\n<p>                 only.\n<\/p>\n<p>                          The petitioners submit that had they been<br \/>\n<span class=\"hidden_text\">                  3<\/span><\/p>\n<p>aware that the respondents under the advertisement<\/p>\n<p>would make appointments of Circle Officers also,<\/p>\n<p>they would have also applied. Since they were not<\/p>\n<p>interested to work on the post of Block Development<\/p>\n<p>Officer they did not apply.     The respondents by<\/p>\n<p>making    appointments    on    posts    beyond   the<\/p>\n<p>advertisement have violated the constitutional rights<\/p>\n<p>of the petitioner to also apply and be considered in<\/p>\n<p>accordance with law. The illegality continued when<\/p>\n<p>the Rural Department transferred the panel on a<\/p>\n<p>requisition made to the Revenue Department which<\/p>\n<p>proceeded to appoint on the post of Circle Officers<\/p>\n<p>not provided for in the advertisement.<\/p>\n<p>         Counter affidavit has been filed on behalf<\/p>\n<p>of the Rural Department only on 29.7.2010. It is not<\/p>\n<p>available on the record.       The Court therefore<\/p>\n<p>requested the counsel for the State to make available<\/p>\n<p>his copy for perusal. No counter affidavit has been<\/p>\n<p>filed on behalf of the Revenue Department.<\/p>\n<p>         If the advertisement was specific for the<\/p>\n<p>post of Block Development Officer only, a person<\/p>\n<p>desirous for deputation on the post of Circle Officer<\/p>\n<p>only may not have applied, being not interested in<\/p>\n<p>the post of Block Development Officer sanguine that<\/p>\n<p>the advertisement shall not be violated in making<\/p>\n<p>appointments.    The moment appointments from a<br \/>\n<span class=\"hidden_text\">                                 4<\/span><\/p>\n<p>           panel prepared under such advertisement is made<\/p>\n<p>           on a post other than that of Block Development<\/p>\n<p>           Officer whether by the Rural Department or the<\/p>\n<p>           Revenue Department, Article 14 would step in, in<\/p>\n<p>           favour of those who did not apply thinking that the<\/p>\n<p>           advertisement was confined to the post of Block<\/p>\n<p>           Development     Officer     only.     They     would   stand<\/p>\n<p>           discriminated inasmuch as they were denied the<\/p>\n<p>           opportunity     to       apply      and   be    considered.<\/p>\n<p>           Appointment beyond the post specified in the<\/p>\n<p>           advertisement is per se arbitrary and needs no<\/p>\n<p>           further discussion in law.\n<\/p>\n<p>                      In the fitness of things, let this matter be<\/p>\n<p>           also disposed off in similar terms as in C.W.J.C. No.<\/p>\n<p>           6733 of 2010 and analogous cases which has been<\/p>\n<p>           referred for appropriate consideration and decision<\/p>\n<p>           in a joint sitting of the Secretaries of the Department<\/p>\n<p>           of Rural Development and Revenue and Land<\/p>\n<p>           Reforms.\n<\/p>\n<p>                      Any further grievance therefore if raised by<\/p>\n<p>           the petitioner are for the two Secretaries to examine<\/p>\n<p>           in accordance with law.\n<\/p>\n<p>                      The writ application stands disposed.<\/p>\n<pre>P.
