Justice M.SASIDHARAN NAMBIAR\n\n Dated :01\/12\/2010\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n\n           ---------------------------------------------\n           CRL.M.C.NO.3813 OF 2010\n           ---------------------------------------------\n            Dated 1st          December, 2010\n\n\n                          O R D E R\n<\/pre>\n<p>         Petitioner is the first accused in<\/p>\n<p>C.C.186\/2009 on the file of Chief Judicial<\/p>\n<p>Magistrate&#8217;s Court, Pathanamthitta, taken<\/p>\n<p>cognizance for the offence under Sections<\/p>\n<p>406 and 420 read with Section 34 of Indian<\/p>\n<p>Penal Code on Annexure-VII final report.<\/p>\n<p>Second   respondent               is         the        de  facto<\/p>\n<p>complainant.           Prosecution                      case   in<\/p>\n<p>Annexure-VII        final             report             is  that<\/p>\n<p>petitioner   and        the         three          accused   were<\/p>\n<p>running ESSEN Bankers, Pathanamthitta                         and<\/p>\n<p>making second respondent believe that                        the<\/p>\n<p>firm is being run following the regulations<\/p>\n<p>issued by Reserve Bank of India as a non<\/p>\n<p>banking financial institution, induced the<\/p>\n<p>Crmc 3813\/10<br \/>\n<span class=\"hidden_text\">                         2<\/span><\/p>\n<p>second respondent to deposit      various amounts<\/p>\n<p>on different dates and     out of the amounts so<\/p>\n<p>deposited,     Rs.1,00,000\/-   was   repaid   and<\/p>\n<p>including     the  chitty   amount,  balance   of<\/p>\n<p>Rs.11,37,574\/- is yet to be repaid and it was<\/p>\n<p>misappropriated and therefore, all the accused<\/p>\n<p>committed    the  offences. Petition    is  filed<\/p>\n<p>under Section 482 of Code of Criminal Procedure<\/p>\n<p>to    quash  the  cognizance  taken  against  the<\/p>\n<p>petitioner    contending   that  petitioner   was<\/p>\n<p>implicated as first accused, for the reason<\/p>\n<p>that he is one of the partners of the firm and<\/p>\n<p>as seen from Annexure-IV certificate issued by<\/p>\n<p>the Registrar of Firm, petitioner ceased to be<\/p>\n<p>a partner w.e.f. 14\/8\/2002       and partnership<\/p>\n<p>firm was thereafter    reconstituted by Annexure-<\/p>\n<p>V      reconstituted  deed of  partnership  dated<\/p>\n<p>14\/8\/2002    and  petitioner  is  not  a  partner<\/p>\n<p>Crmc 3813\/10<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>thereafter      and as per    final report   during<\/p>\n<p>the period when petitioner was a partner of the<\/p>\n<p>firm,      Rs.40,000\/-  was  deposited  on 4\/9\/2000<\/p>\n<p>and Rs.25,000\/-      was deposited on 16\/5\/2002 and<\/p>\n<p>all the balance amount was deposited later at a<\/p>\n<p>time when petitioner ceased to be a partner and<\/p>\n<p>till      the petitioner retired from the firm on<\/p>\n<p>14\/8\/2002, there      was   no    request  for  re-<\/p>\n<p>payment      of  the  deposit   made  and  in  such<\/p>\n<p>circumstances, petitioner cannot be prosecuted.<\/p>\n<p>Petitioner would also contend that evidenced by<\/p>\n<p>Annexure-VIII      order,  this  Court  has already<\/p>\n<p>accepted his case and quashed the case against<\/p>\n<p>him     in   C.C.60\/2008  on   the  file  of  Chief<\/p>\n<p>Judicial Magistrate&#8217;s Court, Pathanamthitta.<\/p>\n<p>            2.   Learned  counsel appearing for the<\/p>\n<p>second respondent pointed out that petitioner<\/p>\n<p>is not disputing the fact that Rs.40,000\/- was<\/p>\n<p>Crmc 3813\/10<br \/>\n<span class=\"hidden_text\">                           4<\/span><\/p>\n<p>deposited      on  4\/9\/2000  and  Rs.25,000\/-    on<\/p>\n<p>16\/5\/2002      when  petitioner   was  one  of   the<\/p>\n<p>partners of the firm and hence he is liable for<\/p>\n<p>the offences.\n<\/p>\n<p>            3. Final report itself establishes that<\/p>\n<p>subsequent      to  16\/5\/2002,  petitioner  received<\/p>\n<p>Rs.1,00,000\/-      out  of  the  amount  deposited.<\/p>\n<p>Before      retirement  of   the  petitioner   total<\/p>\n<p>amount deposited is only Rs.65,000\/-. In such<\/p>\n<p>circumstances, petitioner cannot be prosecuted<\/p>\n<p>for non payment of the deposit made subsequent<\/p>\n<p>to     the     date   of   his   retirement.   Hence<\/p>\n<p>continuation      of  the  proceedings  against  the<\/p>\n<p>petitioner is only an abuse of process of the<\/p>\n<p>Court.\n<\/p>\n<p>            Petition is allowed. Cognizance taken<\/p>\n<p>against the petitioner       in C.C.186\/2009 on the<\/p>\n<p>file     of   Chief  Judicial  Magistrate&#8217;s   Court,<\/p>\n<p>Crmc 3813\/10<br \/>\n<span class=\"hidden_text\">                       5<\/span><\/p>\n<p>Pathanamthitta    is quashed.
