2.1  Thel:app.e11ant–employee has been employed by the<\/p>\n
Board”  2.7.1991. He has questioned the correctness of<\/p>\n
 of termination dated 7.2.2008 passed by the members<\/p>\n
  of the Board urging various grounds particularly placing<\/p>\n
reliance upon the order passed by this court in the
\nW.P.No.1_0529\/92 disposed of on 16.6.1998 and requested<\/p>\n
this court to peruse the additional document in this Writ<\/p>\n
\\\u00bb\/<\/p>\n
appeal in lVlisc.W.1508\/09 under Order XLI Rule 27 of CPC,<\/p>\n
the Learned Counsel for the Appellants submits”<\/p>\n
order impugned in the writ petition is not sustai.i\u00a7ilabi’e.’ .<\/p>\n
as the same is contrary to the Govemment dated ‘*<\/p>\n
14.6.1990 particularly para 9 speaks.oo_fT the <\/p>\n

‘.V.There1″ore,: it could not be brought to the notice of the learned<\/p>\n
0’ llfsinlgdlep judge to examine the order in the impugned writ<\/p>\n
~  pcgutilon. Therefore, he has requested this couxt to consider<\/p>\n
” the aforesaid legal aspects and material evidence and grant<\/p>\n
the relief as played in the writ petitions.<\/p>\n

3. Learned counsel Mr. Venkatesh for the Board has
\njustified the order of termination placing reliance upon the
\ndocument produced at Annexure–R–l, contending that the<\/p>\n
appellant herein was working at Mysore on contractiblasuis.<\/p>\n
As per the Board’s Memorandum dated 6.2.2008:;”‘tlie_ifg: u<\/p>\n
no Work in the Regional Of\ufb01ce at Mysore   list –, <\/p>\n
applied for the recruitment of <\/p>\n
Recruitment Notification in 2002. Therefore,  vtras  ;<\/p>\n
compelled to terminate him  _ser\\}ice_llAoi”: the Board.
\nHence, the learned counsel  submits that the
\norder of termination is   ‘With the learned<\/p>\n
single  samell does not call for our
\ninterference   in exercise of Appellate<\/p>\n
Jurisdiction’ arid Poweif.  ”\n<\/p>\n
   heariied coiinsell for the Appellant has rightly placed<\/p>\n
 reliaii.ce’\u00abin ~supp*_ort of his contention reported in the case of<\/p>\n
Incliorge Gloi\u00a7t;il:Hide Flaying Centre & another V\/s. Rama Ram<\/p>\n
 &  [2003 SCC (L818) 1170) wherein the same legal<\/p>\n
“:l”_a.spe’cts are urged to contend that the order of the learned<\/p>\n
  single judge is not sustainable in law for the reason that the<\/p>\n
aPDellant’s services shouldkyhave been terminated.<\/p>\n

Another important aspect of the case is that the drivers who
\nwere subsequently appointed from 1994 to 19992000 by the
\nBoard have been retained in their services of the Board.<\/p>\n
Therefore, the termination order passed ElgE1lI}.VSV’:t’.”I1\u00a3l’_1C<\/p>\n
Appellant is in contravention of the Principle of _<\/p>\n
\ufb01rst–g0″ as stated in the Governrnentpprder referred\u00bb  supra <\/p>\n
upon which rightly placed re1ia;\u00a71cei_—by’ <\/p>\n
Counsel and the decision of .the_ supreine court jvrefverred to <\/p>\n
supra. For this reason, having regarduto  undisputed fact<\/p>\n
that the employees Olf\ufb01ihe  were appointed’<\/p>\n
subsequent to the El.p]JOiI1tv:I.lif3,I1l,l.’V0l:j tl’ievVap.’pel’1ant have been<\/p>\n
retained in ti1Vef\u00bbserv7.lces_ oftlie Board and the services of the
\nappellant is<–terminated"i.nll"eor1travention of the Government<\/p>\n
Order and lawn' laid clowlrillby the Apex Court in the case<\/p>\n
