This petition seeks quashing of penalty of compulsory<\/p>\n<p>retirement imposed on the petitioner and also further orders of<\/p>\n<p>appellate and reviewing authorities. Prayer has also been made to<\/p>\n<p>quash the enquiry report and the charge sheet.\n<\/p>\n<p>2.           Case of the petitioner is that he was employed with the<\/p>\n<p>Food Corporation of India. A charge sheet dated 2.4.2003,<\/p>\n<p>Annexure P.1 was given to him in respect of misconduct alleged<\/p>\n<p>i.e. causing of financial loss to the extent of Rs.28,38,451.20. The<\/p>\n<p>petitioner denied the charge and an Enquiry Officer was appointed<\/p>\n<p>who gave his report dated 5.5.2004, Annexure P.2, holding the<br \/>\n<span class=\"hidden_text\"> CWP No.17402 of 2006                                             2<\/span><\/p>\n<p>charges to be proved. On the basis of the said report, show cause<\/p>\n<p>notice was given to the petitioner and after considering his<\/p>\n<p>representation, impugned order of penalty of compulsory<\/p>\n<p>retirement was passed. The appeal and review of the petitioner<\/p>\n<p>against the said order were dismissed.\n<\/p>\n<p>3.          Learned counsel for the petitioner raised the following<\/p>\n<p>points:-\n<\/p>\n<blockquote><p>               (i) Authors of Exhibits P.5 and P.6 and reports of the<br \/>\n               inspection team were not examined as witnesses and,<br \/>\n               thus, the said documents could not be held to have<br \/>\n               been proved. Reliance was placed on judgment of<br \/>\n               the Hon&#8217;ble Supreme Court in          M\/s. Bareilly<br \/>\n               electricity <a href=\"\/doc\/244446\/\">Supply Co. Ltd. V. The Workmen and<br \/>\n               others<\/a>, AIR 1972 SC 330.\n<\/p><\/blockquote>\n<blockquote><p>               (ii) Onus was wrongly placed on the petitioner to<br \/>\n               prove his innocence while infact the onus was on the<br \/>\n               department to prove the charge. Reliance was placed<br \/>\n               on judgment of the Hon&#8217;ble Supreme Court in <a href=\"\/doc\/1575323\/\">Delhi<br \/>\n               Cloth and General Mills Co., v. Ludh Budh<br \/>\n               Singh, AIR<\/a> 1972 SC 1031.\n<\/p><\/blockquote>\n<blockquote><p>               (iii) Adverse inference was wrongly drawn for the<br \/>\n               petitioner having not visited the destination inspite<br \/>\n               of opportunity available, which was against the law<br \/>\n               laid down in         Managing Director, ECIL,<br \/>\n               Hyderabad etc. v. B.Karunakar etc,AIR 1994 SC<br \/>\n               1074.\n<\/p><\/blockquote>\n<blockquote><p>               (iv) In absence of any charge for the loss caused, the<br \/>\n               disciplinary authority erroneously observed that the<br \/>\n               petitioner was responsible for the consequential loss.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\"> CWP No.17402 of 2006                                            3<\/span><\/p>\n<blockquote><p>                       (v)The appellate authority and the reviewing<br \/>\n               authority failed to consider the points raised by the<br \/>\n               petitioner, which was against the law laid down by<br \/>\n               the Hon&#8217;ble Supreme Court in <a href=\"\/doc\/1295850\/\">Ram Chander v.<br \/>\n               Union of India, AIR<\/a> 1986 SC 1173.\n<\/p><\/blockquote>\n<p> 5.          On the other hand, learned counsel for the respondents<\/p>\n<p> submitted that charge sheet was duly given to the petitioner after<\/p>\n<p> considering his reply. Enquiry officer was appointed who gave<\/p>\n<p> his report. During the course of enquiry, reasonable opportunity<\/p>\n<p> was given to the petitioner. Evidence was taken in his presence<\/p>\n<p> and he was given opportunity to lead evidence. The Enquiry<\/p>\n<p> Officer gave a detailed report dealing with all the points raised.<\/p>\n<p> Documents Exs. P5 and P.6 were duly proved. PW3 RP Singh<\/p>\n<p> confirmed the contents of Exs. P.5 and P.6 as duly noticed by the<\/p>\n<p> Enquiry Officer. No prejudice whatsoever was caused to the<\/p>\n<p> petitioner. The department duly discharged the burden of proving<\/p>\n<p> the charges. The appellate order also deals with all the submission<\/p>\n<p> made. Judgments relied upon on behalf of the petitioner are<\/p>\n<p> distinguishable. He also referred to judgment of the Hon&#8217;ble<\/p>\n<p> Supreme Court in <a href=\"\/doc\/400596\/\">S.N. Mukherjee v. Union of India,AIR<\/a> 1990<\/p>\n<p> SC 1984 to submit that reasons are not required to be recorded for<\/p>\n<p> an order passed by affirming authority, confirming findings of the<\/p>\n<p> lower authority.\n<\/p>\n<p> 6.          We do not find any merit in the writ petition.\n<\/p>\n<p><span class=\"hidden_text\"> CWP No.17402 of 2006                                             4<\/span><\/p>\n<p> 7.          It is well settled that in exercise of power of judicial<\/p>\n<p> review, interference with the order of disciplinary authority is<\/p>\n<p> permissible only if the finding of Enquiry Officer is based on no<\/p>\n<p> evidence or if there is denial of reasonable opportunity. If enquiry<\/p>\n<p> has been properly conducted, the departmental authority is the<\/p>\n<p> sole judge of the facts. Reference may be made to judgments of<\/p>\n<p> the Hon&#8217;ble Supreme Court in <a href=\"\/doc\/1763592\/\">State of AP and others v. S. Sree<\/p>\n<p> Rama Rao, AIR<\/a> 1963 SC 1723, <a href=\"\/doc\/173865\/\">B.C. Chaturvedi v. Union of<\/p>\n<p> India, AIR<\/a> 1996 SC 484 and High Court of Judicature at<\/p>\n<p> Bombay v. Shashikant S. Patil, AIR 2000 SC 22. In the present<\/p>\n<p> case, the petitioner was given opportunity to deny the charge.<\/p>\n<p> Evidence was led in his presence and he was given opportunity to<\/p>\n<p> cross examine the witnesses and lead the defence evidence. Copy<\/p>\n<p> of enquiry report was duly served on him before taking the<\/p>\n<p> decision and a speaking order was passed dealing with the<\/p>\n<p> objections. We are unable to hold that it was a case of no<\/p>\n<p> evidence. Infact, the petitioner also did not go to that extent and<\/p>\n<p> only submitted that Exs.P.5 and P.6 were not formally proved<\/p>\n<p> and that burden was wrongly placed. We do not find any merit in<\/p>\n<p> the said objection. The disciplinary authority as well as appellate<\/p>\n<p> authority have examined the case of the petitioner and given<\/p>\n<p> sufficient opportunity. Operative part of the order of punishment<\/p>\n<p> does not deal with the causing of loss. The department duly<br \/>\n<span class=\"hidden_text\"> CWP No.17402 of 2006                                            5<\/span><\/p>\n<p> discharged the burden of proving the charges. The judgments<\/p>\n<p> relied upon are distinguishable on facts.\n<\/p>\n<p> 8.          For the above reasons, we do not find any ground to<\/p>\n<p> interfere with the impugned order.\n<\/p>\n<p> 9.
