Learned counsel for the petitioner submitted that the<br \/>\npetitioner retired from the services of the respondents. Petitioner<br \/>\nhas worked honestly, diligently, sincerely and to the satisfaction of<br \/>\nthe respondents. After his retirement, he is entitled for all the<br \/>\nretirement benefits and no civil or criminal proceedings are<br \/>\ninitiated against the petitioner, but, these retirement benefits have<br \/>\nnot yet been paid by the respondents and therefore, a direction<br \/>\nmay be given to the competent authority of the respondents to<br \/>\ntreat this writ petition as representation and to decide the same<br \/>\nwithin stipulated time, in accordance with law, after giving an<br \/>\nadequate opportunity of being heard to the petitioner or to his<br \/>\nrepresentative.\n<\/p>\n<p>2.            I have heard learned counsel for the respondents, who<br \/>\nhas submitted that they have no much objection, if such a<br \/>\ndirection is given to the competent authority of the respondents, to<br \/>\ntreat this writ petition as representation and to decide the legally<br \/>\npayable dues to the petitioner, in accordance with law, within the<br \/>\nstipulated time given by this Court.\n<\/p>\n<p>3.            In view of aforesaid submissions, I hereby direct the<br \/>\nconcerned competent respondent authorities to treat this writ<br \/>\npetition as representation and to decide the same, in accordance<br \/>\nwith law, rules, regulations, policies and enforceable Government<br \/>\norders, applicable to the petitioner, as expeditiously as possible<br \/>\nand practicable, preferably within a period of sixteen weeks from<br \/>\nthe date of receipt of copy of an order of this Court, after giving an<br \/>\nopportunity    of   being   heard   to   the   petitioner   or   to   his<br \/>\nrepresentative. If decision is taken in favour of the petitioner, the<br \/>\nlegally payable dues shall be paid to the petitioner within further<br \/>\nperiod of two weeks, thereafter. The legally payable amount shall<br \/>\n<span class=\"hidden_text\">                                -2-<\/span><br \/>\n     be paid to the petitioner with statutory interest and where there is<br \/>\n     no statutory provision, the legally payable amount shall be paid<br \/>\n     with interest at the simple rate of 5 % per annum, to the petitioner,<br \/>\n     from the date of which the payment ought to have been made.\n<\/p>\n<p>     4.          In view of the aforesaid directions, this writ petition<br \/>\n     stands disposed of.\n<\/p>\n<p>                                                 (D.N.
