Choudhary, P.P. for the State.\nMr. Dhirendra Singh for the respondents.\n\nBY THE COURT :<\/pre>\n<p>     The State has submitted this petition for leave to<\/p>\n<p>appeal against the judgment dated 29.6.2007 passed in<\/p>\n<p>Sessions   Case   NO.8\/2007    passed      by    the    learned<\/p>\n<p>Addl.Sessions Judge (Fast Track) NO.2, Pali, by which for<\/p>\n<p>charges under Section 302 and 364, one of the accusded<\/p>\n<p>Tej Pal has been convicted but respondent Raju has<\/p>\n<p>been acquitted by the trial court.\n<\/p>\n<p>     Brief facts of the case are that on 19.9.2006, the<br \/>\n                       D.B.Criminal Leave to Appeal No.195\/2007<br \/>\n                                                               in<br \/>\n                              D.B.Criminal Appeal No.&#8212;-\/2007.\n<\/p>\n<p>                                       The State or Raj. vs. Raju<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>complainant Prakash submitted a typed information in<\/p>\n<p>the Police Station, Marwar Junction stating therein that<\/p>\n<p>his elder sister Smt. Pista aged 52 years was residing<\/p>\n<p>permanently at    Bangalore. About a month ago, his<\/p>\n<p>sister came to live with complainant&#8217;s mother Smt.<\/p>\n<p>Ghewari Devi. Tej Pal is neighbour of the complainant<\/p>\n<p>and he took some loan from complainant&#8217;s sister. Tej Pal<\/p>\n<p>told Smt. Pista that for repayment of loan, he will have<\/p>\n<p>to go to Bank at Marwar Junction. Smt. Pista, therefore,<\/p>\n<p>went with accused Tej Pal for going to Marwar Junction<\/p>\n<p>by train. However, Smt. Pista did not come back to the<\/p>\n<p>house, therefore, on 19.9.2006, a report about missing<\/p>\n<p>of Smt. Pista was lodged.The complainant subsequently,<\/p>\n<p>came to know that in fact Tej Pal and his colleagues<\/p>\n<p>Ratan and Raju killed Smt. Pista and took away her<\/p>\n<p>ornaments   which    have    been      disclosed      by    the<\/p>\n<p>complainant in the report. On these allegations, FIR<\/p>\n<p>No.159 dated 19.9.2006 was registered as at that time<\/p>\n<p>the complainant&#8217;s apprehension was that Smt. Pista<\/p>\n<p>might have been killed and there was no positive<\/p>\n<p>information to the complainant that Smt. Pista has<br \/>\n                           D.B.Criminal Leave to Appeal No.195\/2007<br \/>\n                                                                   in<br \/>\n                                  D.B.Criminal Appeal No.&#8212;-\/2007.\n<\/p>\n<p>                                           The State or Raj. vs. Raju<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>already been killed. After investigation, challan was<\/p>\n<p>submitted against the two accused Tej Pal and Raju for<\/p>\n<p>offences under Section 664, 302 and 302\/34, IPC. The<\/p>\n<p>prosecution produced as many as 20 witnesses. The trial<\/p>\n<p>court after considering the evidence and the documents<\/p>\n<p>placed on record, acquitted respondent Raju for the<\/p>\n<p>charges referred above. Hence this appeal has been<\/p>\n<p>preferred by the State.\n<\/p>\n<p>        It appears from the judgment of the trial court<\/p>\n<p>that the trial court, after considering the entire<\/p>\n<p>evidence and particularly the alleged recovery of one<\/p>\n<p>gold ring, held that there is no evidence of seeing<\/p>\n<p>deceased Raju at any point of time nor the recovery of<\/p>\n<p>the gold ring has been proved by trustworthy evidence.<\/p>\n<p>The other witnesses were neither knowing respondent<\/p>\n<p>Raju nor they identified accused in any manner. The<\/p>\n<p>trial   court   also   reached     to   the    conclusion      that<\/p>\n<p>respondent Raju was very much available in the town of<\/p>\n<p>Bhinmal from 4.9.2006 to 17.9.2006 and this fact has<\/p>\n<p>been proved from the prosecution witnesses PW-19<\/p>\n<p>Bhanwar Lal and PW-20 Bhikh Singh.\n<\/p>\n<p>                              D.B.Criminal Leave to Appeal No.195\/2007<br \/>\n                                                                      in<br \/>\n                                     D.B.Criminal Appeal No.&#8212;-\/2007.\n<\/p>\n<p>                                              The State or Raj. vs. Raju<br \/>\n<span class=\"hidden_text\">                                  4<\/span><\/p>\n<p>           We perused the statements of the witnesses. It<\/p>\n<p>      appears from the statements of PW-9            Ghewari Devi,<\/p>\n<p>      PW-10 Shanti Lal, PW08 Jayanti Lal, PW-12 Smt. Pista<\/p>\n<p>      w\/o Tara Chand and PW-11 Prakash that there is no<\/p>\n<p>      direct evidence against respondent Raju for commission<\/p>\n<p>      of offence, individually or with accused Tej Pal.<\/p>\n<p>           After going through all the reasons given by the<\/p>\n<p>      trial court and after considering all the evidence<\/p>\n<p>      available on record, we are of the view that the trial<\/p>\n<p>      court has not committed any error of fact or law in<\/p>\n<p>      acquitting respondent Raju.\n<\/p>\n<p>           There is no merit in the petition for leave to<\/p>\n<p>      appeal.
