HANSARIA,\t J.-  The  Released  Emergency\tCommissioned<br \/>\nOfficers    and\t  Short\t  Service   Commissioned    Officers<br \/>\n(Reservation  of  Vacancies)  Rules, 1971  (for\t short\t&#8216;the<br \/>\nRules&#8217;)\t came  to  be framed by the President  of  India  to<br \/>\ncompensate  the\t emergency  commissioned  officers  for\t the<br \/>\nchances they had lost by entering public services during the<br \/>\ntime the country needed them.  The Rules apply to those\t who<br \/>\nwere commissioned after 1-1 1-1962 but before 10-1-1968\t and<br \/>\nmake certain percentage of reservation in all Central  Civil<br \/>\nServices and their seniority, on entering these services, is<br \/>\ndetermined on the assumption that they entered the same\t &#8220;at<br \/>\nthe  first opportunity they had after joining  the  training<br \/>\nprior to their Commission or the date of their\tCommission&#8221;.<br \/>\nThe  prayer  of\t the  All  India  ex-Emergency\tCommissioned<br \/>\nOfficers  and Short Service Commissioned  Officers&#8217;  Welfare<br \/>\nAssociation  and other petitioners is that the same  benefit<br \/>\nshould be made available to these categories of persons when<br \/>\nthey join the non-reserved posts also.\n<\/p>\n<p>2.   Shri Kapoor who addressed us on behalf of the aforesaid<br \/>\nAssociation  has  strenuously contended that as\t the  object<br \/>\nbehind\tthe framing of the Rules was to compensate  for\t the<br \/>\nlost  opportunity there is no rational basis in\t classifying<br \/>\nthe  aforesaid\tofficers  in  two  categories\tholders\t  of<br \/>\nreserved  posts\t and nonreserved posts.\t  According  to\t the<br \/>\nlearned counsel, such a classification is hit by Article  14<br \/>\non the well-accepted principle that a classification to pass<br \/>\nthe  test  of  this Article is not only\t to  be\t founded  on<br \/>\nintelligible  differentia,  but the same must  also  have  a<br \/>\nrational  relation to the object sought to be achieved\ti.e.<br \/>\nthere  must be a nexus between the basis  of  classification<br \/>\nand the object behind the same.\n<\/p>\n<p>3.   There  can\t be  no quarrel\t with  the  aforesaid  legal<br \/>\nproposition;  it  has become well entrenched by now.  We  do<br \/>\nnot,  however,\tview this matter as one of  classifying\t the<br \/>\naforesaid ex-servicemen in two categories mentioned by\tShri<br \/>\nKapoor. According to us, a policy decision was taken to give<br \/>\nsome  benefit  to those servicemen who had  stood  with\t the<br \/>\npeople when the country was invaded and had rendered  useful<br \/>\nservice\t during the emergency in question. How much  benefit<br \/>\nand  in\t what  shape it ought to have  been  given  are\t not<br \/>\nmatters on which    courts  can\t have  any  say,  these\t are<br \/>\nexclusively  for  the executive to decide. The\tcourts\tcome<br \/>\ninto  picture in such policy matters if the same  be  either<br \/>\nillegal\t or  irrational or were to  suffer  from  procedural<br \/>\nimpropriety,  as reiterated recently by this Court  in\t<a href=\"\/doc\/884513\/\">Tata<br \/>\nCellular  v.  Union  of\t India&#8217;. We<\/a> do\tnot  find  any\tsuch<br \/>\ninfirmity in the policy at hand.\n<\/p>\n<p>4. This is not all. As the recruitment for the reserved post<br \/>\nis  through separate method, as stated in para 6(b)  of\t the<br \/>\nreply filed on behalf of      Respondents  1 and 2  to\tWrit<br \/>\nPetition No. 151 of 1989, there is no possibility of   some<br \/>\nof  the released officers obtaining reserved posts with\t the<br \/>\nbenefit available   under  the Rules, and  others  obtaining<br \/>\nnon-reserved posts with no benefit visualised by the  Rules.<br \/>\nSo the two types of incumbents have to be taken as belonging<br \/>\nto  two\t different categories; the one having  no  clash  of<br \/>\ninterest with\t    the\t other;\t the  one  being  denied  no<br \/>\nbenefit available to the other.\n<\/p>\n<p>1 (1994) 6 SCC 651 : JT (1994) 4 SC 532<br \/>\n<span class=\"hidden_text\">80<\/span>\n<\/p>\n<p>5.In  view  of the aforesaid, we are not in  a\tposition  to<br \/>\nconcede the prayer made\t in  these  petitions.\t They\tare,<br \/>\ntherefore, dismissed.
