This  appeal is preferred against the judgment  of\t the<br \/>\nMadhya\tPradesh High Court allowing the writ petition  filed<br \/>\nby the respondent.  The respondent was the Branch Manager in<br \/>\nthe  State  Bank of India, Bhopal  branch.   A\tdisciplinary<br \/>\ninquiry was held against him in respect of six charges.\t The<br \/>\nEnquiry\t Officer held charges 1 and 5 established  but\theld<br \/>\nthat  charges  2, 3, 4 and 6 were  not\testablished.   After<br \/>\nperusing the report of the Enquiry Officer the\tdisciplinary<br \/>\nauthority agreed with the Enquiry Officer that charges 1 and<br \/>\n5  are established and charges 3 and 4 are not\testablished.<br \/>\nSo  far\t as  charge 2 is concerned  he\tdisagreed  with\t the<br \/>\nEnquiry\t Officer.  The disciplinary authority held that\t the<br \/>\nsaid  charge  to  have been fully established.\t So  far  as<br \/>\ncharge\t6 is concerned, he again disagreed with the  Enquiry<br \/>\nOfficer and held it partially established.  Accordingly,  he<br \/>\nimposed\t the punishment of removal from service by an  order<br \/>\ndated  8-5-1984.   The\trespondent filed an  appeal  to\t the<br \/>\nappellate  authority prescribed by the service\tregulations.<br \/>\nThe  appellate authority dismissed the appeal  on  25-1-1985<br \/>\nunder the following order:\n<\/p>\n<blockquote><p>\t      &#8220;With  reference\tto your appeal\tdated  31-8-<br \/>\n\t      1984,  we have to advise that the said  appeal<br \/>\n\t      was  placed by us before the Local Board,\t the<br \/>\n\t      appellate authority, on 25-1-1985.  We further<br \/>\n\t      advise  that the Board in the meeting held  on<br \/>\n\t      the aforesaid date, resolved as under:<br \/>\n\t      &#8220;THE  BOARD considered at length the facts  of<br \/>\n\t      the   case   including  the  fact\t  that\t the<br \/>\n\t      disciplinary  authority has differed from\t the<br \/>\n\t      findings of the inquiring authority in respect<br \/>\n\t      of  two charges.\tAfter having considered\t the<br \/>\n\t      appeal  and other relevant papers\t and  having<br \/>\n\t      applied their minds, the Board concluded\tthat<br \/>\n\t      there are no grounds to sustain the appeal and<br \/>\n\t      accordingly  RESOLVED  that the order  of\t the<br \/>\n\t      disciplinary authority be upheld and that\t the<br \/>\n\t      appeal   made   by  Shri\t S.S.\tKoshal,\t  be<br \/>\n\t      dismissed.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>\t      +\t Arising out of SLP (C) No. 8147 of 1992<br \/>\n<span class=\"hidden_text\">\t      470<\/span>\n<\/p><\/blockquote>\n<blockquote><p>\t      3.    The respondent then approached the\tHigh<br \/>\n\t      Court  by way of a writ petition,\t wherein  he<br \/>\n\t      urged three grounds viz.,<br \/>\n\t      (1)   [N]on-supply  of  copy  of\tthe  Enquiry<br \/>\n\t      Officer&#8217;s report,<br \/>\n\t      (2)   the\t failure to give a fresh  notice  to<br \/>\n\t      him  when the appellate  authority   disagreed<br \/>\n\t      with  the findings of the Enquiry\t Officer  on<br \/>\n\t      some of the charges, and<br \/>\n\t      (3)   the\t fact that the\tappellate  authority<br \/>\n\t      passed  a non-speaking order in  violation  of<br \/>\n\t      the principles of natural justice.\n<\/p><\/blockquote>\n<p>4.   The High Court upheld all the three grounds and allowed<br \/>\nthe writ petition against     which  the present  appeal  is<br \/>\npreferred.\n<\/p>\n<p>5.   The   first   contention  stands\tnegatived   by\t the<br \/>\nConstitution  Bench  decision in  <a href=\"\/doc\/1190519\/\">Managing  Director,  ECIL,<br \/>\nHyderabad  v.  B.  Karunakar1,<\/a>\tinasmuch  as  the  order  of<br \/>\npunishment is prior to 20-11-1990.\n<\/p>\n<p>6.   So far as the second ground is concerned, we are unable<br \/>\nto  see any substance in it.  No such fresh  opportunity  is<br \/>\ncontemplated  by the regulations nor can such a\t requirement<br \/>\nbe  deduced from the principles of natural justice.  It\t may<br \/>\nbe  remembered\tthat  the Enquiry Officer&#8217;s  report  is\t not<br \/>\nbinding upon the disciplinary authority and that it is\topen<br \/>\nto the disciplinary authority to come to its own  conclusion<br \/>\non  the charges.  It is not in the nature of an appeal\tfrom<br \/>\nthe  Enquiry Officer to the disciplinary authority.   It  is<br \/>\none  and the same proceeding.  It is open to a\tdisciplinary<br \/>\nauthority  to hold the inquiry himself.\t It is equally\topen<br \/>\nto him to appoint an Enquiry Officer to conduct the  inquiry<br \/>\nand  place the entire record before him with or without\t his<br \/>\nfindings.   But in either case, the final decision is to  be<br \/>\ntaken  by  him on the basis of the material  adduced.\tThis<br \/>\nalso appears to be the view taken by one of us (B.P.  Jeevan<br \/>\nReddy,\tJ.) as a Judge of the Andhra Pradesh High  Court  in<br \/>\nMahendra  Kumar v. Union of India&#8217;.  The  second  contention<br \/>\naccordingly stands rejected.\n<\/p>\n<p>7.   Now coming to the third ground on which the High  Court<br \/>\nhas  allowed  the  writ petition, the  relevant\t rule  [Rule<br \/>\n51(2)] reads as follows:\n<\/p>\n<blockquote><p>\t      &#8220;An  appeal shall be preferred within 45\tdays<br \/>\n\t      from  date  of receipt of the  order  appealed<br \/>\n\t      against.\tThe appeal shall be addressed to the<br \/>\n\t      appellate\t authority  and\t submitted  to\t the<br \/>\n\t      authority\t whose\torder is  appealed  against.<br \/>\n\t      The employee may, if he so desires, submit  an<br \/>\n\t      advance copy to the appellate authority.\t The<br \/>\n\t      authority\t whose\torder  is  appealed  against<br \/>\n\t      shall  forward  the appeal together  with\t its<br \/>\n\t      comments\tand  records  of  the  case  to\t the<br \/>\n\t      appellate authority.  The appellate  authority<br \/>\n\t      shall   consider\twhether\t the  findings\t are<br \/>\n\t      justified\t  and\/or  whether  the\tpenalty\t  is<br \/>\n\t      excessive\t or inadequate.\t Authority may\tpass<br \/>\n\t      an  order confirming, enhancing,\treducing  or<br \/>\n\t      setting  aside  the penalty or  remitting\t the<br \/>\n\t      case  to\tthe  authority\twhich  imposed\t the<br \/>\n\t      penalty  or to any other authority  with\tsuch<br \/>\n\t      directions   as\tit   deems   fit   in\t the<br \/>\n\t      circumstances of the case.&#8221;\n<\/p><\/blockquote>\n<p>8.   The  High\tCourt  has  taken the  view  that  the\trule<br \/>\nrequires  the appellate authority to pass a  speaking  order<br \/>\neven  if it is an order of affirmance.\tFor the\t purpose  of<br \/>\nthis  case, we shall assume the said view to be the  correct<br \/>\none.  Even so we are not satisfied that the appellate  order<br \/>\nis  not\t a speaking order.  We have  already  extracted\t the<br \/>\nappellate order in full hereinbefore, which shows that it<br \/>\n1  (1993) 4 SCC 727: 1993 SCC (L&amp;S) 1184: (1993) 25 ATC 704:<br \/>\nJT (1993) 6 SC 1<br \/>\n2 (1983) 3 SLR 319, 324 &amp; 325 (AP HC)<br \/>\n<span class=\"hidden_text\">471<\/span><br \/>\nconsidered  at\tlength the facts of the case  including\t the<br \/>\nfact   that  the  appellate  authority\t (sic\tdisciplinary<br \/>\nauthority)  had\t differed from the findings of\tthe  Enquiry<br \/>\nOfficer\t in  respect  of the  two  charges.   The  appellate<br \/>\nauthority then says that it considered the relevant  grounds<br \/>\nof  appeal and after considering the facts of the case\tcame<br \/>\nto the conclusion that there was no substance in the appeal.<br \/>\nIn  view of the fact that it was an order of affirmance,  we<br \/>\nare of the opinion that it was not obligatory on the part of<br \/>\nthe  appellate authority to say more than this as the  order<br \/>\nas  it is, shows application of mind.  The order  cannot  be<br \/>\ncharacterised as a non-speaking order.\n<\/p>\n<p>9.   For  the  above reasons, the appeal  is  allowed.\t The<br \/>\norder  of  the\tHigh Court is set aside\t and  the  order  of<br \/>\npunishment is restored.\t No costs.\n<\/p>\n<p><span class=\"hidden_text\">472<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India State Bank Of India vs S.S.Koshal on 12 January, 1994 Equivalent citations: 1994 SCC, Supl.
