Mr. Dave, has<br \/>\nrelied upon the decision of this Court in the case of <a href=\"\/doc\/1349222\/\">Mahendra<br \/>\nPetrochemicals Ltd. v. Union of India<\/a> reported<br \/>\nin 2008 (222) E.L.T 508 (Guj.), more particularly para<br \/>\n8 and 9, which read as under :-\n<\/p>\n<p>&#8220;8. In the present<br \/>\ncase, as the facts reveal, the Settlement Commission has not even<br \/>\nheard the petitioner before passing the impugned order dated 16th<br \/>\nMay, 2005. In the subsequent application seeking further extension of<br \/>\ntime and payment by way of installments the petitioner had<br \/>\ncategorically referred to its weak financial position and pendency of<br \/>\ncase before the BIFR. The petitioner has also given reasons for the<br \/>\nweak financial position. Instead of passing an order without hearing<br \/>\nthe petitioner, it would have been appropriate for the Settlement<br \/>\nCommission to have given a hearing to the parties and, if necessary,<br \/>\ncalled upon the petitioner to establish its case in support of its<br \/>\nprayer to grant further extension and facility of payment by<br \/>\ninstallments. The petitioner has discharged its liability when it was<br \/>\npermitted to make payment of outstanding interest by installments and<br \/>\nin these circumstances, the bonafides of the petitioner are required<br \/>\nto be accepted. The petitioner has also expressed its willingness to<br \/>\nmake payment of interest on such delayed payments and by way of<br \/>\nproposal it has placed on record a sheet containing computation of<br \/>\ninterest relatable to each of the installments paid from time to<br \/>\ntime. Though initially, on behalf of the respondents it was submitted<br \/>\nthat the rate of interest fixed by the Settlement Commission at 10%<br \/>\nmay be adopted and be continued even in relation to the delayed<br \/>\npayments,  both the parties have left it to the Court to decide the<br \/>\nappropriate rate of interest that may be applied in the facts and<br \/>\ncircumstances of the case.\n<\/p>\n<p>9. In light of what is<br \/>\nstated hereinbefore, the Court deems it appropriate that the<br \/>\npetitioner be directed to bear interest on delayed payments from time<br \/>\nto time at the rate of 6% p.a. taking into consideration the<br \/>\nprevailing market conditions and the bank rate. The Court feels that<br \/>\nin the interest of justice, rate of 6% p.a. would be fair and<br \/>\nreasonable.&#8221;\n<\/p>\n<p>2.\t\tHowever,<br \/>\nMs. Mandavia, learned counsel for the respondents requests for time<br \/>\nto take necessary instructions.
