RAMKUMAR, J.\n             -------------------------------------------------\n               Bail Application No.455 of 2011\n            --------------------------------------------------\n           Dated this the 28th day of January, 2011\n\n                                ORDER\n<\/pre>\n<p>     The petitioner, who is accused No.12 in Crime No.401 of<\/p>\n<p>2009 of Anchal Police Station, for an offence punishable under<\/p>\n<p>Section 55(a) of Kerala Abkari Act, seeks his enlargement on<\/p>\n<p>bail.\n<\/p>\n<p>     2.    The    learned     Public    Prosecutor       on   instructions<\/p>\n<p>submitted that no final report has been filed even after 60 days<\/p>\n<p>of judicial custody of the petitioner.          If so, by virtue of the<\/p>\n<p>proviso to Sec.167(2) Cr.P.C. the petitioner is entitled to be<\/p>\n<p>released on bail as of right.\n<\/p>\n<p>     3.    Accordingly, the petitioner is directed to be released<\/p>\n<p>on bail on his executing a bond for `3,00,000\/- (Rupees three<\/p>\n<p>lakhs only) with two solvent sureties each for the like amount to<\/p>\n<p>the satisfaction of the Magistrate concerned and subject to the<\/p>\n<p>following conditions:-\n<\/p>\n<blockquote><p>     1.    The    petitioner    shall   report    before    the<\/p>\n<p>           Investigating Officer between 9 a.m. and<\/p>\n<p>           11 a.m. on all Wednesdays.\n<\/p><\/blockquote>\n<p>Bail Appln.No.455 of 2011<br \/>\n<span class=\"hidden_text\">                                   -:2:-<\/span><\/p>\n<p>      2.    The petitioner shall not influence or intimidate<\/p>\n<p>             the prosecution witnesses nor shall he attempt<\/p>\n<p>             to   tamper   with    the  evidence   for  the<\/p>\n<p>             prosecution.\n<\/p>\n<\/p>\n<p>      3.    The petitioner shall make himself available for<\/p>\n<p>             interrogation as and when required by the<\/p>\n<p>             investigating officer.\n<\/p>\n<\/p>\n<p>      4.
