PATTANAIK (J)\n\nCITATION:\n JT 1996 (7)   208\t  1996 SCALE  (5)686\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     Heard learned counsel on both sides.\n<\/p>\n<p>     This appeal  by special  leave arises against the order<br \/>\nof the\tDivision Bench\tof the\tHigh Court  of Patna,  dated<br \/>\nSeptember 21,  1993 made  in CWJA No.2811\/93. Admittedly the<br \/>\nrespondent had\tentered into an agreement with the appellant<br \/>\nBoard for  supply  of  electricity  pursuant  to  which\t the<br \/>\nrespondent  was\t  required  to\tpay  the  minimum  guarantee<br \/>\ncharges. When  a bill  was issued,  it would appear that the<br \/>\nrespondent had objected to the minimum guarantee bill on the<br \/>\nground that  there was erratic supply of electricity and the<br \/>\nBoard\tunable\tto  supply  the\t required  quantity  of\t the<br \/>\nelectricity. Consequently  the respondent  to not  liable to<br \/>\npay the minimum guarantee under the  contract the High Court<br \/>\nallowed\t the  writ  petition  finding  that  on\t an  earlier<br \/>\noccasion the  High Court  in CWJC No.3642\/92 had disposed of<br \/>\nwrit petitions\ton February  25, 1923 directing the Board to<br \/>\nraise fresh   bill  giving proportionate  reduction  in\t the<br \/>\nannual minimum\tguarantee charges,  but the  same not  being<br \/>\ncomplied with  it is  not open to the Board to give the bill<br \/>\nas impugned in the writ petition.\n<\/p>\n<p>     It is seen that clause 13 of the agreement provides a<br \/>\nunder:\n<\/p>\n<blockquote><p>     &#8220;13. &#8211;  if at any time the consumer<br \/>\n     is\t prevented   from  receiving  or<br \/>\n     using the\telectrical energy  to be<br \/>\n     supplied\tunder\tthis   agreement<br \/>\n     either in\twhole, or in part due to<br \/>\n     strike,   riots,\t fire,\t floods,<br \/>\n     explosions, act of God or any other<br \/>\n     case reasonably  beyond control  or<br \/>\n     if\t the  Board  is\t prevented  from<br \/>\n     supplying or  unable to supply such<br \/>\n     electrical energy\towing to  any or<br \/>\n     all of  the cause\tmentioned  above<br \/>\n     than   the\t   demand   charge   and<br \/>\n     guaranteed, energy\t charge set  out<br \/>\n     in\t  the Schedule\tshall be reduced<br \/>\n     in proportion to the ability of the<br \/>\n     consumer to  take or  the Board  to<br \/>\n     supply such  power and the decision<br \/>\n     of the  Chief Engineer, Bihar State<br \/>\n     Electricity Board,\t in this respect<br \/>\n     shall be final.\n<\/p><\/blockquote>\n<blockquote><p>     Note:  The\t  term\tChief\tEngineer<br \/>\n     includes additional  Chief Engineer<br \/>\n     for the area concerned.&#8221;<\/p><\/blockquote>\n<p>     A reading thereof would clearly indicate that the Board<br \/>\nis enjoined to give proportionate reduction provided any one<br \/>\nof  the\t  conditions  enumerated   therein  had\t occasioned.<br \/>\nObviously, an  application in  that behalf shall be required<br \/>\nto be  filed to\t the Chief  Engineer of\t the Board  who\t was<br \/>\nrequired  to  investigate  into\t the  matter  and  then\t his<br \/>\ndecision  shall\t  be  final.   It  would   appear   that   a<br \/>\nrepresentation was  made, but it is not clear whether it was<br \/>\nto the\tChief Engineer,\t the competent authority in terms of<br \/>\nthe  agreement\t or   any   other   officer.   Under   these<br \/>\ncircumstances,\tunless\t an  application   is  made  to\t the<br \/>\ncompetent authority  to investigate  into  the\tmatter,\t the<br \/>\nboard in  terms of  clause 13 of the contract is necessarily<br \/>\nobliged to  demand and\tthe consumer  is to  comply with the<br \/>\npayment\t of   minimum  guarantee  amount  in  terms  of\t the<br \/>\nagreement subject  to the  decision by\tthe Chief  Engineer.<br \/>\nAccordingly we\tset aside the order of the High Court giving<br \/>\nliberty to  the respondents  to make  an application  afresh<br \/>\nwithin a period of one month from the date of the receipt of<br \/>\nthis order  to the  Chief Engineer,  Electricity Board.\t The<br \/>\nChief Engineer\twould enquire  into and give the decision in<br \/>\nthat behalf. In the event, the Chief Engineer finds that the<br \/>\nBoard was responsible, then necessarily, in terms of clause<br \/>\nthe proportionate reduction is required to be given to<br \/>\nthe respondents.\n<\/p>\n<p>     The appeal is accordingly ordered.
