Devendar Bind son of Bipat Bind                  ...Petitioners\n                                          Versus\n                  The State Of Bihar                                       ...OP\n                                         -----------\n<\/pre>\n<p>2\/   08.09.2011                     Heard learned counsel for the petitioners and the State.<\/p>\n<p>                                    The petitioners seek anticipatory bail in a case instituted<\/p>\n<p>                        for the offence under sections 147, 341, 323, 353 and 379 of the<\/p>\n<p>                        Indian Penal Code.\n<\/p>\n<p>                                    Considering that the informant is said to have been<\/p>\n<p>                        assaulted with fits and slaps and the petitioners have no criminal<\/p>\n<p>                        antecedent, it is ordered that in the event of surrender of the<\/p>\n<p>                        petitioners, named above, within four weeks from the date of receipt<\/p>\n<p>                        of a copy of this order in connection with Tekari (Panchanpur) P.S.<\/p>\n<p>                        Case No.31 of 2011, they shall be released on anticipatory bail on<\/p>\n<p>                        furnishing bail bond of Rs.5,000\/-(five thousand) with two sureties<\/p>\n<p>                        of the like amount each to the satisfaction of the Chief Judicial<\/p>\n<p>                        Magistrate, Gaya, subject to conditions as laid down under section<\/p>\n<p>                        438 (2) Cr. P.C., and (i) That one of the bailors will be a close<\/p>\n<p>                        relative of the petitioners, who will give an affidavit giving<\/p>\n<p>                        genealogy as to how he is related with the petitioners. The bailors<\/p>\n<p>                        will undertake to furnish information to the court about any change<\/p>\n<p>                        in the address of the petitioners, (ii) That the affidavit shall clearly<\/p>\n<p>                        state that the petitioners are not an accused in any other case and, if<\/p>\n<p>                        they are, they shall not be released on bail and further the petitioners<\/p>\n<p>                        shall undertake to be represented on the first date after cognizance if<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>       the investigation in the case is still pending and in case they fail to<\/p>\n<p>       do so, their bail bond will be liable to be cancelled (iii) That the<\/p>\n<p>       bailors shall also state on affidavit that they will inform the court<\/p>\n<p>       concerned if the petitioners are implicated in any other case of<\/p>\n<p>       similar nature after their release in the present case and thereafter the<\/p>\n<p>       court below will be at liberty to initiate the proceeding for<\/p>\n<p>       cancellation of bail on the ground of misuse, (iv) That the petitioners<\/p>\n<p>       will give an undertaking that they will receive the police papers on<\/p>\n<p>       the given date and be present on date fixed for charge and if they fail<\/p>\n<p>       to do so on two given dates and delay the trial in any manner, their<\/p>\n<p>       bail will be liable to be cancelled for reasons of misuse and (v) That<\/p>\n<p>       the petitioners will be well represented on each date and if they fail<\/p>\n<p>       to do so on two consecutive dates, their bail will be liable to be<\/p>\n<p>       cancelled.\n<\/p>\n<\/p>\n<pre>JA\/-                                            (Anjana Prakash,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Surendra Bind &amp; Ors. vs The State Of Bihar on 8 September, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.
