Mr. Bhatt for the appellant.\n<\/p>\n<p>4.\tAn<br \/>\ninformation came to be lodged  by Ghemarji Hiraji Thakarda on<br \/>\n18.6.1995 at about 5.00 p.m., at Chhapi Police Station about missing<br \/>\nof his daughter Bhikhiben aged about 14 years from 22nd<br \/>\nMay, 1995. An occurrence report entry was made by number 10\/95 and<br \/>\nlater on converted into F.I.R., when Bhikhiben was found from<br \/>\nAhmedabad and informed that she was taken away by the respondent by<br \/>\nalluring her of marriage and happy life. On the basis of this, F.I.R.<br \/>\nwas registered on 6.8.1995. Investigation was made and charge sheet<br \/>\ncame to be filed. The case was committed to the Court of Sessions and<br \/>\nSessions Case No.19\/1997 was registered. The charge was framed<br \/>\nagainst the respondent at Exh.4 for the said three offences, to which<br \/>\nhe pleaded not guilty and he claimed to be tried. The Trial Court on<br \/>\nthe basis of the evidence, recorded conviction for the said offences<br \/>\nby the judgment impugned and awarded sentence as stated in the<br \/>\nearlier part of the judgment.\n<\/p>\n<p>5.\tThe<br \/>\nlearned Additional Public Prosecutor contended that the sentence<br \/>\nawarded is unduly lenient and the discretion is not properly used by<br \/>\nthe learned trial Judge while awarding sentence. The victim was a<br \/>\nminor girl and, therefore, the trial Court ought to have awarded at<br \/>\nleast the minimum punishment prescribed by law.\n<\/p>\n<p>6.\tUpon<br \/>\nexamining the judgment, particularly the reasoning part, and<br \/>\nexamining the evidence, we find that the prosecutrix was about 15<br \/>\nyears of age at the time of the incident. It  appears that she had<br \/>\nmoved and stayed with the respondent for a long time. It also<br \/>\nappears\tfrom  her evidence that she had gone with the respondent<br \/>\nwillingly and was enjoying physical relationship willingly. However,<br \/>\nin view of the provisions contained in Section 375 of the Code of<br \/>\nCriminal Procedure, since she is below 16 years of age, her consent<br \/>\nbecomes irrelevant. But, keeping this aspect in mind, the trial Court<br \/>\nhas used its discretion and has awarded punishment as stated<br \/>\nhereinabove. We are of the view that in the facts and circumstances<br \/>\nof the case, it cannot be said that the discretion has been used in<br \/>\narbitrary manner or that undue leniency is shown towards the<br \/>\nrespondent so as to call for interference by this Court in its<br \/>\nappellate jurisdiction.\n<\/p>\n<p>7.\tWe<br \/>\nmay also record that the conviction is dated 25th June,<br \/>\n1997 and the respondent has undergone the sentence and has been<br \/>\nreleased from the prison about 10 years back on 7.12.1998.\n<\/p>\n<p>8.\tIn<br \/>\nview of what is stated hereinabove, the appeal must fail and stands<br \/>\ndismissed.\n<\/p>\n<p>\t\t\t\t\t\t\t[<br \/>\nA.L.
