No.16110 of 2010\n                                   BINDESHWAR SAH\n                                           Versus\n                                 THE STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>3\/   21.07.2010             Heard learned counsel for the petitioner and<\/p>\n<p>                  learned counsel for the State.\n<\/p>\n<p>                            Admittedly something happened in the case.<\/p>\n<p>                  According to the petitioner, children were quarrelling<\/p>\n<p>                  in which other family members also joined and<\/p>\n<p>                  received injuries. By filing complaint, allegation is<\/p>\n<p>                  levelled against the petitioner&#8217;s family members and<\/p>\n<p>                  specifically, he has been alleged for blowing garasa on<\/p>\n<p>                  the head of the informant. Injury Report is there<\/p>\n<p>                  showing the injury grievous which is doubted on the<\/p>\n<p>                  ground that the same is obtained from Navinagar<\/p>\n<p>                  Primary Health Centre where informant was never<\/p>\n<p>                  treated, for that averment made in the complaint<\/p>\n<p>                  petition is taken that this informant went to Police<\/p>\n<p>                  Station fromwhere he was referred to Aurangabad but<\/p>\n<p>                  investigation goes to show that informant was treated<\/p>\n<p>                  at Varanasi. Prior to that if he was treated at<\/p>\n<p>                  Aurangabad, it was in knowledge of the Hospital.<\/p>\n<p>                  Earlier to that what happened was not known to<\/p>\n<p>                  Varanasi Hospital.\n<\/p>\n<p>                            Both the parties belong to Navinagar Police<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>        Station where Primary Health Center      is also there.<\/p>\n<p>        Informant was in need of getting better treatment up<\/p>\n<p>        to Varanasi is beyond imagination that immediately he<\/p>\n<p>        should not have gone for primary aid. Only missing of<\/p>\n<p>        averment may never help this petitioner rather there is<\/p>\n<p>        clear allegation about blowing garasa on the head.<\/p>\n<p>        Injury Report is relevant only for nature of injury<\/p>\n<p>        otherwise there was injury on head is clear that<\/p>\n<p>        petitioner had gone to Varanasi for treatment and not<\/p>\n<p>        only approached rather admitted there for days.
