Mr.R.Janakiramualu\n\t\t     Special Government Pleader\n\t\n\t\t\t\t\t  * * * *\t\n\n:ORDER\n<\/pre>\n<p>\tThis writ petition has been filed to call for the records of the 2nd<br \/>\nrespondent dated 16.09.2008 in Na.Ka.No.B1\/2691\/2008 and quash the same.\n<\/p>\n<p>\t2. Heard the learned counsel for the petitioner and also<br \/>\nMr.R.Janakiramulu, learned Special Government Pleader, appearing for the<br \/>\nrespondents.\n<\/p>\n<p>\t3. The facts giving rise to the filing of this writ petition as stood<br \/>\nexposited from the averments in the affidavit accompanying the writ petition as<br \/>\nwell as from the submissions made by the learned counsel for the petitioner, is<br \/>\nto the effect that the impugned order of suspension was passed without adhering<br \/>\nto the principles of natural justice; the order is cryptic and it is not<br \/>\nreferred to any of the grounds set out by the petitioner in defence to the show<br \/>\ncause notice and accordingly it is liable to be quashed.\n<\/p>\n<p>\t4. The learned counsel for the petitioner would develop his arguments to<br \/>\nthe effect that in the anticipatory bail order granted by the learned Sessions<br \/>\nJudge, Madurai dated 06.08.2008 in Cr.M.P.No.2655 of 2008, there is a reference<br \/>\nto the point that the offending vehicle was found parked near the premises of<br \/>\nthe petitioner and not inside the premises and on that ground alone anticipatory<br \/>\nbail was granted; however in the show cause notice, it is found set out that the<br \/>\nvehicle as though was found inside the premises of the petitioner and that such<br \/>\na vehicle was allowed to enter without being stopped by the watchman or others<br \/>\nto the rice -mill; absolutely there is no incriminating evidence found out as<br \/>\nagainst the petitioner; without supply of paddy to the petitioner for hulling,<br \/>\nhis workers are suffering and the petitioner is also suffering.\n<\/p>\n<p>\t5. The learned Special Government Pleader by placing reliance on the<br \/>\ngrounds of the counter, would develop his arguments that there are incriminating<br \/>\ncircumstances and the police also collected Expert&#8217;s opinion to the effect that<br \/>\nthe rice transported illegally, was PDS rice; the vehicle was seized from the<br \/>\npremises of the petitioner and not outside his premises.  Accordingly, he prayed<br \/>\nfor the dismissal of the writ petition.\n<\/p>\n<p>\t6. At this jucnture, I would like to point out that on earlier occasion,<br \/>\nthis Court directed the Investigating Officer concerned to be present with C.D.<br \/>\nfile so as to find out as to how far incriminating circumstances have been<br \/>\ngathered by the police as against the petitioner.  But, today no one appeared.<br \/>\nHowever, the learned Special Government Pleader would produce the copy of the<br \/>\nFirst Information Report along with the analyst Report, which would show that<br \/>\nthe rice seized from the said vehicle was PDS rice.\n<\/p>\n<p>\t7. The pertinent point that arises for consideration is as to whether the<br \/>\nimpugned order was passed after considering the objections raised by the<br \/>\npetitioner. I could see considerable force in the submissions made by the learned<br \/>\ncounsel for the petitioner that in the impugned order, the District Collector&#8217;s<br \/>\nletter, the show cause notice given by the authority and the reply given by the<br \/>\npetitioner are referred to.  In the body of the letter simply the Collector&#8217;s<br \/>\nrequest alone is found set out and it smacks of the impression as though the<br \/>\nimpugned authority was carried away by the request of the Collector and he had<br \/>\nnot taken into account the objections and pleas set out by the petitioner in his<br \/>\nexplanation to the show cause notice.\n<\/p>\n<p>\t9. At this juncture, I would like to point out that the principles of<br \/>\nnatural justice warrants that once in response to the show cause notice,<br \/>\nexplanations are given, the authority concerned should give reasons either for<br \/>\naccepting or for rejecting the reasons furnished by the petitioner.  But, in<br \/>\nthis case,  there is no iota or shred of evidence to show that the authority<br \/>\nconsidered those aspects.  Hence, in these circumstances, I am of the view that<br \/>\nthe authority should be directed to reconsider the order passed by him after<br \/>\ngiving due opportunity of being heard to the petitioner within a period of one<br \/>\nweek from the date of receipt of a copy of this order.\n<\/p>\n<p>\t10. The learned counsel for the petitioner would also highlight that<br \/>\nalready the petitioner suffered four months suspension and in such a case<br \/>\nprolongation of suspension would be prejudiced to him.  Hence, the authority is<br \/>\ndirected to consider all these aspects and pass a reasoned order.\n<\/p>\n<p>\t11. With the above said observations and directions, this Writ Petition is<br \/>\ndisposed of.  No costs.
