Opposite parties\n\n                               -----------\n\nHon'ble Rajiv Sharma, J.\n<\/pre>\n<p>      Heard learned Counsel for the parties.\n<\/p>\n<p>      Through this writ petition, the petitioners prays for quashing<br \/>\nthe orders dated 28.9.1991, contained in Annexure Nos.7, 8 and 9<br \/>\nof the opposite parties 3 to 6, whereby they have been confirmed<br \/>\nand the petitioners&#8217; representation has been rejected and they<br \/>\nhave been held to be juniors to the opposite party nos.3 to 6.<br \/>\nFurther pray for quashing of the Rule 7 reproduced in para 28<br \/>\nholding it to be arbitrary and illegal and ultra vires has also been<br \/>\nmade.\n<\/p>\n<p>      Brief facts of the petitioners&#8217; case are that in December,<br \/>\n1985, the Controlling Chairman, U. P. Public Services Tribunal<br \/>\n(hereinafter referred to as the &#8216;Tribunal&#8217; for the sake of brevity)<br \/>\ninvited   applications    through       Employment    Exchange   for<br \/>\nappointment on various Ministerial posts in the Tribunal. On<br \/>\n19.2.1986, the Controlling Chairman passed an order appointing<br \/>\nthe petitioners 1 to 8 and one Smt. Mohini Misra on the posts of<br \/>\nClerk-cum-Typist. Thereafter, the petitioner No.9 was also given<br \/>\nappointment to fill up the quota of Scheduled Caste category.<br \/>\nSubsequently, one Smt. Mohini Misra resigned her job and in her<br \/>\nplace, petitioner No.10 was given appointment as his name was<br \/>\nalready in the waiting list.\n<\/p>\n<p>      Petitioners&#8217; Counsel further asserted that appointment of<br \/>\nthe petitioners cannot be said to be ad hoc in nature as they faced<br \/>\nselection committee and full procedure for appointment on regular<br \/>\nbasis was followed. In any case, the appointment of the<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>petitioners was termed to be ad hoc only, because the petitioners<br \/>\nwere not selected by the District Level Selection Committee and<br \/>\ntherefore, on coming into force of the Government Order dated<br \/>\n24.6.1986 and subsequent Rules on 8.9.1986, the nature of<br \/>\npetitioners&#8217; appointment automatically became regular as the<br \/>\ncondition No.3 in the appointment order became redundant. The<br \/>\nappointment of the opposite parties 3 to 6 cannot be said to be<br \/>\nvalid as the orders of appointment were passed by the competent<br \/>\nauthority. The Controlling Chairman failed to appreciate that the<br \/>\npetitioners&#8217; appointment was regular in nature. Further, the<br \/>\nChairman committed an error in holding the petitioners junior and<br \/>\nfailed to see that on the basis of continuous officiation, the<br \/>\npetitioners would become senior. No discrimination can be made<br \/>\nby the State Government in providing criteria for determination of<br \/>\nseniority of those appointed directly and of those appointed<br \/>\nthrough promotion.\n<\/p>\n<p>      On the other hand, learned Standing Counsel submits that<br \/>\non 16.3.1985, the Government of U. P. in exercise of powers<br \/>\nconferred by the proviso to Article 309 of the Constitution enforce<br \/>\nvide notification No. 20\/3\/82, The Subordinate Offices Ministerial<br \/>\nStaff (Direct Recruitment) Rules, 1985 for regulating recruitment<br \/>\nof Ministerial Staff in the Subordinate Government Offices in the<br \/>\nState. This Rule also governed recruitment to all ministerial posts<br \/>\nin the Services Tribunal. The State of U. P. in Karmik Anubhag &#8211; 2<br \/>\nin exercise of powers conferred in proviso to Article 309 of the<br \/>\nConstitution of India have also framed and enforced with<br \/>\nimmediate effect Uttar Pradesh Sew Adhikaran, Lipik Verg Sewa<br \/>\nNiyamawali, 1987 vide notification dated 1st July, 1987. These<br \/>\nRules are exhaustive and contain details regarding recruitment to<br \/>\nsubstantive   vacancy,   its   procedure,   formation   of   Selection<br \/>\nCommittee, probation period, confirmation, promotion, seniority<br \/>\netc. These Rules are applicable at present to All Ministerial<br \/>\nEmployees of Services Tribunal. When the representation of the<br \/>\npetitioners was rejected, U. P. Government Seniority Rules, 1991<br \/>\nwere in force. At that time, the petitioners were placed on<br \/>\nprobation, whereas the opposite parties 3 to 6 were confirmed.<br \/>\nThe petitioners filed their writ petition after lapse of one year,<br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>therefore, the writ petition is barred by limitation.\n<\/p>\n<p>      Considered the submissions made by the learned counsel<br \/>\nfor the parties and perused the record. Admittedly, when the<br \/>\nrepresentation of the petitioners was rejected, U. P. Government<br \/>\nSeniority Rules, 1991 were in force. Therefore, the impugned<br \/>\norder has rightly been passed. Further, the opposite parties 3 to 6<br \/>\nwere sponsored by the Employment Exchange for regular vacant<br \/>\nposts of Typists\/Junior Clerks. The selection committee for<br \/>\nrecruitment of all the petitioners was different to the selection<br \/>\ncommittee for recruitment of the opposite parties 3 to 6.<br \/>\nTherefore, the contention of learned counsel for the petitioners<br \/>\nthat the selection committees for the petitioners and the opposite<br \/>\nparties were same or the nature of selection was identical is not<br \/>\nacceptable. Once the appointment has been accepted by the<br \/>\npetitioners, they should not raise their grievance that too after<br \/>\nlapse of six years. To clarify this point, it is reiterated that after<br \/>\nselection, the petitioners were joined in the year 1986, whereas<br \/>\nthe representation of the petitioners was rejected in the year<br \/>\n1991. Subsequently, the writ petition was filed after one year from<br \/>\nthe date of passing the impugned order.
