He further submitted that injunction was granted in<br \/>\nfavour of the respondent in a counter claim contrary to the material<br \/>\non record. He, therefore, submitted that the order dated 7.2.2008 is<br \/>\nrequired to be recalled and reviewed.\n<\/p>\n<p>3.\tI<br \/>\nam, however, of the opinion that this application is not required to<br \/>\nbe granted. Firstly, against order dated 7.2.2008, present review<br \/>\napplication was filed on 6.3.2008. For about 2 years thereafter, no<br \/>\nsteps were taken to get the review application heard. Secondly, the<br \/>\nmain petition pertains to interim injunction pending civil suit. The<br \/>\npetitions were disposed of with following observations:-\n<\/p>\n<p>&#8220;3.\tUpon<br \/>\nhearing the learned advocate for the petitioners and upon perusing<br \/>\nthe material on record, I do not find that the courts below committed<br \/>\nany legal error. They have, prima facie, come to the conclusion that<br \/>\nthe petitioners are not in possession of the suit land contrary to<br \/>\nwhat is contended by the petitioners. Agreement to sell dated 15.1.86<br \/>\ndoes not state handing over the possession of th suit land to the<br \/>\npetitioners. There were other material such as report of the<br \/>\nMamlatdar and Commissioner to indicate that the petitioners were not<br \/>\nin possession.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above position, I do not find that there is any scope for<br \/>\ninterference in exercise of jurisdiction under Article 227 of the<br \/>\nConstitution.\n<\/p>\n<p>5.\tThe<br \/>\nabove observations are made only to decide the interlocutory stage of<br \/>\nthe suit and will not come in the way of the petitioners in perusing<br \/>\ntheir contentions. With these observations, the petitions are<br \/>\ndismissed. It will be open for the petitioners to seek expediting of<br \/>\nthe suits which will be considered by the learned Judge depending on<br \/>\nhis workload.&#8221;\n<\/p>\n<p>4.\tFrom<br \/>\nthe above, it can, therefore, be seen that the observation that the<br \/>\npetitioners were permitted to be brought on record in the civil suit<br \/>\nwas only for narration of facts and even if there is some inaccuracy<br \/>\nin such a statement, the order was not passed on this basis and was<br \/>\nbased on the observations made in para 3 noted hereinabove.\n<\/p>\n<p>5.\tFurther,<br \/>\nI find that the petitioners were granted  liberty to seek early<br \/>\ndisposal of the suit.
