SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 05\/08\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>RULE.\n<\/p>\n<p>\tMr.L.R. Pathan, learned<br \/>\n\tadvocate waives the service of notice of rule  on behalf of the<br \/>\n\trespondents.\n<\/p>\n<p>\tIn<br \/>\n\tthe facts and circumstances of the case and with the consent of the<br \/>\n\tlearned advocates appearing on behalf of the respective parties,<br \/>\n\tpresent petition is taken up for final hearing today.\n<\/p>\n<p>\tBy<br \/>\n\tway of this petition under Article 226 of the Constitution of India,<br \/>\n\tthe petitioners have prayed for appropriate writ, order and\/or<br \/>\n\tdirection quashing and setting aside the impugned notices<br \/>\n\tdtd.19\/4\/2010 issued by the respondent No.1 to the petitioners, by<br \/>\n\twhich the petitioners   are directed to remove the encroachment,<br \/>\n\twhich is on the land in question.\n<\/p>\n<p>\tHaving<br \/>\n\theard the learned advocates appearing on behalf of the respective<br \/>\n\tparties it appears that it is the case on behalf of the respondents<br \/>\n\tand so submitted by Mr.L.R. Pathan, learned advocate appearing on<br \/>\n\tbehalf of the respondents, that as there is breach of condition of<br \/>\n\tagreement executed between the petitioners   and the Nagar Palika<br \/>\n\tpursuant to the allotment of the space for putting up the Cains, the<br \/>\n\timpugned decision is taken. However, considering the impugned<br \/>\n\tnotices, it appears that the impugned notices are not  issued on the<br \/>\n\taforesaid ground.  If the respondents are of the opinion that there<br \/>\n\tis  a   breach of condition of agreement executed between the<br \/>\n\tpetitioners   and the Nagar Palika pursuant to the allotment of the<br \/>\n\tspace for putting up the Cains, in that case, the petitioners   are<br \/>\n\trequired to be given show cause notice before taking any action on<br \/>\n\tthe aforesaid ground and they are required to be heard on the<br \/>\n\taforesaid ground.\n<\/p>\n<p>Under<br \/>\n\tthe circumstances, without expressing any opinion on merits with<br \/>\n\trespect to the breach alleged to have been committed  by the<br \/>\n\tpetitioners and without expressing any opinion on merits in favour<br \/>\n\tof either parties, present Special Civil Application is disposed of<br \/>\n\tby quashing and setting aside the impugned  notices dtd.19\/4\/2010<br \/>\n\treserving liberty in favour of the respondents  to initiate<br \/>\n\tappropriate proceedings by issuing show cause notice to the<br \/>\n\tpetitioners<br \/>\n\t for the  breach<br \/>\n\tof condition of agreement executed between the petitioners   and the<br \/>\n\tNagar Palika pursuant to the allotment of the space for putting up<br \/>\n\tthe Cains, as alleged by the respondents and take appropriate<br \/>\n\tdecision  in accordance with law and ion merits, after giving an<br \/>\n\topportunity of being heard to the petitioners   and considering the<br \/>\n\treply of the petitioners   to the show cause notice that may be<br \/>\n\tissued by the respondents.\n<\/p>\n<p>With<br \/>\n\tthese present Special Civil Application is disposed<br \/>\n\tof.
