Agarwal, J.     <\/p>\n<p> 1. This petition under Section 482 Cr.P.C. is<br \/>\ndirected against order 28th June, 2001 passed by Sh. A.K.<br \/>\nSarpal, Metropolitan Magistrate, Delhi dismissing the<br \/>\napplication of the petitioner under Section 205 Cr.P.C.<br \/>\nseeking exemption from personal appearance during the<br \/>\ntrial.\n<\/p>\n<p> 2. Facts in brief are that respondent No.2 filed a<br \/>\ncomplaint under Section 138 of Negotiable Instruments Act<br \/>\n(for short &#8216;N.I.Act&#8217;) against the petitioner alleging that<br \/>\npetitioner had issued a cheque for a sum of Rs. 70,000\/-<br \/>\ndrawn on UCO Bank, Noida (UP) in his favor. The said<br \/>\ncheque, on presentation, was dishonoured with the remarks<br \/>\n&#8216;refer to drawer&#8217; due to funds not being sufficient in the<br \/>\naccount of the petitioner. The petitioner did not make<br \/>\nthe payment of the cheque amount even after the legal<br \/>\nnotice. By order dated 18th September, 1995, trial court<br \/>\ntook cognizance and summons were issued for appearance of<br \/>\nthe petitioner to face the trial. In compliance of the<br \/>\nsummons, petitioner appeared before the trial court and<br \/>\nwas admitted on bail. Thereafter, she was served with a<br \/>\nnotice under Section 251 Cr.P.C. to which she pleaded not<br \/>\nguilty and claimed trial. The matter was then adjourned<br \/>\nfor evidence of the complainant. The petitioner moved an<br \/>\napplication seeking exemption from personal appearance<br \/>\nduring the trial. The trial court vide order dated 30th<br \/>\nMay, 2000 dismissed the application. Aggrieved by the<br \/>\nsaid order, petitioner moved a petition under Section 482<br \/>\nCr.P.C. before this Court seeking directions to the trial<br \/>\ncourt to dispense with appearance of the petitioner in the<br \/>\nsaid case. Hon&#8217;ble Mr. Justice R.C. Chopra vide order<br \/>\ndated 18th April, 2001 passed in Crl. M.(M) No. 4668\/2000<br \/>\ndirected the petitioner to move a fresh application for<br \/>\nexemption before the trial court and directed the trial<br \/>\ncourt to decide the application in accordance with law<br \/>\nlaid down in    Geeta Sethi v. State,   Crl. M.(M). No. 4685\/2000<br \/>\ndecided on 12th March, 2000 and    S.Nihal Singh and others<br \/>\nv. Arjan Das,   1985 Crl. L. J. 467. Thereafter, the<br \/>\npetitioner again moved an application for exemption<br \/>\nstating therein that she is a permanent resident of<br \/>\nBombay; she has a small baby to take care of; she has to<br \/>\nface difficulties in traveling from bombay to Delhi on<br \/>\nall dates of hearing; the question of identity is not<br \/>\ninvolved in the trial and she undertook to appear before<br \/>\nthe court as and when required. The trial court vide<br \/>\nimpugned order dated 28th June, 2001 dismissed the<br \/>\napplication observing:\n<\/p>\n<p>  &#8220;This fact is not disputed that<br \/>\naccused is a rich lady and a wife of film<br \/>\nstar. No proof has been placed on record<br \/>\nthat she has a small child or what is the<br \/>\nage of that child. Even if for the sake<br \/>\nof arguments it is presumed that she has<br \/>\na small child to lookafter but it is not<br \/>\nalleged in her application that there is<br \/>\nno other person including family member<br \/>\nor servant to lookafter the child in her<br \/>\nabsence. Though admittedly she is a<br \/>\nresident of Bombay but now a days Bombay<br \/>\nis well connected with the Delhi by fast<br \/>\ntrains and airways. No problem would<br \/>\narise for the accused to come to Delhi to<br \/>\nattend the date of hearing as it is not<br \/>\nalleged that she had financial problem.<br \/>\nThe Delhi High Court in Geeta Sethi&#8217;s<br \/>\ncase granted exemption to the lady which<br \/>\nwas old and sick. But here in he<br \/>\npresent case the accused is not an old<br \/>\nlady or suffering from any ailment.&#8221;\n<\/p>\n<p> 3. The above order is under challenge. I have<br \/>\nheard learned counsel for the parties and have been<br \/>\ntaken through the record. Learned counsel for<br \/>\nrespondent No.2 very fairly conceded that grant or<br \/>\nrefusal of exemption is within the discretion of the<br \/>\nCourt.\n<\/p>\n<p> 4. admittedly, petitioner is a permanent resident<br \/>\nof Bombay. She has ben summoned as an accused for the<br \/>\noffence under Section 138 of N.I. Act which dies not<br \/>\ninvolve any moral turpitude. It is a summons trial<br \/>\ncase. Section 205 Cr.P.C. constitutes an exception to<br \/>\nthe general rule that the accused must be present in<br \/>\nperson in the course of enquiry for trial during the<br \/>\ncriminal case. this Section empowers the magistrate to<br \/>\ndispense with the personal appearance of the accused.<br \/>\nPower under this Section can be exercised not only when<br \/>\nthe summons are issued against the accused but also at<br \/>\nthe initial stage. Sub-section (1) of Section 205<br \/>\nCr.P.C. undoubtedly gives very wide discretion to the<br \/>\nMagistrate issuing summons to decide whether the accused<br \/>\nshould appear in person or should be permitted to appear<br \/>\nthrough a lawyer but such discretion must be exercised<br \/>\njudiciously. It is a settled proposition of law that<br \/>\nwherever discretion is vested with court it has to be<br \/>\nexercised judiciously keeping in view the attending<br \/>\ncircumstances. For the propose of granting exemption<br \/>\nfrom personal appearance, the court is only to see<br \/>\nwhether it would prejudice the progress of the trial.<br \/>\nThere must be cogent and convincing reasons for<br \/>\nrejection of such application. Exemption should not be<br \/>\nrefused if accused is likely to be put to avoidable<br \/>\nhardship and harassment. The power to dispense with the<br \/>\npersonal attendance of the accused should be liberally<br \/>\nexercised except in the criminal case of serious nature<br \/>\ninvolving moral turpitude or where the offence is<br \/>\npunishable with a sentence of long imprisonment. The<br \/>\ncourt should examine the matter and see whether any<br \/>\nuseful purpose is likely to be served by requiring the<br \/>\npersonal appearance of the accused. Personal attendance<br \/>\nof the accused to receive notice regarding the substance<br \/>\nof accusation and the plea of guilty thereto or not can<br \/>\nalso be recorded in suitable cases in absentia as has<br \/>\nbeen held by Apex Court as well as by this Court in<br \/>\nseveral authoritative pronouncements.\n<\/p>\n<p> 5. The Apex Court in the recent decision passed<br \/>\nin    <a href=\"\/doc\/1255592\/\">Bhaskar Industries Ltd. v. Bhiwani<br \/>\nDenim and Apparels Ltd. and Ors.<\/a>   2001 (2) JCC (SC) 127<br \/>\nconsidered the Section 317 Cr.P.C. which provides<br \/>\nenquiries and trial being held in the absence of the<br \/>\naccuse din certain cases. While considering Section 205<br \/>\nCr.P.C. which empowers the Magistrate to dispense with<br \/>\nthe personal attendance of the accused it was held:-\n<\/p>\n<p>  &#8220;The position, therefore, bogs down to<br \/>\nthis: It is within the powers of a<br \/>\nMagistrate and in his judicial discretion<br \/>\nto dispense with the personal appearance<br \/>\nof an accused either throughout or at any<br \/>\nparticular stage of such proceedings in a<br \/>\nsummons case, if the Magistrate finds<br \/>\nthat insistence of his personal presence<br \/>\nwould itself inflict enormous suffering<br \/>\nor tribulations to him, and the<br \/>\ncomparative advantage would be less.<br \/>\nSuch discretion need be exercised only in<br \/>\nrare instances where due to the    far<br \/>\ndistance at which the accused resides or<br \/>\ncarries on business or on account of any<br \/>\nphysical or other good reasons the<br \/>\nMagistrate feels that dispensing with the<br \/>\npersonal attendance or the accused would<br \/>\nonly by in the interests of justice.\n<\/p>\n<p>However, the Magistrate who grants such<br \/>\nbenefit to the accused must take the<br \/>\nprecautions enumerated above, as a matter<br \/>\nof course.&#8221;\n<\/p>\n<p> (emphasis supplied) <\/p>\n<p> 6. To concluded, while considering the exemption<br \/>\napplication, the question which the court addresses<br \/>\nitself is whether any useful purpose would be served by<br \/>\nrequiring the personal attendance of the accused or the<br \/>\nprogress of the trial is likely to be hampered on<br \/>\naccount of his absence. In this case, an noticed above,<br \/>\ntrial court declined the exemption application only on<br \/>\nthe ground that petitioner is a rich lady, wife of film<br \/>\nstar and can afford to travel from Bombay to Delhi on<br \/>\neach and every date of hearing. The court failed to<br \/>\nconsider that it is bound to cause lot of hardships if<br \/>\nshe is required to come all the way from Bombay to Delhi<br \/>\non each and every date of hearing. The progress of<br \/>\ntrial is not likely to be hampered when the petitioner<br \/>\nwas represented by a lawyer who has full instructions;<br \/>\nwhose power of attorney is on record; who has<br \/>\nundertaken not to seek adjournment because of absence of<br \/>\nthe petitioner. The identity of petitioner is not<br \/>\ndisputed. She has undertaken to appear as and when<br \/>\nrequired. Undoubtedly, a Magistrate granting exemption<br \/>\nfrom personal attendance is also empowered under<br \/>\nSub-section (2) of Section 205 Cr.P.C. to withdraw such<br \/>\nprivilege. In my considered view, the reasoning adopted<br \/>\nby the trial court while dismissing exemption<br \/>\napplication of petitioner is at all not sustainable in<br \/>\nlaw.\n<\/p>\n<p> 7. For the foregoing reasons, petition is<br \/>\nallowed. Impugned order is set aside.
