Justice V.RAMKUMAR\n\n Dated :22\/07\/2010\n\n O R D E R\n                      V.RAMKUMAR, J.\n                -------------------------------------\n    W.P(C) Nos. 13813, 13922 and 14299 of 2010\n               --------------------------------------\n           Dated this the 22nd day of July, 2010\n\n                       J U D G M E N T\n<\/pre>\n<p>      Petitioners, are licensees of toddy shops.       They are<\/p>\n<p>accused in three different crimes. The petitioners in W.P(C)<\/p>\n<p>No.14299\/2010 are the salesman and licensee respectively of<\/p>\n<p>Group No.IV of Kottarakkara Excise Range. The crime which<\/p>\n<p>is registered against the petitioners is CR.No.39\/2010 of<\/p>\n<p>Kottarakara Excise Range of the 4th respondent for offences<\/p>\n<p>punishable under Sections 57(a) and 56(b) of the Abkari Act.<\/p>\n<p>The case of the prosecution is that the toddy seized from one<\/p>\n<p>of the toddy shops was adulterated. The samples drawn from<\/p>\n<p>the toddy seized have been forwarded to the chemical<\/p>\n<p>examiner for analysis to find out the percentage of ethyl<\/p>\n<p>alcohol in those samples. Reports are awaited.<\/p>\n<p>      2.    The petitioner in W.P(C) No.13813\/2010 is a<\/p>\n<p>licensee of Group No.III of Sasthamcotta Excise Range in<\/p>\n<p>Kollam Range. The occurrence took place on 22.4.2010 at 9.55<\/p>\n<p>AM, when the 1st respondent and his excise parties inspected<\/p>\n<p>toddy shop No.7 included in the said group and seized 58.8<\/p>\n<p>liters of toddy suspected to be mixed with spirit. This resulted<\/p>\n<p>W.P(C) Nos. 13813, 13922 and 14299 of 2010<br \/>\n<span class=\"hidden_text\">                                   : 2 :<\/span><\/p>\n<p>in CR.No.59\/2010 for offences punishable under Sections 57<\/p>\n<p>(a) and 56(b) of the Abkari Act. The samples drawn from the<\/p>\n<p>bulk quantity have been forwarded to the chemical examiner<\/p>\n<p>for analysis and the certificates of analysis are yet to be<\/p>\n<p>received by the committal Magistrate.\n<\/p>\n<p>     3.     The petitioner in W.P(C) No.13922\/2010 is the<\/p>\n<p>licensee of toddy shop in Group No.IV of Adoor Excise Range.<\/p>\n<p>On 15.4.2010 the 4th respondent seized 715 liters of toddy<\/p>\n<p>allegedly mixed with spirit from a pick up van bearing<\/p>\n<p>Registration       No.KL-26-4222         and registered   Crime<\/p>\n<p>CR.No.466\/2010 for an offence punishable under Section 57<\/p>\n<p>(A) of the Abkari Act. The samples drawn from the bulk<\/p>\n<p>quantity have been forwarded to the chemical examiner for<\/p>\n<p>analysis. The results are awaited.\n<\/p>\n<p>     4.     The request of the petitioners is to quash the above<\/p>\n<p>crimes and occurrence reports and all further proceedings in<\/p>\n<p>the above cases. The said request cannot be acceded to at this<\/p>\n<p>stage of the proceedings. As and when the reports of the<\/p>\n<p>chemical analysis are received before the Magistrate<\/p>\n<p>concerned, the Officer-in-Charge of the investigation of the<\/p>\n<p>W.P(C) Nos. 13813, 13922 and 14299 of 2010<br \/>\n<span class=\"hidden_text\">                                   : 3 :<\/span><\/p>\n<p>above crimes shall complete the investigation and file a final<\/p>\n<p>report before the Magistrate expeditiously and in accordance<\/p>\n<p>with the result of the chemical analysis.            In case the<\/p>\n<p>petitioners are charge sheeted by the investigating officer<\/p>\n<p>concerned, the petitioners can assail the same in appropriate<\/p>\n<p>proceedings if grounds exist to do so.
