SHAH\n\t\t\n\t\n\n \n\nDate\n: 03\/03\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tWith<br \/>\nthe consent of the learned advocates appearing on behalf of the<br \/>\nrespective parties and in the facts and circumstances of the case,<br \/>\nthe present Second Appeal itself is taken up for final hearing today.\n<\/p>\n<p>2.\tAt<br \/>\nthe time of admission, the  learned Single Judge framed the following<br \/>\nsubstantial questions of law to be determined by this Court;\n<\/p>\n<p>(i)\tWhether<br \/>\nin the facts and circumstances of the case, the Courts below have<br \/>\njurisdiction to issue direction to the appellant to create a post and<br \/>\ngive appointment to the respondent?\n<\/p>\n<p>(ii)\tWhether<br \/>\nin the facts and circumstances of the case, the Courts below can pass<br \/>\norder of compassionate appointment in contravention of the policy<br \/>\nframed by the appellant-Corporation?\n<\/p>\n<p>3.\tThe<br \/>\npresent Second Appeal has been preferred by the appellants-original<br \/>\ndefendants-Gujarat State Road Transport Corporation  challenging the<br \/>\nimpugned judgement and order passed  by the learned Principal<br \/>\nDistrict Judge, Porbandar dated 10\/02\/2009 in  Regular Civil Appeal<br \/>\nNo. 74\/2005 in dismissing the same and confirming the judgement and<br \/>\ndecree passed by the learned Additional Senior Civil Judge, Porbandar<br \/>\ndated 06\/10\/2005 in Regular Civil Suit No. 618\/1995 by which both the<br \/>\n Courts below have directed the appellants-original defendants to<br \/>\nappoint the respondent-original plaintiff on compassionate ground,<br \/>\neven by creating a post, on the death of his father, who was serving<br \/>\nwith appellant no. 1-Gujarat State Road Transport Corporation as<br \/>\ndriver, who died on 16\/05\/1981 while in service.\n<\/p>\n<p>4.\tThe<br \/>\nfacts leading to the present Second Appeal in  nutshell are as under;\n<\/p>\n<p>4.1.\tThe<br \/>\nfather of the respondent-original plaintiff was serving as permanent<br \/>\ndriver in Porbandar S.T. Depo, who died while in service on<br \/>\n16\/05\/1981.  At the time when the deceased employee died, the<br \/>\nrespondent-original plaintiff was minor i.e. aged five years.  The<br \/>\nrespondent-original plaintiff instituted Regular Civil Suit No.<br \/>\n618\/1995 in the Court of learned Additional Senior Civil Judge,<br \/>\nPorbandar  for declaration that, on  death of his father, the<br \/>\nrespondent-original plaintiff is entitled to appointment on<br \/>\ncompassionate ground and for declaration that the action of the<br \/>\nappellants-original defendants in not appointing the<br \/>\nrespondent-original plaintiff on compassionate ground, on the death<br \/>\nof his father, is illegal and unjust.    The learned trial Court vide<br \/>\njudgement and decree dated 06\/10\/2005 decreed the said suit and<br \/>\ndeclared that on  death of the father of the respondent-original<br \/>\nplaintiff, respondent-original plaintiff is entitled to appointment<br \/>\non compassionate ground.  Being aggrieved and dissatisfied with the<br \/>\njudgement and decree passed by the learned Additional Senior Civil<br \/>\nJudge, Porbandar dated 06\/10\/2005 in Regular Civil Suit No. 618\/1995,<br \/>\nthe appellants-original defendants preferred Regular Civil Appeal No.<br \/>\n74\/2005 before the learned Principal District Judge, Porbandar and<br \/>\nthe learned appellate Court not only dismissed the said appeal<br \/>\nconfirming the judgement and decree passed by the learned trial Court<br \/>\nbut also passed further order that if there is no post available, in<br \/>\nthat case, supernumerary post be created considering the educational<br \/>\nqualification of the respondent-original plaintiff  and to appoint<br \/>\nthe respondent-original plaintiff.  Being aggrieved and dissatisfied<br \/>\nwith the judgement and order passed by the learned Principal District<br \/>\nJudge, Porbandar dated 10\/02\/2009 in Regular Civil Appeal No.<br \/>\n74\/2005, the appellants-original defendants have preferred the<br \/>\npresent Second Appeal.\n<\/p>\n<p>5.\tMs<br \/>\nSejal Mandavia, learned advocate appearing on behalf of the<br \/>\nappellants-original defendants has vehemently submitted that the<br \/>\njudgement and order passed by the both the Courts below directing the<br \/>\nappellants-original defendants  to appoint the respondent-original<br \/>\nplaintiff on compassionate ground is absolutely illegal and against<br \/>\nthe scheme of the appellant- Gujarat State Road Transport Corporation<br \/>\n as well as against the decisions of the Hon&#8217;ble Supreme Court as<br \/>\nwell as this Court.   It is further submitted that the learned<br \/>\nappellate Court has passed an order to create supernumerary post to<br \/>\nappoint the respondent-original plaintiff on compassionate ground,<br \/>\nwhich is absolutely without jurisdiction and, therefore, it is<br \/>\nrequested to quash and set aside the impugned judgement and orders<br \/>\nand to allow the present Second Appeal.  It is submitted that as such<br \/>\nthe father of the respondent-original plaintiff died in the year 1981<br \/>\nand the suit came to be filed in the year 1995 i.e. after a period of<br \/>\n14 years from the date of death of the deceased employee and also<br \/>\nafter five years of attaining the age of majority by the<br \/>\nrespondent-original plaintiff, and, therefore, both the Courts below<br \/>\nhave materially erred in directing the appellants-original defendants<br \/>\nto appoint the respondent-original plaintiff on compassionate ground.\n<\/p>\n<p>6.\tMs.\n<\/p>\n<p>Sejal Mandavia, learned advocate appearing on behalf of the<br \/>\nappellants-original defendants has heavily relied upon the decisions<br \/>\nof the Hon&#8217;ble Supreme Court in the case of STATE OF J &amp; K &amp;<br \/>\nORS Vs. SAJAD AHMED MIR reported in  (2006) 5 SCC 766 as<br \/>\nwell as in the case of DHARMENDRASINH VANRAJSINH JADEJA Vs. STATE<br \/>\nOF GUJARAT &amp; ORS reported in 2009 (1) GLR 434  and<br \/>\nthe decision of this Court  dated 29\/12\/2009 in Special Civil<br \/>\nApplication No. 298\/2009.   By making the above submissions and<br \/>\nrelying upon the above decisions, it is requested to allow the<br \/>\npresent Second Appeal.\n<\/p>\n<p>7.\tThe<br \/>\npresent Second Appeal is opposed by Shri Popat, learned advocate<br \/>\nappearing on behalf of the respondent-original plaintiff.  It is<br \/>\nsubmitted that at the relevant time when the father of the<br \/>\nrespondent-original plaintiff died in the year 1981, the<br \/>\nrespondent-original plaintiff was minor, aged 5 years only, and,<br \/>\ntherefore, after the respondent-original plaintiff attained the age<br \/>\nof majority he submitted an application for appointment on<br \/>\ncompassionate ground, which was wrongly rejected and, therefore, both<br \/>\nthe Courts below have rightly passed the order directing the<br \/>\nappellants-original defendants to appoint the respondent-original<br \/>\nplaintiff on compassionate ground even by creating  supernumerary<br \/>\npost.  No other submissions have been made.  By making the above<br \/>\nsubmissions, it is requested to dismiss the present Second Appeal.\n<\/p>\n<p>8.\tHeard<br \/>\nthe learned advocates appearing on behalf of the respective parties<br \/>\nat length.  It is not in dispute that the father of the<br \/>\nrespondent-original plaintiff died in the year 1981 and as per the<br \/>\npolicy of the appellant no. 1-Gujarat State Road Transport<br \/>\nCorporation, if at the time of death of an employee, dependent is<br \/>\nminor and\/or attains the age of majority within 10 years, then and<br \/>\nthen only the application can be considered.  It is to be noted that<br \/>\nin the present case the suit came to be instituted by the<br \/>\nrespondent-original plaintiff in the year 1995 i.e. after a period of<br \/>\n 14 years  from the death of the deceased employee.  It is also<br \/>\nrequired to be noted that the respondent-original plaintiff attained<br \/>\nthe age of majority in the  year 1993-94 and after a period of two<br \/>\nyears of attaining the age of majority the suit came to be filed.  It<br \/>\nis also required to be noted that when the learned trial Court<br \/>\ndecreed the suit, 24 years have passed after the death of the<br \/>\ndeceased employee and, therefore, when the order came to be passed by<br \/>\nthe learned trial Court to appoint the respondent-original plaintiff<br \/>\non compassionate ground it was after a period of 24 years from the<br \/>\ndeath of deceased employee.\n<\/p>\n<p>9.\tIn<br \/>\nthe aforesaid background and in the facts and circumstances of the<br \/>\ncase, the present Second Appeal is required to be considered and<br \/>\nappointment of the respondent-original plaintiff on compassionate<br \/>\nground is not to be considered.\n<\/p>\n<p>10.\tAs<br \/>\nobserved by the Hon&#8217;ble Supreme Court in case of Sajjad<br \/>\nAhmed Mir (supra),<br \/>\nthe compassionate appointment is exception to the general rule and<br \/>\nnormally, an employment in the Government or other public sectors<br \/>\nshould be open to all eligible candidates who can come forward to<br \/>\napply and compete with each other. It is in consonance with Article<br \/>\n14 of the Constitution. On the basis of competitive merits, an<br \/>\nappointment should be made to public office. It is also further<br \/>\nobserved by the Hon&#8217;ble Supreme Court that this general rule should<br \/>\nnot be departed from except where compelling circumstances demand,<br \/>\nsuch as, death of the sole breadwinner and livelihood of the family<br \/>\nsuffering because of the setback. It is<br \/>\nalso further observed by the Hon&#8217;ble Supreme Court that once it is<br \/>\nproved that in spite of the death of the breadwinner, the family<br \/>\nsurvived and substantial period is over, there is no necessity to say<br \/>\n goodbye  to the normal rule of appointment and to show favour to<br \/>\none at the cost of the interests of several others ignoring the<br \/>\nmandate of Article 14. In the case before the Hon&#8217;ble Supreme Court,<br \/>\nthe learned Single Judge dismissed the petition on the ground of<br \/>\ndelay and laches. The Division Bench set aside the said order and<br \/>\npassed an order of appointment on compassionate ground. The Hon&#8217;ble<br \/>\nSupreme Court set aside the order passed by the Division Bench and<br \/>\nhas observed as above.\n<\/p>\n<p>11.\tIdentical<br \/>\nquestion came to be considered by this Court in Special Civil<br \/>\nApplication No.1678 of 1997 and Special Civil Application No.1903 of<br \/>\n2005 and this Court dismissed the said Special Civil Applications<br \/>\nrelying upon the decision of the Hon&#8217;ble Supreme Court in the case of<br \/>\nState of J&amp;K<br \/>\nand Others vs. Sajjad Ahmed Mir reported in (2006) 5 SCC 766 and<br \/>\nin the case of National<br \/>\nHydroelectric Power corporation and Another vs. Nanak Chand and<br \/>\nAnother reported in 2004 AIR SCW 6339 rejecting<br \/>\nthe applications which were filed belatedly.\n<\/p>\n<p>12.\tIn<br \/>\nthe case of  National Hydroelectric Power corporation and Another<br \/>\n(supra), the Hon&#8217;ble Supreme Court has observed that  it is to<br \/>\nbe seen that the appointment on compassionate ground is not a source<br \/>\nof recruitment, but merely an exception to the requirement regarding<br \/>\nappointments being made on open invitation of application on merits.<br \/>\nBasic intention is that on the death of the employee concerned, his<br \/>\nfamily is not deprived of means of livelihood.  The object is to<br \/>\nenable the family to get over sudden financial crises.\n<\/p>\n<p>13.\tConsidering<br \/>\nthe aforesaid decisions of the Hon&#8217;ble Supreme Court in the case of<br \/>\nSajjad Ahmed Mir<br \/>\n(supra) and in the case of<br \/>\nNational Hydroelectric Power corporation and Another (supra)<br \/>\nand the facts of the present case that more than 20 years have been<br \/>\npassed after the death of the deceased employee and even at the time<br \/>\nwhen the learned trial court passed the decree more than twenty seven<br \/>\nyears had been passed and the family survived for all these years, as<br \/>\nobserved by the Hon&#8217;ble Supreme Court, there is no necessity to say<br \/>\n good bye  to the normal rule of appointment and to show favour<br \/>\nto one at the cost of the interests of several others ignoring the<br \/>\nmandate of Article 14.  Under the circumstances, the judgment and<br \/>\ndecree passed by the learned trial court, confirmed by the appellate<br \/>\ncourt is just contrary to the aforesaid two decisions of the Hon&#8217;ble<br \/>\nSupreme Court as well as the object and purpose of appointment on<br \/>\ncompassionate ground which deserves to be quashed and set aside.\n<\/p>\n<p>14.\tIn<br \/>\nview of the above and for the reasons stated hereinabove, the present<br \/>\nSecond Appeal succeeds. The impugned judgement and orders passed by<br \/>\nthe learned Additional Senior Civil Judge, Porbandar dated 06\/10\/2005<br \/>\nin Regular Civil Suit No. 618\/1995 and learned Principal District<br \/>\nJudge, Porbandar dated 10\/02\/2009 in Regular Civil Appeal No. 74\/2005<br \/>\nare hereby quashed and set aside.    The present Second Appeal is<br \/>\nallowed to the aforesaid extent.
