SHAH\n\t\t\n\t\n\n \n\nDate\n: 25\/08\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Articles 226 and 227 of the Constitution<br \/>\nof India, petitioner has prayed for appropriate writ, direction or<br \/>\norder quashing and setting aside the impugned order dated 07.07.2003<br \/>\npassed by the District Civil Supply Officer, Valsad (Annexure A) and<br \/>\nthe order dated 07.10.2003 passed by respondent No.2, Collector,<br \/>\nValsad in Appeal No.10\/2003 as well as the impugned order dated<br \/>\n02.01.2006 passed by the Revisional Authority in Revision Application<br \/>\nNo.101\/2003 and the order dated 05.05.2010 passed in Revision<br \/>\nApplication No.19\/2010 passed by the Secretary, Food and Civil<br \/>\nSupplies Department, State of Gujarat by which the license in favour<br \/>\nof the petitioner to run Fair Price Shop has been cancelled.\n<\/p>\n<p>2.\tPetitioner<br \/>\nwas granted a license to run Fair Price Shop at Vapi, Taluka Pardi,<br \/>\nDistrict Valsad.  That on the basis of the surprise checking by the<br \/>\nDistrict Supply Officer, Valsad on 08.04.2003, 09.05.2003, 09.04.2003<br \/>\nand 10.05.2003, various irregularities were found in supply of<br \/>\nkerosene and it was found that 180 liters of kerosene was sold<br \/>\nwithout any entry in the 46 cards and duplicate bills were issued<br \/>\nwith respect to total 526 liters of kerosene and the same was sold<br \/>\nfor which there were no entries in the ration cards.  That after<br \/>\ngiving an opportunity to the petitioner, by order dated 07.07.2003,<br \/>\nthe District Supply Officer, Valsad passed the order to cancel the<br \/>\nlicense of the petitioner to run the Fair Price Shop.  That being<br \/>\naggrieved and dissatisfied with the order passed by the District<br \/>\nSupply Officer, Valsad dated 07.07.2003, petitioner preferred Appeal<br \/>\nbefore the Collector, Valsad which came to be dismissed by the<br \/>\nCollector, Valsad by order dated 07.10.2003.  Being aggrieved and<br \/>\ndissatisfied with the aforesaid two orders, petitioner approached the<br \/>\nState Government   Revisional Authority by filing Revision<br \/>\nApplication No.101\/2003 and the same came to be dismissed by the<br \/>\nState Government by order dated 02.01.2006.  It appears that against<br \/>\nthe aforesaid orders, petitioner preferred Special Civil Application<br \/>\nNo.21933\/2006 and the learned advocate appearing on behalf of the<br \/>\npetitioner withdrew the same with a view to make representation to<br \/>\nthe State Government. That thereafter petitioner approached the State<br \/>\nGovernment again which was numbered as Revision Application<br \/>\nNo.19\/2010, which has been dismissed by the impugned order passed by<br \/>\nthe State Government.  Being aggrieved and dissatisfied with the<br \/>\naforesaid orders in cancelling the license in favour of the<br \/>\npetitioner to run Fair Price Shop, petitioner has preferred the<br \/>\npresent Special Civil Application under Articles 226 and 227 of the<br \/>\nConstitution of India.\n<\/p>\n<p>3.\tShri<br \/>\nPatel, learned advocate appearing on behalf of the petitioner has<br \/>\nvehemently submitted that the order passed by the District Supply<br \/>\nOfficer, confirmed by the Appellate and Revisional Authorities, is in<br \/>\nbreach of principles of natural justice and there was no material<br \/>\nbefore the District Supply Officer with respect to the alleged<br \/>\nirregularity committed by the petitioner. It is submitted that the<br \/>\nstatements of ration card holders were not recorded and if recorded,<br \/>\nthe same are not given to the petitioner.  Therefore, it is requested<br \/>\nto admit\/allow the present petition.  No other submissions have been<br \/>\nmade.\n<\/p>\n<p>4.\tHaving<br \/>\nheard Shri Patel, learned advocate appearing on behalf of the<br \/>\npetitioner and considering the impugned orders, it appears that the<br \/>\nallegation of irregularity in supply\/sale of kerosene against the<br \/>\npetitioner  has been proved.  The finding given by the District<br \/>\nSupply Officer is based upon verification of various records<br \/>\nmaintained by the petitioner and as the charge against the petitioner<br \/>\nwith respect to irregularity in sale of kerosene without making<br \/>\nnecessary entries in the ration card and preparation of duplicate and<br \/>\nfalse bills have been proved it cannot be said that authority has<br \/>\nerred in cancelling the license in favour of the petitioner to run<br \/>\nFair Price Shop, which calls for interference of this Court in<br \/>\nexercise of powers under Articles 226 and 227 of the Constitution of<br \/>\nIndia.
