Justice K.T.SANKARAN\n\n Dated :14\/01\/2010\n\n O R D E R\n                         K.T.SANKARAN, J.\n            ------------------------------------------------------\n                      B.A. NO. 109 OF 2010\n            ------------------------------------------------------\n            Dated this the 14th day of January, 2010\n\n\n                               O R D E R\n<\/pre>\n<p>      This is an application for bail under Section 439 of the Code of<\/p>\n<p>Criminal Procedure. The petitioner is the accused in Crime No.384<\/p>\n<p>of 2009 of Vallikunnam Police Station, Alappuzha.<\/p>\n<p>      2.   The offences alleged against the petitioner are under<\/p>\n<p>Sections 354 and 377 of the Indian Penal Code.<\/p>\n<p>      3. The prosecution case is that on 22.11.2009, the petitioner<\/p>\n<p>aged 42, committed the offence on a ten year old girl. The petitioner<\/p>\n<p>is the neighbour of the girl.          The petitioner was arrested on<\/p>\n<p>2.12.2009 and he was remanded to judicial custody.<\/p>\n<p>      4. Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the petitioner,<\/p>\n<p>the nature of the offence and the present stage of investigation, I am<\/p>\n<p>of the view that bail can be granted to the petitioner on stringent<\/p>\n<p>conditions.\n<\/p>\n<p>B.A. NO. 109 OF 2010<\/p>\n<p>                                     :: 2 ::\n<\/p>\n<p>      5. The petitioner shall be released on bail on his executing<\/p>\n<p>bond for Rs.25,000\/- with two solvent sureties for the like amount to<\/p>\n<p>the satisfaction of the Judicial Magistrate of the First           Class,<\/p>\n<p>Kayamkulam, subject to the following conditions:<\/p>\n<blockquote><p>      a)     The petitioner shall appear before the Circle Inspector of<br \/>\n             Police, Kayamkulam between 9 A.M. and 11 A.M. on<br \/>\n             all Mondays and Thursdays, till the final report is filed or<br \/>\n             until further orders;\n<\/p><\/blockquote>\n<blockquote><p>      b)     The petitioner shall appear before the investigating<br \/>\n             officer for interrogation as and when required;\n<\/p><\/blockquote>\n<blockquote><p>      c)     The petitioner shall not enter into the limits of<br \/>\n             Vallikunnam Police Station, till the final report is filed or<br \/>\n             until further orders;\n<\/p><\/blockquote>\n<blockquote><p>      d)     The petitioner shall not try to influence the prosecution<br \/>\n             witnesses or tamper with the evidence;\n<\/p><\/blockquote>\n<blockquote><p>      e)     The petitioner shall not commit any offence or indulge in<br \/>\n             any prejudicial activity while on bail;\n<\/p><\/blockquote>\n<blockquote><p>      f)     In case of breach of any of the conditions mentioned<br \/>\n             above, the bail shall be liable to be cancelled.\n<\/p><\/blockquote>\n<blockquote><p>      The Bail Application is allowed as above.<\/p><\/blockquote>\n<p>                                                    (K.T.SANKARAN)<br \/>\n                                                           Judge<\/p>\n<p>ahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Krishnankutty vs Sub Inspector Of Police on 14 January, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 109 of 2010() 1.
