SHAH\n\t\t\n\t\n\n \n\nDate\n: 12\/07\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\tBy<br \/>\nway of the present Special Criminal Application under Article 226 of<br \/>\nthe Constitution of India, petitioner has prayed for an appropriate<br \/>\nwrit, direction or order directing the respondents authority to take<br \/>\nappropriate actions in respect of the written complaint filed by the<br \/>\npetitioner dated 11.04.2011 by considering the same as complaint<br \/>\nunder the provisions of Section 154(3) of the Code of Criminal<br \/>\nProcedure, 1973 (hereinafter referred to as &#8220;CrPC&#8221;).\n<\/p>\n<p>2.\tHaving<br \/>\nheard Shri Rana, learned advocate appearing on behalf of the<br \/>\npetitioner and Shri K.P. Raval, learned Additional Public Prosecutor<br \/>\nappearing on behalf of respondent State, it appears that the main<br \/>\ngrievance of the petitioner is non-registration of his complaint<br \/>\ndated 11.04.2011 as FIR under Section 154 of the CrPC and not<br \/>\ninvestigating the same by the concerned respondent police<br \/>\nauthorities.  As observed by the Hon&#8217;ble Supreme Court in the case of<br \/>\n<a href=\"\/doc\/325716\/\">Aleque Padamsee vs. Union of India<\/a> reported<br \/>\nin (2006)7 SCC 171 as<br \/>\nwell as in the case of <a href=\"\/doc\/1456561\/\">Gangadhar Janardan Mhatre vs. State<br \/>\nof Maharashtra and Ors.<\/a> reported<br \/>\nin (2004)7 SCC 768 as<br \/>\nwell as decision of this Court in the case of <a href=\"\/doc\/1826647\/\">Kanubhai<br \/>\nShamjibhai Dayani &amp; Anr. vs. State of Gujarat &amp; Ors.<\/a> reported<br \/>\nin 2007(3) GLR 2684,<br \/>\nin case of non-registration of the complaint by the concerned police<br \/>\nofficers as FIR, a petition under Article 226 is not required to be<br \/>\nentertained, as the aggrieved party has a remedy by way of filing a<br \/>\nprivate complaint under Section 190 of the CrPC.  Hence, the present<br \/>\npetition is not entertained.
