M. SAHAI)<\/p>\n<p>1.\t\tWe<br \/>\nhave heard Mr. H. S. Munshaw, learned counsel appearing for the<br \/>\nappellant and Ms. Jirga D. Jhaveri, learned counsel appearing for the<br \/>\nrespondent.\n<\/p>\n<p>2.\t\tThis<br \/>\nIntra-Court Letters Patent Appeal has been filed challenging the<br \/>\njudgment and order dated 18.10.2002 passed by the Learned Single<br \/>\nJudge in Special Civil Application No.6433 of 2002 whereby the<br \/>\nLearned Single Judge has dismissed the said Special Civil Application<br \/>\nand confirmed the award dated 29.11.2001 passed by the Presiding<br \/>\nOfficer, Labour Court, Vadodara in Reference (LCV) No.697 of 1999<br \/>\nwhereby the Labour Court directed the appellant to reinstate the<br \/>\nrespondent in service with continuity and full back wages.\n<\/p>\n<p>3.\t\tLearned<br \/>\ncounsel for the appellant has urged that the Learned Single Judge<br \/>\ninquired from the appellant that how many regular posts are available<br \/>\nwith the appellant Panchayat so that regular employees could be<br \/>\nappointed on these posts.  In response to this, learned counsel for<br \/>\nthe appellant has informed the Court that from 23.01.1998, regular<br \/>\nvacancies of Class IV were filled in.  However, as the respondent was<br \/>\nappointed for a short period and even if he has worked for 240 days<br \/>\nin a last preceding one year, he would not be entitled for<br \/>\nregularization of his services as the daily wager has no right of<br \/>\ncontinuity and is not entitled to the benefits of Section 25-F of the<br \/>\nIndustrial Disputes Act, 1947.  He further urged that the case of the<br \/>\nrespondent was squarely covered under the provisions of Section 2<br \/>\n(oo) (bb) of the Industrial Disputes Act, 1947.  According to the<br \/>\nlearned counsel for the appellant, though the said contention was<br \/>\nadvanced before the Learned Single Judge, the said contention was not<br \/>\ndealt with by the Learned Single Judge.\n<\/p>\n<p>4.\t\tWhile<br \/>\nperusing the judgment of the Learned Single Judge, we find that the<br \/>\nsaid argument of the appellant has not been considered by the Learned<br \/>\nSingle Judge.  Therefore, the impugned judgment and order passed by<br \/>\nthe Learned Single Judge cannot be maintained.  In the result, this<br \/>\nappeal succeeds and is allowed.  The impugned judgment and order<br \/>\ndated 18.10.2002 passed by the Learned Single Judge in Special Civil<br \/>\nApplication No.6433 of 2002 is set aside and the writ petition is<br \/>\nremanded back to the Learned Single Judge for deciding the matter<br \/>\nafresh after hearing learned counsel for the parties expeditiously,<br \/>\nsubject to His Lordship&#8217;s convenience.
