This  petition  impugns  the order  dated  01.10.2007<br \/>\n       (Annexure P\/1 and P\/2) on the ground that no reasonable<br \/>\n       opportunity of hearing was afforded to the petitioner. Shri<br \/>\n       Awasthy, learned senior counsel appearing for the petitioner<br \/>\n       submits that if he takes recourse to statutory remedy<br \/>\n       available under the law, it is not efficacious.\n<\/p>\n<p>  2.   The Chhattisgarh Land Revenue Code, 1959 (hereinafter<br \/>\n       referred to as `the Code, 1959&#8242;) is a self contained. It<br \/>\n       provides for grant of relief and other remedies. The Code,<br \/>\n       1959 further provides for appeal and appellate authorities<br \/>\n       in Chapter V, section 44. This is a case where in normal<br \/>\n       course, an appeal is maintainable before the Sub Divisional<br \/>\n       Officer against the order of the Tahsildar, then to the<br \/>\n       Collector and then to the Board of Revenue.\n<\/p>\n<p>  3.   Shri  Awasthy further submits that alternative remedy<br \/>\n       available  to the petitioner is not efficacious.  The<br \/>\n       contention of learned counsel that the remedy is  not<br \/>\n       efficacious does not merits acceptance as the statutory<br \/>\n       remedy is provided in the court below as more effective and<br \/>\n       efficacious remedy then the writ petitions in the High Court<br \/>\n       wherein cases of all the nature are pending consideration.\n<\/p>\n<p>  4.   On the question of availability of alternative remedy,<br \/>\n       the Hon&#8217;ble Supreme Court in the matter of <a href=\"\/doc\/674013\/\">State of H.P. and<br \/>\n       others v. Gujrat Ambuja Cement and<\/a> another1 observed as<br \/>\n       under:\n<\/p>\n<blockquote><p>           &#8220;17.  We  shall first deal with  the  plea<br \/>\n           regarding alternative remedy as raised  by<br \/>\n           the  appellant State. Except for a  period<br \/>\n           when  Article  226  was  amended  by   the<br \/>\n           Constitution (Forty-second Amendment) Act,<br \/>\n           1976,  the  power relating to  alternative<br \/>\n           remedy  has been considered to be  a  rule<br \/>\n           of    self-imposed   limitation.   It   is<br \/>\n           essentially  a rule of policy, convenience<br \/>\n           and  discretion and never a rule  of  law.<br \/>\n           Despite   the   existence  of  alternative<br \/>\n           remedy,  it is within the jurisdiction  of<br \/>\n           description  of  the High Court  to  grant<br \/>\n           relief   under   Article   226   of    the<br \/>\n           Constitution. At the same time, it  cannot<br \/>\n           be  lost  sight of that though the  matter<br \/>\n           relating  to  an  alternative  remedy  has<br \/>\n           nothing to do with the jurisdiction of the<br \/>\n           case,  normally the High Court should  not<br \/>\n           interfere   if   there  is   an   adequate<br \/>\n           efficacious   alternative    remedy.    If<br \/>\n           somebody approaches the High Court without<br \/>\n           availing  the alternative remedy  provided<br \/>\n           the  High Court should not ensure that  he<br \/>\n           has  made out a strong case or that  there<br \/>\n           exists   good   grounds  to   invoke   the<br \/>\n           extraordinary jurisdiction.\n<\/p><\/blockquote>\n<blockquote><p>           21.  <a href=\"\/doc\/808713\/\">In G.Verappa Pillai v. Raman &amp;  Raman<br \/>\n           Ltd.,  CCE<\/a> v. <a href=\"\/doc\/1254697\/\">Dunlop India Ltd.,  Ramendra<br \/>\n           Kishore  Biswas v. State of Tripura,  Shiv<br \/>\n           Gonda  Anna Patil<\/a> v. <a href=\"\/doc\/1156598\/\">State of Maharashtra,<br \/>\n           C.A.  Abraham  v.  I.T.O,  Titaghur  Paper<br \/>\n           Mills   Co.  Ltd.<\/a>  v.  <a href=\"\/doc\/1219535\/\">State  of   Orissa,<br \/>\n           H.B.Gandhi  v. Gopinath &amp; Sons,  Whirlpool<br \/>\n           Corpn.  V.  Registrar of  Trademarks,  Tin<br \/>\n           Plate Co. of India Ltd.<\/a> v. <a href=\"\/doc\/1060913\/\">State of Bihar,<br \/>\n           Sheela  Devi v. Jaspal Singh,  and  Punjab<br \/>\n           National Bank<\/a> v. O.C.Krishnan, this  Court<br \/>\n           had  held that where hierarchy of  appeals<br \/>\n           is  provided  by the statute,  party  must<br \/>\n           exhaust   the   statutory  remedy   before<br \/>\n           resorting to writ jurisdiction.&#8221;\n<\/p><\/blockquote>\n<p>  5.   Further applying the said ratio in the matter of U.P.\n<\/p>\n<p>       State Spinning Co. Ltd. v. R.S.Pandey and another2, the<br \/>\n       Hon&#8217;ble Supreme Court observed as under:\n<\/p>\n<blockquote><p>           &#8220;21.  <a href=\"\/doc\/1452602\/\">In  U.P.State Bridge Corpn. Ltd.  v.<br \/>\n           U.P. Rajya Setu Nigam S. Karmachari Sangh,<\/a><br \/>\n           it  was held that when the dispute relates<br \/>\n           to  enforcement of a right  or  obligation<br \/>\n           under the statute and specific remedy  is,<br \/>\n           therefore, provided under the statute, the<br \/>\n           High  Court  should not deviate  from  the<br \/>\n           general  view and interfere under  Article<br \/>\n           226 except when a very strong case is made<br \/>\n           out for making a departure. The person who<br \/>\n           insists upon such remedy can avail of  the<br \/>\n           process as provided under the statute.  To<br \/>\n           the  same  effect  or  the  decisions   in<br \/>\n           <a href=\"\/doc\/321104\/\">Premier   Automobiles  Ltd.  v.   Kamlekar<br \/>\n           Shantaram Wadke, Rajasthan SRTC<\/a> v. <a href=\"\/doc\/677526\/\">Krishna<br \/>\n           Kant,   Chandrakant   Tukaram   Nikam   v.<br \/>\n           Municipal  Corpn.  Of  Ahmedabad  and<\/a>   in<br \/>\n           <a href=\"\/doc\/1365916\/\">Scooters India v. Vijai E. V. Eldred.<\/a>&#8221;\n<\/p><\/blockquote>\n<p>  6.   In   another  latest  decision  on  the  concept   of<br \/>\n       maintainability of writ petition vis&#8211;vis availability of<br \/>\n       alternative remedy, the Supreme Court in the matter of<br \/>\n       Secy., U.P.High School &amp; Intermediate Education, Allahabad &amp;<br \/>\n       another v. H.K.Lal3, observed as under:\n<\/p>\n<blockquote><p>           &#8220;4.  From the records it is borne out that<br \/>\n           the  question as to whether the respondent<br \/>\n           has  a  legal right to alter his  date  of<br \/>\n           birth  recorded in the certificate granted<br \/>\n           by  the  Board  was pending  consideration<br \/>\n           before  the  appellate  Court.  The   writ<br \/>\n           petition  filed by the respondent  should,<br \/>\n           therefore,   not  have  been   entertained<br \/>\n           particularly in view of the fact that  the<br \/>\n           appeal  thereagainst  was  pending.   Writ<br \/>\n           jurisdiction is discretionary jurisdiction<br \/>\n           and should not ordinarily be exercised  if<br \/>\n           there is an alternative remedy.&#8221;\n<\/p><\/blockquote>\n<p>  7.   This Court, in the matter of <a href=\"\/doc\/44479\/\">Chandrika Prasad Sahu  &amp;<br \/>\n       Others v. State of Chhattisgarh &amp; Others,<\/a> in W.P.(S) No.<br \/>\n       4597 of 2008, vide order dated observed as under:\n<\/p>\n<blockquote><p>           &#8220;9. A common thread running into the dicta<br \/>\n           laid down by the Hon&#8217;ble Supreme Court  in<br \/>\n           the  aforementioned cases is that normally<br \/>\n           the  High  Court should not  interfere  if<br \/>\n           there    is    an   adequate   efficacious<br \/>\n           alternative   remedy  where  hierarch   of<br \/>\n           appeals is provided by the statute,  party<br \/>\n           must  exhaust the statutory remedy  before<br \/>\n           resorting to the writ jurisdiction, except<br \/>\n           when  a  very strong case is made out  for<br \/>\n           making a departure.&#8221;\n<\/p><\/blockquote>\n<p>  8.   Applying  the well-settled principles of law  on  the<br \/>\n       issue of availability of alternative remedy to the facts of<br \/>\n       the case, this petition is dismissed as not maintainable as<br \/>\n       no  strong  case  has been made out for  exercise  of<br \/>\n       extraordinary discretionary jurisdiction in favour of the<br \/>\n       petitioner.
