Heard    Shri    Dewendra       Narayan    Singh,<\/p>\n<p>                   learned counsel for the petitioner and Shri<\/p>\n<p>                   Umesh    Lal    Verma,       learned   Additional       Public<\/p>\n<p>                   Prosecutor.\n<\/p>\n<p>                                The petitioner, who is in custody in<\/p>\n<p>                   Awatar Nagar P.S. Case No.9 of 2009 for the<\/p>\n<p>                   offence under Sections 498A, 304B\/34 of the<\/p>\n<p>                   Indian Penal Code, has prayed for grant of<\/p>\n<p>                   bail.\n<\/p>\n<p>                                It was submitted by learned counsel<\/p>\n<p>                   for    the    petitioner       that    daughter-in-law        of<\/p>\n<p>                   the    petitioner      received       burn    injury,    while<\/p>\n<p>                   she    was    cooking     food.    Thereafter,         she   was<\/p>\n<p>                   carried to hospital where the informant also<\/p>\n<p>                   arrived.       However,      the   injured     died     on   the<\/p>\n<p>                   same    day    i.e.    22.2.2008.      Subsequently,         she<\/p>\n<p>                   was cremated in presence of the informant of<\/p>\n<p>                   the present case. Initially, U.D. case was<\/p>\n<p>                   got registered. However, after lapse of more<\/p>\n<p>                   than seven days, a complaint vide Complaint<\/p>\n<p>                   Case No.585 of 2008 was filed in the court of<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>Chief Judicial Magistrate, Chapra, Saran with<\/p>\n<p>a concocted story that due to non fulfillment<\/p>\n<p>of demand of dowry, daughter of informant was<\/p>\n<p>put     on    fire           and     she    died.        The    learned<\/p>\n<p>Magistrate,             after        filing        the     complaint,<\/p>\n<p>transferred the same to the police for its<\/p>\n<p>registration and investigation under Section<\/p>\n<p>156(3)       of    the       Code     of    Criminal       Procedure.<\/p>\n<p>After lapse of almost 11 months, the present<\/p>\n<p>F.I.R. vide Awatar Nagar P.S. Case No.9 of<\/p>\n<p>2009    was       registered          for    the    offence          under<\/p>\n<p>Sections 498, 304B and 34 of the Indian Penal<\/p>\n<p>Code.    Learned             counsel        for    the     petitioner<\/p>\n<p>submits that vide Annexure-2 to the petition,<\/p>\n<p>husband of the petitioner, who was father-in-<\/p>\n<p>law     of        the        deceased,       was     extended          the<\/p>\n<p>privilege          of        anticipatory          bail.        It     was<\/p>\n<p>submitted that petitioner is in custody since<\/p>\n<p>28.6.2010 and she is an old lady aged about<\/p>\n<p>70 years.\n<\/p>\n<p>             Learned Additional Public Prosecutor<\/p>\n<p>has opposed the prayer for bail.<\/p>\n<p>             In    view       of     the    fact    that       even   the<\/p>\n<p>complaint          was       filed    at     delayed       stage      and<\/p>\n<p>thereafter, expiry of about 11 months, F.I.R.<\/p>\n<p>was lodged, the court is of the opinion that<br \/>\n<span class=\"hidden_text\">                        3<\/span><\/p>\n<p>        the petitioner deserves to be extended the<\/p>\n<p>        privilege of bail.\n<\/p>\n<p>                Let   the   petitioner    above   named   be<\/p>\n<p>        enlarged on bail on his furnishing bond of<\/p>\n<p>        Rs.10,000\/- (ten thousand) with two sureties<\/p>\n<p>        of the like amount each to the satisfaction<\/p>\n<p>        of C.J.M., Saran at Chapra in Awatar Nagar<\/p>\n<p>        P.S.
