The  aged about 40 years at the<\/p>\n
  and healthy, working as Coolie<\/p>\n

  came near Jogipatty, Tamilnadu State, at that<\/p>\n

V V’ our c’o_nsi._de-ration are as under:<\/p>\n
 ..  (i)z  1. Whether the liability fastened on the Insurer
\nby the Tribunal is sustainable in law?\n<\/p>\n
(ii) Whether the compensation awarded by the<\/p>\n
Tribunal is just and reasonable?<\/p>\n

Regarding Point No. 1:\n<\/p>\n
10. As rightly pointed out by the learried  M<\/p>\n
for the Insurer, it is crystal clear”fr’0m__ the,<\/p>\n
conditions of the Ex.R2~_ instiraiice  ‘ <\/p>\n
insurance risk is not coveretilvt\u00ab’:i:’I’i. respe~ct”ct” if
\nthey travel in the priyate  bytlthetylv\u00e9owner.
\nFurther, it is clear frorn 147 of the
\nAct that the pelicjyrglylof  to be taken in
\nterms of    the liability in
\nrespecttir  arising out of and
\naiso in  of every employee of<\/p>\n
the pejrson insuilvfedi hizntienthe policy. Such liability must<\/p>\n
 h0weV’erV”becQVered in respect of three classes of<\/p>\n
 thee’-insured, namely:\n<\/p>\n

 an employee engaged as a conductor of the<\/p>\n
Vehicle or for examining the tickets on the<\/p>\n
