\t Heard
\nlearned counsel for the parties for final disposal of the petition.\n<\/p>\n
\t Petitioner
\nhas imported a consignment of certain quantity of Oil. There is a
\ndisputed about the import duty to be paid on such goods. Department
\nhad classified the goods under Entry No. 15.13 attracting higher rate
\nof duty as compared to Entry No. 38.23, under which, the petitioner
\ncontends the same ought to have been classified.\n<\/p>\n
\tThe
\nOrder passed by the Adjudicating Authority was carried in appeal by
\nthe petitioner before the Appellate Authority ie., the
\nCommissioner, who by his Order dated 12th October 2010,
\nruled in favour of the petitioner, classifying the goods under CTH
\nNo. 38231900  and directed as under :-\n<\/p>\n
\t“13.\tFrom
\nthe totality of the facts, I have concluded that the impugned goods,
\nwhich is essentially composed of triglycerides of fatty acids
\nand free fatty acids (fatty material), is excluded from
\nCTH 15132910, and in fact it is entirely excluded from Chapter
\n15 of the Customs Tariff Act, 1975. From the findings above,
\npurely based on facts of the instant case, I hold that the
\nnomenclature of the impugned goods qualify as ‘semi acid oil’ and it
\nmerits classification under CTSH 38231900 CTA, 1975.\n<\/p>\n
\t14.\tIn
\naccordance with the above, I set aside the impugned order and hold
\nthat the imported goods merit classification under CTSH 38231900 as
\nsemi acid oil. The appeal is disposed off accordingly.”\n<\/p>\n
\t   Despite
\nsuch a clear order, the respondents did not release the goods of the
\npetitioner. The petitioner wrote letters to the respondents
\nrequesting that the goods be released and that further delay is
\ncausing him heavy demur rage burden. Since, despite such
\nrequests, the respondents did not take any steps, the petitioner has
\napproached this Court in the present petition praying that direction
\nbe issued to the respondent no.3 to forthwith release the
\ngoods covered under the Bill of Entry No. 665976 dated 16th
\nDecember 2009 in terms of the Order-in-Appeal dated 12th
\nOctober 2010.\n<\/p>\n
\t    In
\nresponse to the notice issued by us, learned advocate Ms. Amee Yagnik
\nappeared for the respondents. She contended that the Department has
\ncarried the issue in appeal before the Tribunal and the CESTAT is
\nceased of the matter. Alongwith the appeal, Department has also filed
\nan application for stay.\n<\/p>\n
\t   On
\n28th April 2011, we had permitted the Department to move
\nthe Tribunal for hearing of the stay application. We are informed
\nthat such application is fixed for hearing on 13th June
\n2011.\n<\/p>\n
\t  In
\nthe facts of the case, we are of the opinion that the goods of the
\npetitioner should not be allowed to be detained any longer. Firstly,
\nthe order of higher duty demand made by the respondents was set-aside
\nby the appellate authority vide its Order dated 16th
\nDecember 2010. Several months have passed since then and the goods of
\nthe petitioner are lying, incurring heavy demur rage charges.
\n On certain terms and conditions, therefore, we are of the view that
\nthe the goods of the petitioner be released; of course subject to the
\noutcome of the appeal pending before the Tribunal.\n<\/p>\n
\t    Counsel
\nfor the petitioner submitted that the petitioner had suffered heavy
\ndemur rage on account of inaction on the part of the
\nDepartment. However, we are not inclined to go into this question in
\nthe present petition, leaving it open to the petitioner to raise its
\ngrievance in an appropriate proceedings; as may be advised.\n<\/p>\n
\t   This
\npetition is, therefore, disposed of with the following directions :-\n<\/p>\n
\t[1]\tThe goods of the
\npetitioner, covered under the Bill of \t\tEntry No. 665976 dated
\n16.12.2009, shall be released \t\ton the following conditions :-\n<\/p>\n
\t\t(a)\tThat the
\npetitioner has to deposit entire customs \t\t\tduty as per the
\nclassification accepted by the \t\t\t\tappellate authority in its Order
\ndated 12th October \t\t\t2010;\n<\/p>\n
\t\t(b)\tThe petitioner
\nprovides immovable security for \t\t\tdifferential duty ie., the
\nduty already paid and \t\t\tadditional duty demanded by the Adjudicating
\n\t\t\tAuthority;\n<\/p>\n
\t\t(c)\tThis arrangement
\nwould be, of course, subject to \t\t\tthe final outcome of the
\nDepartment’s Appeal \t\t\t\twhich is pending before the Tribunal.\n<\/p>\n
\t\t[2]\tIt would be open
\nto the Department to request the \t\t\tTribunal to take up the Appeal
\nfor early hearing.\n<\/p>\n
\t\t[3]\tWe have expressed
\nno opinion on the merits of the \t\t\tclassification and leave the
\nentire issue open to be \t\t\tjudged by the Tribunal in accordance with
\nlaw.\n<\/p>\n
With the above directions, the petition is disposed of.\n<\/p>\n
