Rule. Rule is waived by learned<br \/>\n\tadvocates appearing for the respondents. With the consent of learned<br \/>\n\tadvocates for the parties, rule is fixed forthwith.\n<\/p>\n<p>Shri<br \/>\n\tShastri, learned advocate appearing for respondent no.1 &amp; 2 has<br \/>\n\tvery fairly submitted that in view of  pendency of the matter before<br \/>\n\tthe District Collector, as could be seen from  page-32 of the<br \/>\n\tpetition, there cannot be any objection in quashing the orders at<br \/>\n\tAnnexure-A dated 1\/6\/2011 and at Annexure-K dated 11\/8\/2011 at this<br \/>\n\tstage, without prejudice to the respondent no. 1 &amp; 2&#8217;s<br \/>\n\tcontentions to be taken before the appropriate authority.\n<\/p>\n<p>Learned<br \/>\n\tadvocate for the petitioner also submitted that, it goes without<br \/>\n\tsaying that, in case, if such contentions are taken, then, the<br \/>\n\tpetitioner will also be at liberty to defend their case in<br \/>\n\taccordance with law.\n<\/p>\n<p>In<br \/>\n\tview of the aforesaid submission by learned advocates for the<br \/>\n\tcontesting parties, this Court need not go into other merits of the<br \/>\n\tmatter. Suffice it to say that the order at Annexure-A dated<br \/>\n\t1\/6\/2011 and Annexure-K dated 11\/8\/2011 are hereby quashed and set<br \/>\n\taside. Liberty is reserved for the parties to pursue the remedy<br \/>\n\tbefore the appropriate authority in accordance with law. Rule made<br \/>\n\tabsolute. No cost in view of the fact situation.
