Yadav\n                                                                    ...Petitioners\n                                     Versus\n              THE STATE OF BIHAR                                        ...OP\n                                    -----------\n<\/pre>\n<p>3\/   23.03.2011                 Heard learned counsel for the petitioners and the State.<\/p>\n<p>                                The petitioners seek bail in a case instituted for the<\/p>\n<p>                    offence under sections 302 and other allied sections of the Indian<\/p>\n<p>                    Penal Code.\n<\/p>\n<p>                                It has been submitted by the counsel for the petitioners<\/p>\n<p>                    that the judgment of the present case is being held up on account of<\/p>\n<p>                    non-receipt of the lower court records from the High Court.<\/p>\n<p>                                I find that even though the court below has mentioned<\/p>\n<p>                    that the judgment is pending awaiting original case record from the<\/p>\n<p>                    Patna High Court, Patna, but the office reports that no<\/p>\n<p>                    communication has been received from the trial court calling for the<\/p>\n<p>                    said records.\n<\/p>\n<p>                                However, the Cr. Appeal Section is directed to<\/p>\n<p>                    immediately send the lower court records to the court of the<\/p>\n<p>                    Additional Sessions Judge-cum-Fast Track Court No.4, Banka, for<\/p>\n<p>                    conclusion of trial in Sessions Trial No. 400-B of 1992 so that there<\/p>\n<p>                    is no further delay in the pronouncement of the judgment.<\/p>\n<p>                                The court below shall retain Photostat copy of all the<\/p>\n<p>                    documents and send the original records to the High Court<\/p>\n<p>                    immediately they have been dealt with by the trial court so that in<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>       case there is any further abscondence of the accused, there is no<\/p>\n<p>       further delay in conclusion of trial on account of non-availability of<\/p>\n<p>       the records.\n<\/p>\n<p>                      In view of the discussions made above, I do not find it a<\/p>\n<p>       fit case for grant of bail.\n<\/p>\n<p>                      Their prayer for bail is rejected.\n<\/p>\n<\/p>\n<pre>JA\/-                                              (Anjana Prakash,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Suresh Yadav &amp;Amp; Ors vs The State Of Bihar on 23 March, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.
