(J)\n\nCITATION:\n 1996 AIR  136\t\t  1995 SCC  (5) 577\n JT 1995 (6)   657\t  1995 SCALE  (5)176\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     Though  the  respondents  have  been  served,  none  is<br \/>\nappearing either  in person or through counsel. The admitted<br \/>\nposition  is   that  there   being  a\tdispute\t as  to\t the<br \/>\napportionment of  the compensation,  the  Collector  made  a<br \/>\nreference under\t s.30 of the Land Acquisition Act, 1894 (for<br \/>\nshort, &#8216;the  Act&#8217;) and\tthe Reference Court formed the point<br \/>\nthus :\n<\/p>\n<blockquote><p>     &#8220;Who among the claimants are entitled to<br \/>\n     receive compensation  and to what extent<br \/>\n     ?&#8221;<\/p><\/blockquote>\n<p>     The Civil\tCourt, while  apportioning the\tcompensation<br \/>\namong the  claimants, awarded  interest 9%  per annum on the<br \/>\namount of  compensation. When  it was  challenged  in  Civil<br \/>\nRevision Petition No. 1148\/87 dated March 10, 1987, the High<br \/>\nCourt confirmed\t the same following a judgment of the Andhra<br \/>\nPradesh High  Court Purushotham\t Haridas &amp;  Ors. Vs.  Amruth<br \/>\nGhee Co. Ltd., Guntur &amp; Ors. [AIR 1961 AP 143].\n<\/p>\n<p>     The questions  is whether the view of the High Court is<br \/>\ncorrect. Section  11 of\t the  Act  provides  that  the\tLand<br \/>\nAcquisition  Officer   shall  enquire  into  the  respective<br \/>\ninterests of  the persons claiming, compensation or believed<br \/>\nto have\t an interest  therein and  shall make  an award; and<br \/>\nunder clause  (iii) of\tsub-section (1)\t apportion the\tsaid<br \/>\ncompensation among  all persons\t known\tor  believed  to  be<br \/>\ninterested  in\t land  of  whom\t or  whose  claims,  he\t has<br \/>\ninformation  in\t  whether  or  not  they  have\trespectively<br \/>\nappeared before him.\n<\/p>\n<p>     Under Section  30\tof  the\t Act,  when  the  amount  of<br \/>\ncompensation has  been settled\tunder s.11,  if any  dispute<br \/>\narises as  to the  apportionment of  the same  or  any\tpart<br \/>\nthereof or  as to  the persons\tto whom the same or any part<br \/>\nthereof is  payable, the Collector may refer such dispute to<br \/>\nthe decision  of the Court. Under sub-section (2) of Section<br \/>\n31, if\tthere is  any dispute  as to  apportionment  of\t the<br \/>\ncompensation, the  Collector shall  deposit  the  amount  of<br \/>\ncompensation, in  the Court to which reference under Section<br \/>\n18 would be submitted.\n<\/p>\n<p>     Thus, if could be seen that on making award under s.11,<br \/>\nthe Collector is enjoined to make a reference under s.30, if<br \/>\nthere is  any dispute  as to  the person entitled to receive<br \/>\nthe compensation  and the  apportionment thereof.  On making<br \/>\nsuch reference, the Collector is further enjoined under s.31<br \/>\nto deposit  the amount\tof the\tcompensation in the Court to<br \/>\nwhich reference\t under s.18  would be  submitted.  In  other<br \/>\nwords, on  deposit of  the amount into the court and pending<br \/>\ndecision of the reference, the liability of the State to pay<br \/>\ninterest thereon  ceases with  effect from  the date  of the<br \/>\ndeposit. Therefore,  the Reference Court as well as the High<br \/>\nCourt committed\t an obvious  illegality in directing payment<br \/>\nof interest  at 9% on the amount from the date of deposit by<br \/>\nthe Collector till the decision of the reference court under<br \/>\ns.30.
